A hearing on this petition was held June 26, 1991 with the following Board Members
present: Richard Bencal, Chairman; Richard Febonio, Edward Luzinski, Mary Jane
Stirgwolt and Associate Member Ronald Plante. Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Special Permit to allow
construction of an addition in this R-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which is provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set for in Section VIII
F and IX D, grant Special Permits for alterations and reconstruction of nonconformin€
structures, and for changes, enlargement, extension, or expansion on nonconforming
lots, land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the
existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The proposed addition will provide ground level living quarters for the
present occupants who have lived in the house for over fifty (50) years.
2 The proposed addition will contain a bedroom and bath only, not an additional
and separate dwelling unit.
3. Several neighbors spoke in favor of this petition.
4. One abutter spoke in opposition to the petition citing reduced sunlight
on this back porch due to the height of the proposed addition.
5. The petitioner expressed willingness to adjust the proposed roof pitch
to ameliorate the adverse impact of the addition on the abutters porch.
On the basis of the above findings of fact, and on the evidence presented at the
hearing the Board of Appeal concludes as follows:
1 . The granting of the Special Permit requested will promote the public health,
safety convenience and welfare of the City's inhabitants and will be in.
harmony with the neighborhood.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the Special
Permit requested, subject to the following conditions:
1 . All construction be in compliance with city and state building codes.
2. All construction be as per the plans and dimensions submitted and amended with
the roof pitch lowered to 6 to 12.
3. A building permit be obtained.
4. A certificate of occupancy be obtained.
5. Exterior finishes of the proposed addition be in harmony with the existing
structure.
6. All requirements of the Salem Fire Department relative to smoke and fire
safety be strictly adhered to.

1- This property (has no) (4A*&) compliance with the provisions of the Massachusetts

smoke detectors. The applicant will be required to contact the Salem Fire Preven-
tion Bureau in order to bring his dwelling up to code relative to automatic smoke

1- This property (has no) (tOtO compliance with the provisions of the Massachusetts
General Laws, Chapter 148, Section 26E, relative to the installation of automatic
stroke detectors. The applicant will be required to contact the Salem Fire Preven-
tion Bureau in order to bring his dwelling up to code relative to automatic stroke
dal-antnra_
2- Plans for the proposed construction are to be presented to the Salem Fire Prevention
Bureau for approval prior to the issuance of a building permit.
3- The proposed construction shall conform to all applicable provisions of the Massa-
chusetts State Building Code, the Salem Fire Prevention Code, 527CMR(Code of Massa-
chuestts Regulations) , the Salem City Ordinances, and Massachusetts General Laws
relative to fire and public safety.
4- The applicant and/or contractor shall arrange for an inspection by the Salem Fire
Prevention Bureau upon cenpletion of the work.

The Application for Permit was denied by the Inspector of Buildings for the following
reasons:

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem
Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed, as the enforcement of said
Zoning By-Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially dero-
gating from the intent and purpose of the Zoning Ordinance and Building Code for
the following reasons:

1) To .allow for first floor sleeping and bathrom facilities for 70 year old
physically and medically-handicapped person. Present structure requires the.
occupant to ascend and descend stairs which is no longer possible.
2) The two additional occupants of the house are a 72 year. old wcaa and 78 year
old man.
3) All three occupants have lived in the house for the past 68 years.
