The proponent would like to install a demonstration residential-scale wind turbine at the recently renovated 96 Swampscott Road facility. The proposed wind turbine consists of a thirty four (34) foot high tower upon which will be mounted a wind blade mechanism. The location has been selected to provide optimum wind flow conditions for the turbine. Per discussions with the City Zoning Officer, the proposed wind turbine is defined as an accessory structure pursuant to Section 7.8 Accessory Buildings and Structures of the City of Salem Zoning Ordinance. The proposed wind turbine is 41 feet in height when the blades are in their highest position. Pursuant to Article VII, Supplementary Regulations, Section 7.8, Accessory Buildings and Structures, the maximum allowable height of Accessory Structures is 1'/2 stories or 18 feet and thus a height variance from this provision of the Zoning Ordinance is required. To my knowledge, no previous applications have been submitted to the Zoning Board for this property in the recent past. Special conditions and circumstances that especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district. The subject property is located in the Business Park Development zone where building heights of up to 50feetare allowed. The proposed turbine is well below this height. The location has been selected to provide optimum wind flow conditions for the turbine. The City of Salem Zoning Ordinance does not specifically list wind turbines in its list of allowable uses. The Zoning Officer has determined that the wind turbine is an accessory structure and as such, the maximum allowable height limit for the wind turbine is eighteen (18) feet. The wind turbine is being installed as a demonstration project for residential applications and is therefore a unique structure. The proponent is not aware of any other wind turbines that have been or are being proposed in the City of Salem. Granting the variance to allow the wind turbine at this location will not affect other lands, buildings or structures in the same district. Furthermore, with the exception of the blade portion of the turbine, the structure is similar in design and mass to the large parking lot light poles that already exist on the site. Finally, the wind turbine is proposed to be located along the top of the side slope along the entrance road which is down-gradient grade of the existing building which reduces the height impact of the structure relative to the existing building. B. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the applicants. Literal enforcement of the provisions of Section VII, Section 7.8 of the Salem Zoning Ordinance would prohibit the installation of the proposed wind turbine. There are no wind turbines in commercial production that could comply with the maximum zoning height of eighteen (18) feet to the Proponent's knowledge. l Ms. Cohen Salem Zoning Board of Appeals April 26, 2007 Page 4 of 5 C. Desirable Relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district or purposes of the ordinance. Granting of the height variance to allow the proposed wind turbine in the Business Park District will not result in substantial detriment to the public good. Wind turbines are a new"green" energy saving technology being researched and developed all over the country. Granting of the height variance will not nullify or substantially derogate from the intent of the Business Park District or other purposes of the zoning ordinance. The structure is nine (9) feet lower than the allowable height of buildings in the Business Park District and, due to its small mass; the structure will not create shadows on adjacent structures or present any other adverse impacts that are typically associated with increased height allowances for accessory structures. I am also a member of the City's Renewable Energy Task Force. As a member of the Task Force I have spent hours studying turbine technology and turbine installations throughout the Commonwealth.It is my personal opinion that the plan Groom has for the turbine at 96 Swampscott Road is good for Salem for three reasons. One,the technology being installed is state-of-the-art and does not have some of the limitations that older wind technology had;two,Salem would be a leader in promoting renewable energy technology; and three, Salem would be supporting a Salem-based company that is a leader in the wave of the future: environmentally friendly building and energy. I have heard from many residents and businesspeople that Salem should be a leader in renewable energy and this project goes a along way toward doing that. Many cities and towns throughout Massachusetts have tried to site turbines with limited success. Presently the Renewable Energy Task Force is working toward helping draft an ordinance to provide Salem business and homeowners some framework to go by if they want to install a residential turbine. This ordinance,along with successful turbine installations like the one before you tonight,create an atmosphere where new technology gets more and more accepted and therefore more and more successful. In order for Salem to be a leader,the Board must take the lead and allow this installation. I think it is important to allow Groom to install this turbine so that Salem residents,as well as residents from surrounding towns,can see an installation and decide for themselves whether or not a turbine is right for them and their home. Until we allow an installation all of the discussion about noise and visual is hypothetical. With all due respect to the neighbors there is little chance that they will be disturbed by the turbine,certainly the truck noise from Swampscott Road is more severe! And the power lines are far more obtrusive than the turbine tower. The concerns that many people have about turbines is often the result of word of mouth and is based on complaints about older wind turbine designs. I have met with Groom and toured their site. The turbine that is being proposed is the state-of-the-art. In addition,the proposed installation site is industrial and there is a buffer of well over 100 feet to the residential area,more than what is suggested in some studies to allow for noise. This installation will be good for Salem and we should support a new Salem company that has made its business model reflect the times we now live in,where renewable energy and green building is the future.
