The House of Seven Gables ' new petition has greatly
reduced the size of its proposed addition. This, I am
sure, will satisfy many of the neighbors .
We all must address the needed parking in the area, so
that the neighbors can continue to have a parking space
near their homes . The City of Salem, Salem Maritime Site,
Chamber of Commerce, and the Salem Partnership, must work
together to meet these goals .

ASSOCIATION FOR A SPECIAL PERMIT AT 54 TURNER ST. (B-1/R-2)
A hearing on this petition was held May 19, 1993 with the following Board
Members present: Francis Grealish Jr. , Chairman; George Ahmed, Stephen
O'Grady, Stephen Touchette and Associate Member LaBrecque. Notice of the
hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Special Permit to extend
nonconforming structure, the Visitors Center, by allowing construction of
an addition.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is Section 5-3(j ) , which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the
Board of Appeal may, in accordance with the procedure and conditions set
forth in Section 8-6 and 9-4, grant Special Permits for alterations and
reconstruction of nonconforming structures, and for changes, enlargement,
extension or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or expansion
shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be granted
upon a finding by the Board that the grant of the Special Permit will
promote the public health, safety, convenience and welfare of the City's
inhabitants.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. The House of Seven Gables is a registered National Historic Place and a
Massachusetts Historic Landmark which attracts approximately 150,000
visitors per year.
2. The site consists of five (5) historic buildings, as well as the
Visitors Center, which is primarily a coffee shop and restrooms.
3. The Visitors Center was built several years ago to accommodate the then

approximately 25,000 visitors per year coming to the site.
4 . The Visitors Center is inadequate to handle the number of visitors
presently coming to the site.
5 . The proposed addition will include two audio/visual rooms to be used
for "arm-chair" tours, as well as classrooms for visitors.
6. The proposed addition will include handicapped accessible restrooms.
7. Adequate and proper storage space for many historical artifacts will be
included in the proposed addition.
8. The Ward Councillor sent a letter in favor of the proposal.
9. There is no proposed change in use.
10. There will be adequate on-site parking (74) spaces .
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1 . The Special Permit requested can be granted without substantial
detriment to the public good and without nullifying or substantially
derogating from the intent of the district or the purpose of the Ordinance.
2. The granting of the Special Permit requested will promote the public
health, safety, convenience and welfare of the City's inhabitants and may
be granted in harmony with the neighborhood.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Special Permit requested, subject to the following conditions:
1 . Petitioner shall comply with all City and State statutes, ordinances,
codes and regulations.
2. All construction shall be done as per the plans and dimensions
submitted.
3. All requirements of the Salem Fire Department relative to smoke and
fire safety shall be strictly adhered to.
4. Petitioner shall obtain a legal building permit.
5. That any functions held at the site require all music stop by 9:30 p.m.
and that all visitors be off the premises by 10:00 p.m.
6. That petitioner post signs on the site requiring all buses turn their
engines off while loading and unloading passengers and while parked on
site.

approximately 25,000 visitors per year coming to the site.
4. The Visitors Center is inadequate to handle the number of visitors
presently coming to the site.
5. The proposed addition will include two audio/visual rooms to be used
for "arm-chair" tours, as well as classrooms for visitors .
6. The proposed addition will include handicapped accessible restrooms .
7. Adequate and proper storage space for many historical artifacts will be
included in the proposed addition.
8. The Ward Councillor sent a letter in favor of the proposal.
9 . There is no proposed change in use.
10. There will be adequate on-site parking (74) spaces .
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1. The Special Permit requested can be granted without substantial
detriment to the public good and without nullifying or substantially
derogating from the intent of the district or the purpose of the Ordinance.
2. The granting of the Special Permit requested will promote the public
health, safety, convenience and welfare of the City's inhabitants and may
be granted in harmony with the neighborhood.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Special Permit requested, subject to the following conditions:
1. Petitioner shall comply with all City and State statutes, ordinances,
codes and regulations.
2. All construction shall be done as per the plans and dimensions
submitted.
3 . All requirements of the Salem Fire Department relative to smoke and
fire safety shah be strictly adhered to.
4. Petitioner shall obtain a legal building permit.
5. That any functions held at the site require all music stop by 9:30 p.m.
and that all visitors be off the premises by 10:00 p.m.
6. That petitioner post signs on the site requiring all buses turn their
engines off while loading and unloading passengers and while parked on
site.

SCHEDULE A
The Petitioner, the House of the Seven .Gables Settlement
Association, is the owner of the property and is seeking to upgrade
and modernize its Visitors Center. The centerpiece of such an
upgrade is the proposed Education Center addition, which will
include two audio/visual rooms with overhead video projectors, a
lobby/reception area, new rest rooms, a program director 's office
and miscellaneous storage space.
The Association runs several community programs described
below through its Settlement House activities, while also operating
the House of Seven Gables Historic Site. This Site is a registered
National Historic Place and a Massachusetts Historic Landmark,
consisting of five historic buildings as well as the Visitors
Center (coffee shop and rest rooms) . Since 1910, when the House
of the Seven Gables was completely restored and renovated, the
House has been open to the public. The income received from
admission fees is used not only to preserve 'the Site but to provide
funds on a permanent basis to support the work of the Settlement
House. Today, the Settlement House provides community programs
which include a pre-school, day care, after school program, summer
camp and senior citizen program. Fees for all of these programs
are based on ability to pay. Thus, the revenues from admissions
to the Historic Site are essential in supporting the Settlement
House programs.
The existing Visitors Center is non-conforming and a
Special Permit is requested to allow construction of the proposed
addition to this building, which addition will not be substantially
more detrimental to the neighborhood or the public good than the
existing non-conformity.
The proposed construction complies with the provisions
of the zoning requirements and will serve to enhance the visitors '
experience without substantially altering the purpose or manner of
the present Visitors Center. The new construction meets all
density requirements and will not create any new non-conformity on
the Site.
The lot in question is located in both an R-2 and B-1
Zone. The proposed addition would take place in the R-2 portion
of the lot and will not nullify or substantially derogate from the
intent and purpose of the Ordinance or the prior use of the
existing Visitors ' Center.
The proposed addition is reasonable in size and scope and
is intended to serve the flow of visitors already coming to the
Site. Parking for the expanded structure is sufficient as it
exceeds what this Board has previously found adequate. Therefore,
the Petitioner respectfully requests a Special Permit to allow
construction of the addition.
