DECISION ON THE PETITION OF PETRO THEO PHI 0f0fTCQS�FOR
A VARIANCE FOR 24 VALLEY ST. , SALEM
A hearing on this petition was held on June 20, 1984 with the following Board
Members present: James Hacker, Chairman; Messrs. , Gauthier, Luzinski, Strout
and Associate Member Bencal. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petition is .requesting a Variance from rear setbacks in order to construct
an addition to be used as a family room. The property is located in an R-1 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
Special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district.
The Board of Appeal, after hearing the evidence presented at the hearing, makes
the following findings of fact:
1 . Vigorous opposition was raised by neighbors;
2. Petitioner did not meet his burden of proof as to hardship.
On the basis of the above findings of fact and on the evidence presented at the
hearing the Board of Appeal concludes as follows:
1 . The variance requested cannot be granted without substantial detriment
- to the public good or without substantially derogating from the purpose
of the Ordinance or the intent of the district.
Therefore, the Zoning Board of Appeals voted unanimously against granting
petitioner the requested Variance.

As a result of public notice received concerning the Board of Appeal °
hearing for the above listed name and address, the Salem Fire
Department, reYuest6 the following items to be placed on record .
1. Records at the Salem Fire Prevention office indicate the owner of
record does not have the required Certificate of Compliance for
smoke detectors and is in violation of Chapter 148, Section 26E
of the Mass. General Laws.
2 . As a condition of approval for the Variance requested,the owner
shall be required to provide the Salem Fire Prevention Bureau
with plans for stamped approval and include the installation of
the required smoke detectors, and obtain the Certificate of
Compliance , from the Salem Fire Department.

We, the undersigned, as concerned neighbors, object to Mr. mhel)hilopoulos in
obtaining a variance for rear set backs in order to add a family room on his
house at 24 Valley St.SSalem, Mass.
We feel that he has mismanaged the land that he owns. .He had plenty of land to
build the house that he wants, but chose instead to subdivide his property in
order to build other houses, causing him to build too close to his abutters in
order to gain more land for his personal use and financial gain.

We also feel that hms building these houses so close to each other on small lots
will make the area congested, and will depreciate our properties and neighborhood
by having these properties (literally) in our back .yards.
