A hearing on this petition was held March 20, 1991 with the toftowing Board Members
present: Richard Bencal, Chairman; Joseph Correnti, Secretary; Richard Febonio,
Mary Jane Stirgwolt and Associate Member Arthur LaBrecque. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published
in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting Variances from all the requirements
listed on Table I of the Salem Zoning Ordinance Density Regulations. The property
is located in an R-2 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures, in the same district.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
c. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and after
viewing the plans, makes the following findings of fact:
1 . That presently there is a storage garage located at the sight which the petitioner
proposes to raze in order to construct a new one family dwelling
2. That the lot is 2400 sq.ft. and would require variances for front, rear and
side yard setbacks, density and frontage, as well as minimum lot size.
3. That the current owner has owned the lot for less than a year.
4. That the proposed dwelling house would be either stick built or pre-fabricated
but the dimensions in either case would remain the same.
5. That there was no opposition to the petition during the public portion
of the hearing.
6. That Edward Martins, a direct abutter, spoke in favor with the condition that
there be a seven foot rear setback, that a six foot high wooden fence be
erected along the back property line, and that any, windows in the rear of the
house be as per plan submitted .
7. That one other abutter spoke in favor of the petition.

Dear Rich:
This letter is in regards to the plans that you dropped off for
review regarding the above project. I would like to state that the
following comments are preliminary and final comments will be made
when a variance is granted and the owners apply for a building
permit.
1) The proposed sewer main should be 8" PVC with wyes
installed for future connections by other abbutters .
2) The proposed manhole will be precast concrete with steps
and be located as close to the end of Skerry St. Court
as possible. t
3) The proposed water main shall be 8" Ductile Iron Concrete
lined with a 811 water gate at the intersection of Skerry
Street and Skerry St. Court. Also at the end of the main
their will be either a 2" blow off or fire hydrant
depending on requirements -of the Fire Department.
4) Final plans submitted for a building permit should also
Include site features such as sidewalks, curbing,
grading of driveway etc.

proposed constraction of a single family house on Skerry St- Court- He has
come to us and shown us what he intends to do and asked how our
concerns could be met- We have reviewed his plans and find that he has
made a reasonable attempt to satisfy the neighborhood's concerns. We, his ,

Dear Rich:
This letter is in regards to the plans that you dropped off for
review regarding the above project. I would like to state that the
following comments are preliminary and final comments will be made
when a variance is granted and the owners apply for a building
permit. ,
1) The proposed sewer main should be 8" PVC with wyes
installed for future connections by other abbutters .
2) The proposed manhole will be precast concrete with steps
and be located as close to the end of Skerry St. Court
as possible.
3) The proposed water main shall be 8" Ductile Iron Concrete
lined with a 81' water gate at the intersection of Skerry
Street and Skerry St. Court. Also at the end of the main
their will be either a 211 blow off or fire hydrant
depending on requirements of the Fire Department.
4) Final plans submitted for a building permit should also
Include site features such as sidewalks, curbing,
grading of driveway etc.

struction of a single family dwelling at Skerry Street Court, subject to the following
conditions:
1- Plans for the proposed construction are presented to the Fire Prevention Bureau for
approval prior to the issuance of a building permit.
2- The proposed construction shall conform to all applicable provisions of the Massa-
chusetts State Building Code, 527 CMR (Code of Massachusetts Regulaitons) , the Salem
Fire Prevention Code, the Salem City Ordinances, and Massachusetts General Laws
relative to fire safety.
3- The applicant shall arrange for an inspection by the Fire Prevention Bureau upon

1) The proposed sewer main should be 8" PVC with wyes
installed for future connections by other abbutters .
2) The proposed manhole will be precast concrete with steps
and be located as close to the end of Skerry St. Court
as possible.
3) The proposed water main shall be 8" Ductile Iron Concrete
lined with a 81' water gate at the intersection of Skerry
Street and Skerry St. Court. Also at the end of the main
their will be either a 2" blow off or fire hydrant
depending on requirements of the Fire Department.
4 ) Final plans submitted for a building permit should also
Include site features such as sidewalks, curbing,
grading of driveway etc.

DECISION ON THE PETITION OF Mark Petit
FOR VARIANCES AT Skerry Street Court
A hearing on this petition was held on March 20, 1991,
with the following Board Members present : Chairman Richard
Bencal, Richard Febonio, Arthur Labreque, Joseph Correnti, Jane
Stirgwalt .
Notice of the hearing was sent to abutters and others, and
notices were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting variances from all of the requirements
listed on Table I of the Salem Zoning Ordinance;
in this R-2 zone.
The variances requested may be granted �pon a finding by
. this Board that:
1 . Special conditions and circumstancei e' xist which
especially affect the land, building or structure involved and
which are not generally affecting other land, buildings and
structures in the district .
2 . Literal enforcement of the provision's of the zoning
ordinance would involve substantial hardship, financial or
otherwise to the petitioner.
3 . Desirable relief may be granted witl�but substantial
detriment to the public good and without nullifying or
substantially derogating from the intent of the district or the
purpose of the ordinance.
The Board of Appeal, after careful consideration,.of the
evidence presented at the hearing makes the following findings
of fact :
1. That presently there is a storage g�rage located at the
sight which the petitioner proposes to raze in order to
construct a new one family dwelling;
2 . That the lot is 2400 S.F. and would require variances
for front, rear and sideyard setbacks, density and frontage, as
well as minimum lot size;
3 . That the current owner has owned the lot for less than
a year;
4 . That the proposed dwelling house would be either stick
built or pre-fabricated but the dimensions in either case would
remain the same;
5 . That there was no opposition to the petition during the
public portion of the hearing.
6 . That Edward Martins, a direct abutter, spoke in favor
with the conditions that there be a seven foot rear setback,
that a six foot high wooden fence be erected along the back
property line, and that any windows in the rear of the house be
as per plan submitted;
7 . That one other abutter spoke in favorof i-biz.-np.t-Ation.
Wherefore, the Zoning Board of Appeals 'voted 3-2, with Mrs-.
Stirgwolt and Mr. Correnti voting against, to allow the
variances requested subject to the following conditions :
1 . That the petitioner obtain all necessary building
permits .
2 . That a certificate of occupancy 88 obtained.
3 . That all rules and regulations of' ,the Salem Fire
Department and the Fire Prevention Code be' ;trictly adhered to.
4 . That all city and state building codes be strictly
adhered to.
5 . That the dwelling be per plans and' dimensions submitted.

6 . That the square footage of window and door area in the

rear of the building remain the same in peib&tuity.
7 . That the proper numbers from the City assessor ' s office
be obtained.
8 . That a six foot stockade fence run a' l'ong the entire
rear property line.
9 . That the appropriate number of parking spaces be
maintained on the premises .
10 . That no further encroachment on �List non-conforming
lot be allowed.
Wherefore, failing to obtain the neces'La'ry� �our votes to
grant the variances, the petition is hereb� denied.
