A public hearing on the above Petition was opened on July 15, 2015 pursuant to M.G.L Ch. 40A, 5 11. The public hearing was continued at the request of the petitioner to August 19, 2015 and closed on this date with the following Salem Board of Appeals members present: Peter A. Copelas (Vice-Chair),Jimmy Tsitsinos,Tom Watkins, Mike Duffy,Paul Viccica (alternate). The Petitioner seeks dimensional variances per Sec. 4.1.1 Table of Dimensional Requirements of the Salem Zoning Ordinance for relief from rear and side-yard setbacks, minimum lot area, and minimum lot area per dwelling unit. The applicant withdrew the request for a special permit as the proposal was revised to use the structure as a single-family home. Statements of fact: 1. In the petition date-stamped June 23, 2015 and revised on August 3, 2015, the Petitioner requested variances per Sec. 4.1.1 Table of Dimensional Requirements to allow the construction of a rear addition. 2. A public hearing for the petition was opened on July 15, 2015 and continued to the next regularly scheduled meeting on August 19, 2015 at the request of the applicant after a building code review showed that the proposed architectural plans were non-compliant with the building code. 3. William and Alexandra Peterson,petitioners,presented the petition. 4. The petitioner revised the petition to propose that the building be used as a single-family home due to difficulty being able to structurally meet the means of egress requirements for each unit. 5. The petitioner withdrew the request for a special permit to reconstruct, extend, alter or change a nonconforming structure to construct an additional unit, as the intent is to use the structure as a single-family home. 6. The petitioner requests variances for relief from rear and side-yard setbacks, minimum lot area, and minimum lot area per dwelling unit to construct a rear addition to bring the rear stairwell up to current building code standards. The rear addition is needed to expand an existing rear stairway that is two-feet wide and is not compliant with current building code. 8. The petitioner presented a petition from four (4) abutters in support of the project. 9. The requested relief, if granted, would allow the Petitioner to construct a rear addition to expand an existing rear stairway that does not met current building code standards. 10. At the public hearings four (4) members spoke in favor and no (0) members spoke in opposition to the proposal. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Variance: 1) Given the size and shape of the nonconforming structure the variances requested are warranted because the second egress to the building would not meet current building code requirements without the requested relief. 2) Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the applicant. 3) Desirable relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. June 23, 2015 Statement of Hardship Alexandra and William Peterson 4 Watson Street Salem, MA 01970 City of Salem, Board of Appeal 120 Washington Street, 31d Floor Salem, MA 01970 Dear Board of Appeals, We are proposing to remove an existing 8' x 8' wood deck and an existing Tx 7' single story basement entrance with a 18'-11" x 7-2" two and a half story addition and 3'wide emergency staircase going up to the attic at 4 Watson Street in R-2 Zoning District. The first story footprint of the addition is 13'-10"x 7'-2"with new covered deck. Resulting in a total foot print of 18'-11" x 10'-2". The Zoning Ordinance requires the minimum depth of the rear yard to be 30 feet. The current depth of the rear yard is 29 feet, the proposed addition would reduce the depth of the rear yard to 22 feet. Additionally we are proposing to restore the location of the front door facing the street front of Watson Street and remove the existing side door at the driveway.This will require to add front steps onto the sidewalk at no more than 2'-5" deep. The house at 4 Watson Street was built in 1850's and is now located in an R-2 Zoning District on a 2,650 s.f. lot, where 15,000 square feet is required per the current Zoning Ordinance. Although the lot size in non complaint, the lot coverage is complaint with required percentage of 35%.The existing house is currently taking up 29%, and the proposed lot coverage would go up to 31.7%, managing to stay within the guidelines. The existing house has two existing stairs. The front stair only travels from the first floor to second floor. The rear stair travels from basement, first, second, and attic. The rear stair is a non complaint winding stair case,that is an endangerment to the safety of the occupants, and needs to be relocated. The front door is currently located of off the driveway at the side of the yard, making a hazardous and confusing conditions when approaching the house and driving into the driveway. The proposed layout would make the house more safe and efficient and bring all the necessary means of egress and stairways up to current building code. The proposed addition will address the dangerous condition of the rear stair by relocating the stair into a new addition with a code complaint stair case that will allow the occupants to get to all levels of the house, including basement and attic. The project will also consist of moving the front door of off the driveway in the side yard onto the street frontage (see Figure 1 and 3), to be consistent with street scrape on Watson Street(see Figure 2 and 4). By doing the addition and the front door the overall facade will be stripped of the vinyl siding, and replaced by cedar wood shingles to restore historic appeal of the house.
