A public hearing on the above Petition was opened on February 15, 2017 pursuant to M.G.L Ch. 40A, § 11 and closed on that date with the following Salem Board of Appeals members present: Mr. Duffy (Acting Chair),Mr. Tsitsinos,Mr.Watkins, Mr. Hacker (alternate), and Mr. Viccica (alternate). The petitioner is seeking a Special Permit under See. 3.3.2 Nonconforming Uses of the Salem Zoning Ordinance, to change a non-conforming use from a landscape and painting business office and storage to a glass manufacturer office,warehouse, and product photography studio. Statements of fact: 1. Attorney Atkins presents the petition. 2. In the petition date-stamped January 24, 2017, the petitioner requested a Special Permit under Sec. 3.3.2 Nonconforming Uses of the Salem Zoning Ordinance, to change a non-conforming use from a landscape and painting business office and storage to a glass manufacturer office, warehouse, and product photography studio. 3. The property is located within an R-3 Zoning District. 4. This property is currently used for a construction and landscaping business. The parking lot has been used to store construction vehicles. 5. The petitioner is currently operating a successful retail space at 109 Lafayette and is proposing to expand to a second location for manufacturing and warehousing of products at 64-70 Ward Street. 6. There are nine (9) existing parking spaces on site and on the adjacent vacant lot for one (1) company vehicle and three (3) employees for approximately 1,500 square feet of non-storage gross floor area. The Zoning Ordinance requires a total of five (5) parking spaces. Therefore, the petitioner exceeds the parking requirements. 7. Limited traffic will be generated from this site as the proposed use is primarily for office space, glass manufacturing,and warehousing. 8. The petitioner will have table top torches for glass blowing at this facility with associated filtration equipment. Ventilation for the equipment will be filtered before existing the building through a ventilation system in the roof. The requested relief,if granted,would allow the petitioner to change a non-conforming use from a landscape and painting business office and storage to a glass manufacturer office,warehouse, and product photography studio. 11. At the public hearing one (1) member of the public spoke in favor of, and none (0) in opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Special Permit: The Board finds that the proposed change in use is less detrimental than the existing non- conforming use. 1. Social, economic and community needs served by the proposal. 2. Traffic flow and safety,including parking and loading is adequate. 3. Adequacy of utilities and other public services will not be negatively impacted. 4. Impacts on the natural environment,including drainage will remain the same. 5. The proposal fits with the character of the neighborhood. 6. Potential fiscal impact,including the impact on City tax base and employment is positive. As a neighbor, I wanted to weigh in on behalf of North Shore CDC. As you know, our organization owns 40+buildings in the Point neighborhood. We were founded as a grassroots organization in the late 1970's and are still based in the heart of the Point neighborhood. Our mission is to invest in neighborhoods to create thriving communities. We do this through affordable housing development, civic engagement and neighborhood-based programming to improve the quality of life for families in the Point and other neighborhoods across the North Shore. Over the last few years since Witch Doctor opened, they have been an excellent neighbor and addition to the neighborhood. We're thrilled to see their substantial investment in improving their showroom, a property which before their occupancy struggled for decades with problem tenants and a severe lack of investment. Since they moved in, they have renovated the space and provided a substantial amount of positive foot traffic with their customer base supporting other small businesses on lower Lafayette Street. I'm so happy to hear they are planning to invest additionally in the Point through the 64/70 Ward Street property for additional manufacturing. I'm confident that they will similarly invest in that property to further enhance the neighborhood. We are excited to partner with them and support them in whatever ways we can to make that possible. The owners of Witch Doctor have also been excellent neighbors in that they take responsibility over the cleanliness of their property's exterior. Trash and cleanliness remain a challenge in the Point,but Witch Dr. has been a model small business in helping with this effort. They have also been very generous to the community through volunteer work and donating to such initiatives as our annual toy drive during the holiday season. On any given summer afternoon, it is not unusual to find a Witch Dr staff member playing basketball with the young residents of Ward Street at the 15 Ward Street pocket park. Although their generosity and community mindedness is not directly related to their plans for 64/70 Ward Street, it is excellent for the neighborhood to have businesses like Witch Dr., who genuinely care about their surrounding community, committed to investing in the Point.
