24 TURNER STREET - ZBA 24 TURNER ST. B-1 House of seven gables I granted-variance-10/20/$2 r I . ' ROBERT C. McCANN ATTORNEY AT LAW 285 WASHINGTON STREET MARBLEHEAD, MA 01945 (617) 631-2456 r i ffit o1 11,em '82 D,T 22 NO ?1 PIIFCrb a JAPp2a, DECISION ON THE PETITION OF THE HOUSE OF SEVEN GABLES r CITY CLc7"S TTLEMENT ASSOCIATION REQUESTING VARI_ SCES FOR .24 TURNER STREET A hearing on this Petition was held on October 20, 1982,, with the following Board Members present: James Hacker, Chairman; Messrs. Piemonte, Hopper, and Feeherry. Notices of the hearing were sent to abutters and others and a notice of the hearing was published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner has requested variance for the property at 24 Turner Street to construct an addition to the existing structure at 114 Derby Street. A variance is required because the proposed addition will violate minimum front yard depth requirements, minimum sideyard (or rear yard) requirements and maximum height restrictions. The Board of Appeal, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1) Petitioner's proposed addition will have a positive effect on the area because of the architectural features of the proposed addition. 2) Petitioner's proposed addition was supported by abutters, and by the Salem Historical Commission. . 3) Petitioner's proposed addition is essential for the efficient operation of the valuable social service programs offered to the community by the petitioner_ On the basis of the above findings of fact, and the evidence presented at the public hearing, the Board of Appeal concluded as follows: 1) The property in question is unique because of its peculiar location, the existing structure at the site, and because of the fact that to locate the proposed addition in any other manner at the site will be less compatible with the area. 2) The conditions described above especially affect the land in question but do not generally affect the zoning district in which the land is located. 3) The conditions described above which affect the land in question, but not the zoning district generally cause the following special hardship: unless a variance is granted, it will be virtually impossible to construct an addition at the site. 4) The desired variance may be granted without substantial detriment to the public good. Therefore, the Board of Appeal unanimously voted in favor of granting the requested relief. The Board granted a variance to the Petitioner on the following terms: 1) A variance is granted to allow construction of an addition to the property in accord— ance with the plans submitted to the Board. • 2) Petitioner shall obtain a Certificate of Use and Occupancy prior to using the .proposed addition. j C - Anthony M.
