Petition of MICHAEL BECKER requesting Variances from the requirements of Sec. 4.1.1 Table of
Dimensional Requirements of the Salem Zoning Ordinance to allow a reduction in minimum lot
area and minimum lot size per dwelling unit to create a rear lot located at 48 SCHOOL STREET _
(Map 27, Lot 5) (112 Zoning District).
A public hearing on the above Petition was opened on May 20, 2015 pursuant to M.G.L Ch. 40A, ( 11. The
hearing was closed on that date with the following Salem Board of Appeals members present: Rebecca
Curran (Chair), Peter Copelas,Jimmy Tsitsinos,Tom Watkins and Mike Duffy.
The petitioner is seeking Variances requesting relief from Sec. 4.1.1 Table of Dimensional Requirements of the
Salem Zoning Ordinance to allow a reduction in minimum lot area and minimum lot size per dwelling unit to
create a rear lot when merged with a portion of 46 School Street.
1. In the petition date-stamped April 28, 2015, the Petitioner requested a Variances seeking relief from
Sec. 4.1.1 .Table of Dimensional Requirements to allow a reduction in minimum lot area and minimum lot
size per dwelling unit to create a new rear lot when merged with a portion of 46 School Street.
2. Attorney Correnti presented the petition on behalf of the applicant.
3. The existing lot is 15,399 square feet but is nonconforming in lot width, lot frontage and front and side
setbacks.
4. The petitioner proposed to reduce the size of the lot from 15,399 square feet to 6,873 square feet,
while not changing the lot width or existing setbacks.
5. The requested relief, if granted, would allow the Petitioner to reduce the lot area from 15,399 square
feet to 6,873 square feet.
6. At the public hearing four (4) members of the public spoke in favor, of and one (1) spoke in
opposition to, the petition. A petition of support from numerous abutters was also submitted by the
Petitioner.
7. The Petitioner demonstrated at the hearing that the lot was unique units size, shape and topography in
the district by review of an assessor's map showing hundreds of lots in the neighborhood.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:

Findings for Variance:
1. Special conditions and circumstances that especially affect the land, building or structure generally not
affecting other lands, buildings or structures in the same district include the steep slope and grade of the
property, as well as the long, narrow shape of the lot.
2. The literal enforcement of the provisions of the Ordinance would involve substantial hardship to the
applicant.
3. Desirable relief may be granted without substantial detriment to the public good, and without nullifying
or substantially derogating from the intent of the district or the purpose of the ordinance.
On the basis of the above statements of,facts and findings, the Salem Board of Appeals voted four (4) in
favor (Peter Copelas,Jimmy Tsitsinos, Tom Watkins and Mike Duffy) and one (1) Rebecca Curran (Chair),
opposed, to grant Variances, to allow a reduction in minimum lot area, minimum lot size per dwelling unit,
and minimum lot frontage required , subject to the following terms, conditions, and safeguards:
1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.

The Petitioner, owner of 48 School Street, respectfully requests that the Board
grant variances to allow the reduction in lot area of the existing non-conforming
lot in this R-2 Zoning District.
Currently, this parcel is not conforming in that it does not meet the current lot
width, lot frontage and front and side setback requirements. The long, narrow
shape of the lot renders the rear yard oftentimes unusable and a hardship to
maintain due to ledge outcroppings and topography. The division of the lot will
leave 6,873 +/- square feet for the existing house lot, which is in keeping with the
remainder of the neighborhood.
The division of this lot in conjunction with a similar division of the abutting 46
School Street lot will create a new rear lot, when merged, that conforms with
zoning. This will allow for an improvement to the neighborhood by cleaning up
and utilizing land that currently is unusable.
The size and shape of the existing lot is unique to this zoning district. The
topography of the lot rises in the rear to include substantial ledge outcroppings,
which condition is not seen in the general neighborhood. Relief may be granted
resulting in an improvement to the neighborhood in keeping with the intent of this
R-2 Zoning District.
Wherefore, the Petitioner respectfully requests the requested relief be granted.

I propose to combine part of lot from 48 School st and part of lot from 46 School street to
make a and conforming buildable lot at 2 School street Court. This would make the lot at
46 School Street non conforming because it would not meet lot size for R 2 zone.
The existing lot has a long thin shape with steep topography. This makes the space at the
back of 46 School st lot currently unusable and difficult to maintain. if combined with
space from 48 it would make a new rectangle shaped lot with embankment dwelling
thereby making it usable and an improvement to the neighborhood.

improve our neighborhood. Mr. Becker has renovated numerous homes,which had
fallen into disrepair throughout the City of Salem. Mr. Becker's projects have

I am writing in regards to Michael Becker and his variance request for his property located at 48
School Street in Salem. Over the past 6 years,Michael and I have developed a great working business
relationship and while we work for separate real estate firms I have had the pleasure of co-broking a few
transactions with him over the years. I work with a substantial amount of buyers here on the North Shore
and his properties are a pleasure to show. I make a point to stay in touch with him regularly to keep
abreast as to what new inventory he has coming down the pipeline as I trust his product completely. As a
full time REALTOR and a Past President of the North Shore Association of Realtors, I work with many
brokers and developers alike on a regular basis and Michael has always been excellent to work with.
While I know Michael through our business interactions,I can also speak as a past neighbor to
one of his recent projects. The project took place directly across from where I was living up until a few
months ago. He purchased and renovated the 2 houses across the street from my apartment on Meadow
Street, in fact our driveways were directly across from one another.Michael and his construction crew
were extremely respectful of our rather congested neighborhood and for that I couldn't be more thankful.
The two homes they renovated were in poor condition and it was their efforts that truly improved our end
of the street and added value to our neighborhood.
Michael's level of knowledge,professionalism and quality of workmanship are the reasons why
he has become such an excellent local Real Estate Developer and I have nothing but complete confidence

I have had the good fortune of working with Mr. Becker on several real estate
deals over the years. In each case I was the agent representing a distressed

Mr. Becker bought 3 properties I represented.
For each property Mr. Becker bought, he was able to make significant

This letter is in reference to Michael Becker and his request for a variance on his property located
on School Street. I have recently had the pleasure of meeting Michael while he was working on
renovating 13 Meadow Street as I own both 2 Meadow and 12 Meadow. My property at 12 Meadow is
located directly across from his 2 houses at 13 Meadow Street. ,As you probably know,we experienced a
rather traumatic event on Meadow Street in early November, it's a day that myself,my tenants and my
neighbors will never forget. Given the severity of that situation and how the events unfolded it left most
of us uncomfortable at the site of 13 Meadow Street. Being a Real Estate Developer myself I was
relieved to learn that Michael had taken ownership of the property and was going to be renovating both
houses. The circumstances that surrounded 13 Meadow meant that Mike was walking into a rather weird
situation with neighbors who were still trying to understand what had happened. Mike,his employees
and sub-contractors were nothing but understanding and extremely sensitive to what most of us had
witnessed a few months before. The job-site was always clean,the work was never disruptive and all of
the employees were very friendly. Based on my experience as a direct abutter of a recent project I can
attest to what it is like living next to one of Michaels job-sites and if I was to do it over again I wouldn't
change a thing. He brought new life back into our neighborhood and for that I can't thank him enough.
