Withdrawal without Preiudice
City of Salem Zoning Board of Appeals
Petition of JOSEPH W. NIGRO III requesting a Variance from minimum lot width and
frontage to subdivide the property located at 51 VALLEY ST, Salem, MA (R-1 Zoning
District).
A public hearing on the above Petition was opened on June 20, 2012 pursuant to Mass
General Law Ch. 40A, § 11. The hearing was closed on June 20, 2012 with the following
Zoning Board of Appeals members present: Rebecca Curran (Chair), Annie Harris, Jamie
Metsch, Michael Duffy, and Jimmy Tsitsinos.
At the request of the Petitioner, the Board of Appeal voted 5-0 (Curran, Harris, Duffy,
Metsch, and Tsitsinos on favor, none opposed) to allow the Petitioner to withdraw this
petition without prejudice.
GRANTED PERMISSION TO WITHDRAW WITHOUT PREJUDICE

Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days of filing of
this decision in the office of the City Clerk. Pursuant to the Massachusetts General Laws
Chapter 40A, Section 11, the Variance or Special Permit granted herein shall not take
effect until a copy of the decision bearing the certificate of the City Clerk has been filed
with the Essex South Registry of Deeds.

Re: Variance to subdivide the property located at 51 Valley St.
Please note that although we are unable to attend the hearing at the Zoning Board of
Appeals on June 20, 2012, we, as property owners at 41 Valley Street adamantly oppose
subdivision of the property located at 51 Valley Street. We feel that subdivision of this
parcel of land will greatly reduce the property values on the street,therefore directly
reducing the value of our property,by allowing an undersize lot to exist and be sold.
Thank you for consideration of this letter as our vote against this variance request.
