VARIANCE FOR 9 WARREN STREET, SALEM SA!
A hearing on this petition was held on March 28, 1984 with the following
Board Members present: james Hacker; Chairman; Richard A. Bencal, Associate
Member and Acting Secretary; Messrs. , Hopper and Strout. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published 11
in the Salem Evening News in accordance with Massachusetts General Laws Chapter
40A.
The petitioner has requested a. Special Permit and/or Variance for the property
in question for the division of a parcel of land containg 11 ,484 square feet of
land. The first parcel would contain 7,588 square feet and an existing structure.
The second parcel would contain 3,896 square feet and would be used to build a -
new house. This property is located in an R-2 district.
The Board of Appeal, after careful consideration of the evidence presented at
the public hearing, and after viewing plans of the property, makes the following
finding of fact: .
1 . Substantial opposition to the petitioner's plan was raised
by neighbors; .
Ir 2.. The., lot to be-made for thenew house -after the subdivision would be
smaller than lots in the area;
3. The rights of the direct abutters with respect to light, air and view
must be. considered.
On the basis of the above findings of fact, and the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The desired Special Permit and/or Variance cannot be granted without-
substantial detriment to the public good_
Therefore, the Zoning Board of Appeal voted unanimously to deny the petitioners
request for a Special Permit and/or Variance.

Dear Mr. Hacker:
With regard to the request for a special permit and/or variance at
9 Warren Street, the Historical Commission would like to remind the
Board of Appeal of the architectural importance of the Warren Street
neighborhood. This importance is reflected in both National Register
designation, as part of the Chestnut Street National Register Historic
District, and inclusion in the local district, the McIntire Historic
District.
Any new construction provided for by special permit and/or variance
would, as you know, be subject to design feview by the Historical Com-
mission. New construction in historic areas is not discouraged by the
Commission, as per the Secretary of the Interior's Standards for Rehabi-
litation, but the Board and any potential builder should be aware of the
sensitivity of design which would be expected. The Commission's review
process would study features such as scale, materials, proportions, and
size to assure compatibility with the architectural character of this
historic area.
It is important that all parties involved realize the design implications
involved in any contemplated new construction. Should the Board have any
questions, please do not hesitate to contact the Commission.

construction of this type would further exacerbate an extremely dense area.

I decided to live at One Warren Street following a tour
of Beverly, Marblehead, and most of the North Shore. I particu-
larly was drawn to the historic and attractive neignborhoods of
this part of Salem. My wife and I have lived here now for seven
months, and we are very hopeful that the atmosphere and appearance
of our area will not be violated by new building, especially when
It disturbs the spacing and lot sizes to which we have grown ac-
customed.
I have signed a petition opposing Mr. Flynn' s attempt to ob-
tain a variance. Unfortunately, due to the fact that I received
notice of the public hearing only recently, I was unable to cancel
a planned business trip in order to appear at the hearing to vocally
e,cpress my opposition.
