Petition of JOHN O'NIEL for Variances from Sec. 3.2.4 subsections 2 and 4A theYplem Zoning
Ordinance, in order to allow the vertical expansion of two existing storage bins and the development
of two new storage tanks closer than ten feet to the principle building and that exceed eighteen feet
in height at the property located at 96 SWAMPSCOTT RD (BPD Zoning District).
A public hearing on the above Petition was opened on April 17, 2013 pursuant to M.G.L Ch. 40A, 5 11. The
hearing was continued to and closed on May 15, 2013 with the following Zoning Board of Appeals members
present: Ms. Curran (Chair), Ms. Harris (Vice Chair), Mr. Dionne, Mr. Duffy, Mr. Watkins, Mr. Eppley
(Alternate) and Mr.Tsitsinos (Alternate).
Petitioner seeks Variances from Sec. 3.2.4 subsections 2 and 4 of the Salem Zoning Ordinance.
Statements of fact:
1. Marc Hazel and Helene Stevens presented the petition for the property at 96 Swampscott Rd (BPD
Zoning District).
2. In the petition, March 26, 2013, the petitioner Variances from Sec. 3.2.4 subsections 2 and 4 of the
Salem Zoning Ordinance,in order to allow the vertical expansion of two existing storage bins and the
development of two new storage tanks closer than ten feet to the principle building and that exceed
eighteen feet in height. At the April 17, 2013 regular meeting, the petitioner provided supplementary
noise and trucking documentation for consideration.
3. The petitioner is requesting the allow the vertical expansion of two existing storage bins and the
development of two new storage tanks closer than ten feet to the principle building and that exceed
eighteen feet in height. The petitioner's proposed dimensional requirements include:
- Extend two (2) existing flour storage bins to 38'-6"
- Construct one (1) CO2 storage tank to 38'-9"
- Construct all tanks 1' from an existing structure
4. At the first hearing for this petition numerous members of the public in attendance spoke in
opposition to the petition due to noise and truck delivery concerns. At the April 17, 2013 meeting,
numerous Councilor Siegel spoke in favor of the petition and the steps taken by the applicant to
address the noise and delivery concerns. No written comments were submitted in opposition or
support of the petition prior to the hearings.
The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and after
thorough review of the plans and petition submitted,makes the following findings:

1. The desired relief may be granted without detriment to the public good and without nullifying or
substantially derogating from the intent or purpose of the Cityof Salem Zoning Ordinances.
2. The literal enforcement of the City of Salem Zoning Ordinance's Table of Dimensional Requirements
would be physically impossible to apply due to the unique orientation and present location of existing
structures on the parcel.
3. The installation of noise baffling buffers and truck delivery regulation measures greatly reduce the off-
site impacts of the proposed development on the surrounding neighborhood.
4. In permitting such relief, the Board of Appeals requires certain appropriate terms, conditions and
safeguards as noted below.
On the basis of the above findings of fact and all evidence presented at the public hearing including, but not
limited to, the plans,documents and testimony,the Zoning Board of Appeals concludes:
1. The petitioner's requested Variances to allow vertical expansion of two existing storage bins and the
development of two new storage tanks closer than ten feet to the principle building is granted as
conditioned.
In consideration of the above, the Salem Board of Appeals voted to approve the Variances requested. All the
members voted in favor, with a 5-0 vote in favor (Ms. Curran (Chair), Ms. Harris (Vice Chair), Mr. Dionne,
Mr. Duffy, and Mr. Watkins) and none opposed. The Board of Appeals voted to grant petitioner's request for
a Special Permit subject to the following terms,conditions,and safeguards:
1. The Petitioner shall comply with all cityand state statutes,ordinances,codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the
Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but
not limited to,the Planning Board.
8. The petitioner his successors or assigns shall comply with all MassDEP Standards and Regulations for
noise.

Dear Marc:
We visited your facility on May 8, 2013,to measure noise on your rooftop and in the residential
community near your facility.
In summary, operations at Jacqueline's Gourmet Cookies do not appear to violate the noise
policy interpretation of the MA Department of Environmental Protection(DEP). We found that
noise from operations at Jacqueline's Gourmet Cookies does not cause significant increases in
the overall average ambient sound levels in the adjacent neighborhoods—increases in A-
weighted sound levels are well below the limits defined by the DEP policy. Operations of the
nitrogen pump on the nitrogen delivery trucks, however, are more clearly audible in the
neighborhood because of the spectral nature of the source,but the sound does not violate the
DEP's noise policy with respect to tonal noise.
Observations of Existing Physical and Environmental Conditions
We first visited the Jacqueline's Gourmet Cookies facility in Salem,MA in 2009. A third high-
velocity nitrogen exhaust fan has been added to the rooftop since our 2009 visit; each is outfitted
with a sound attenuator approximately 5 feet in length as shown in Figure 1.

The facility sits approximately 650 feet away from the nearest residential property line,which is
located off of Brittania Circle on the opposite side of Swampscott Road from the facility. Figure
2 shows a view of the condominium residences from the rooftop of Jacqueline's Gourmet
Cookies, and Figure 3 (below)shows a map of the area with sound measurement locations
marked.

On the day of our measurements,the weather was overcast, 50 to 60 degrees,with moderate
winds. Light rain came and went throughout the day; all of the measurements reported here
were conducted at times when it was not raining.
Domestic air-conditioning units were operating at many condominiums in the neighborhood,
cycling on and off throughout our measurements. They produce some audible noise in the
neighborhood, although the predominant source of neighborhood noise is traffic on Swampscott
Road.

Applicable Standards and Noise Guidelines
The MA State DEP has a noise policy stating that noises at residential property lines should not
increase the ambient background sound level by more than 10 dBA. Although we have not done
24-hour noise monitoring,our measurements,discussed below, indicate that normal factory
operations(including the use of the three rooftop nitrogen exhaust fans)increase the ambient
noise levels by less than 6 dBA,well within DEP's 10-dB policy limits.
The DEP policy also prohibits what it calls a"pure tone condition,"which it defines as a noise
condition where"any octave band center frequency sound pressure level exceeds the two
adjacent center frequency sound pressure levels by 3 decibels or more." Normal operations of
the Jacqueline's Gourmet Cookies facility are broadband, and contain no tonal components.
However,the occasional delivery of nitrogen to the facility generates audible sound in the
surrounding neighborhood,but we did not measure any instances where that sound met the
DEP's definition of a"pure tone condition."
We are not familiar with any ordinance in the city of Salem, MA that further regulates this kind
of building operation noise.

Measurement Results
We used a calibrated ANSI Type 1 sound level meter to measure sound pressure levels on the
Jacqueline's Cookie Factory rooftop and in the community.
On the day of our measurements,the facility was in operation until approximately 6:30pm. A
nitrogen delivery took place starting just before 4:00pm. We made measurements during the
nitrogen truck delivery, during normal operations after the delivery, and after 6:30pm when the
facility had ceased all operations.
Traffic on Swampscott Road was fairly heavy during our measurements, including several heavy
trucks,up until the evening rush hour;traffic was similar,perhaps with fewer trucks, but still
steady during our measurements after 6:30pm.

Observations, Conclusions, and Recommendations
In general, our measurements in May of 2013 are consistent with our measurements from 2009,
when we also found very little increase in neighborhood noise levels as a result of rooftop
equipment at Jacqueline's. In 2009,we made nighttime measurements in the neighborhood and
turned the nitrogen exhaust fans on and off in order to make a direct,back-to-back comparison;
the results of those measurements are described in our report to you from August 18, 2009.
Residential Air Conditioning
Our measurements were made during a humid day,when domestic air-conditioners were in
occasional use, cycling on and off. On cold days,when neighbors are not using air-conditioning
units and tend to have their windows closed, some sound from rooftop and other equipment at
the factories across Swampscott Road may be detectable. On days when traffic may be lighter,
this may also increase the detectability of such sounds.
Tonal noise
Operation of the nitrogen refilling trucks was not found to violate the MA DEP noise policy for
a"pure tone condition.".That said,the sound from these trucks is clearly audible in the
neighborhood across from the factory, and we understand that residents in the area have
complained about this noise specifically. In the interest of maintaining a"good neighbor"
policy,we recommend that you consider exploring ways that nitrogen truck delivery noise might
be mitigated.

Conclusions
In our professional opinion, equipment associated with operations at Jacqueline's Gourmet
Cookies is not in violation of MA DEP guidelines. However,we recommend that you explore
ways to reduce the transmission of the nitrogen pump sound into the neighboring community,
particularly if your future plans for expansion will increase the number of nitrogen deliveries
made to your facility.
