Petition of JUDYLYNN MONACO seeking a Special Permit per Sec. 3.1 Principal Urex, to operate a medical
clinic for a portion of the property located at 4 TECHNOLOGY WAY (Map 7, Lot 79) (BPD Zoning
District).
A public hearing on the above Petition was opened on January 21, 2015 pursuant to M.G.L Ch. 40A, 11.
The hearing was closed on that date with the following Salem Board of Appeals members present: Ms.
Curran (Chair),Mr. Duffy,Mr. Watkins,Mr. Copelas, Mr. Tsitsinos (alternate).
The Petitioner seeks a Special Permit from the provisions of Sec. 3.1 Principal Uses of the Salem Zoning
Ordinance.
Statements of fact:
1. In the petition date-stamped December 29, 2014, the Petitioner requested a Special Permit to allow
the use of a medical clinic for a portion of the property located at 4 Technology Way.
2. Ms.Joanne O' Connell, architect with NEMD Architects, Inc. of Providence, Rhode Island presented
the petition on behalf of the applicant Davita Healthcare Partners. The petitioner,Judylynn Monaco,
project manager and Ms.Julie Higgins Van Sickle, facility administrator for Davita Healthcare Services
regional office located in Salem,MA were also present.
3. The petitioner,Davita Healthcare Partners is requesting a Special Permit per Sec. 3.1 Principal Uses to
operate a medical clinic in a portion of property located at 4 Technology Way.
4. The current use of 4 Technology Way is research, technology and general office space.
5. The proposed medical clinic is a dialysis center that would provide services to approximately 66-88
Patients per day and staff thirty-two (32) employees per day.
6. The current facility located at 10 Colonial Road in Salem does not meet current service demand.
Therefore the company is seeking the possibility of relocation to 4 Technology Way.
7. The proposed hours of operation of the dialysis clinic are from 5am to Bpm.
8. Approximately 22 patients would access the site independently by car or by ambulance services in
three shifts per day starting at Gam, l lam, and 4pm.
9. The facility will also have 1-2 deliveries made per week by a tractor trailer.
10. There are a total of ninety-five (95) parking spaces forth entire shared facility. The handicapped
spaces that are located closest to the proposed clinic entrance would be designated for the dialysis
center,while the remaining parking options for patients and employees will be first come first serve.
11. The requested relief, if granted, would allow the Petitioner to operate a medical clinic for a portion of
the property at 4 Technology Way.

12. A petition in opposition was submitted as part of the records for this petition.
]3. At the public hearing no (0) members of the public spoke in favor of and five (5) members spoke in
Opposition to, the petition. The opposition was generally on the grounds that the proposed use was in
conflict with the industrial park.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
aper thorough review of the petition, including the application narrative and plans, and the Petitioner's
Presentation and public testimony, makes the following findings that the proposed project meets the
Provisions of the City of Salem Zoning Ordinance:

4. There are no impacts on the natural environment including drainage as no additional construction is
proposed.
5. A medical clinic, as proposed,is inconsistent and incompatible with current uses at this location.
6. The potential fiscal impact,including impact on the City's tax base and employment would be
positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted none (0) in
favor and five (5) opposed (Rebecca Curran,Peter A. Copelas, Mike Duffy, Tom Watkins and Jimmy
Tsitsinos), to grant a Special Permit, to allow the operation of a medical clinic located at 4 Technology Way.

Statement of Grounds
DaVita Healthcare Partners is investigating the possibility of relocating their clinic from 10 Colonial Road,
Salem to a larger more accessible site at 4 Technology Way. DaVita Health Care would like to relocate in
order to better serve their patient. The new clinic would allow for an increase from a 16 patient clinic
to a 22 patient clinic. In addition the clinic would include a Home Training suite for healthier, more
mobile patients. Regional offices would be moved to this location. The facility at 4 Technology Way will
provide better access and more accessible parking. Additional staff will be needed to assist in treating
the additional patients.
Because a treatment lasts from 3 to 6 hours,the total number of dialysis patient receiving treatment will
be about 88 patients. The number of individuals' receiving home training will vary from 4 to 6 per day.
Staff will total about 32 individuals. The clinic will receive supplies via semi-trailer about 1 or 2 times a
week. The impact of this traffic in the Business Park Development will be negligible.
A covered canopy will be added at the proposed clinic entrance. A new staff entrance will be added on
the west side of the building. Existing parking will be restriped to increase the number of handicapped
accessible spaces resulting in a net loss of 3 to 4 spaces in the building. Supplies brought in by the semi-
trailer will be unloaded at the service entrance near the existing loading dock. This area would also
serve as the location for the clinic dumpster. A second emergency generator will be added near the
existing emergency generator. Site plan is attached. No additional parking or site changes are
proposed.
This site is located in a Business Park Development. This interior build-out will not have any impact on
the habitat or neighborhood character.

Dear Ms. Curran and Members of the Board:
It has come to our attention that an Application has been filed by DaVita
Healthcare Partners seeking a Special Permit to operate a medical clinic at 4
Technology Way.
We, the undersigned businesses, are opposed to such a use being
allowed.
As the owners of the existing manufacturing facilities on and about
Technology Way, we are extremely concerned about any such use being located
on Technology Way. The ingress and egress off of Swampscott Road is a single
curb cut from which all tractor trailers, delivery vehicles and employees enter.
The park is designated for manufacturing, research, and industrial uses, and any
type of "retail consumer" use such as a medical clinic will stray from the intent of
this business park. A use such as a clinic will create conflict in traffic movements
between the many trailer trucks and other vehicles servicing our plants with
consumers and public patients in what is already a precarious situation.
It is our hope and intent to continue to invest, improve and expand our
manufacturing facilities within the park to create new jobs and taxes for the City
of Salem. To allow consumer oriented uses, such as medical clinics, would give
us great pause in any future investments we might make. They layout of

DaVita Healthcare Partners is investigating the possibility of relocating their clinic from 10 Colonial Road,
Salem to a larger more accessible site at 4 Technology Way. DaVita Health Care would like to relocate in
order to better serve their patient. The new clinic would allow for an increase from a 16 patient clinic
to a 22 patient clinic. In addition the clinic would include a Home Training suite for healthier, more
mobile patients. Regional offices would be moved to this location. The facility at 4 Technology Way will
provide better access and more accessible parking. Additional staff will be needed to assist in treating
the additional patients.
Because a treatment lasts from 3 to 6 hours,the total number of dialysis patient receiving treatment will
be about 88 patients. The number of individuals' receiving home training will vary from 4 to 6 per day.
'Staff will total about 32 individuals. The clinic will receive supplies via semi-trailer about 1 or 2 times a
V q% week. The impact of this traffic in the Business Park Development will be negligible.
�r � A covered canopy will be added at the proposed clinic entrance. A new staff entrance will be added on
the west side of the building. Existing parking will be restriped to increase the number of handicapped
n�5 accessible spaces resulting in a net loss of 3 to 4 spaces in the building. Supplies brought in by the semi-
trailer will be unloaded at the service entrance near the existing loading dock. This area would also
serve as the location for the clinic dumpster. A second emergency generator will be added near the
existing emergency generator. Site plan is attached. No additional parking or site changes are
proposed.
