DECISION ON THE PETITION OF WALLACE MILLER (PETITIONER) JOYCE
DUPUIS (OWNER) for Variances at 46 SCHOOL ST. (R-2)
A hearing on this petition was held September 20, 1989 having been continued
from May 31 , 1989 with the following Board Members present: James Fleming,
Chairman; Messrs. , Bencal , Febonio and Nutting. Notice of the hearing was sent
to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting variances from lot area, frontage and setbacks to
allow the property to be divided into two lots and to construct a duplex on
the newly created lot in this R-2 district. Property is owned by Joyce Dupuis.
The variances which have been requested may be granted upon a finding by the
Board that:
a. special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance. ,
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . There was neighborhood opposition to the petition.
2. There was concern expressed for adding to the density of the existing
neighborhood, the effect of blasting on nearby dwellings, and Fire
Department access to the new structure.
3. Hardship was not proven by the petitioner.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions do not exist which especially affect the subject
property and not the district in general .
2. Literal enforcement of the provisions of the Zoning Ordinance would not
involve substantial hardship to the petitioner.
3. The relief requested cannot be granted without substantial detriment to the
public good or without nullifying and substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted 3 to 1 in favor of the motion to
grant the requested variances. The motion having failed to gain four (4)
affirmative votes needed to pass is therefore defeated and the Variances
requested are denied.

Dear Mr. Fleming:
The concerns of the Fire Department, as expressed in the comments to the
Board of Appeal on May 31, 1989, reflect the need for fire apparatus to
turn prior to departure from a dead end street. The basis for this
requirement emanates from the inherent danger in backing large vehicles
over streets in residential neighborhoods, where children may stray into
the path of a vehicle, undetected by the operator.
As a basis for this requirement, I referred to the turnaround requirement
as defined in the Salem Subdivision Regulation; that being 20 feet by 35
feet. This space requirement shall be in addition to the three (3)
required off-street parking spaces as requested by the Board.
I support the suggestion of the Board to restrict parking on this street
as a means of insuring access to the property by emergency vehicles.
Whereas School Street Court is a public way, this matter should be
referred to the Salem Police Traffic Division for study.

The Salem Fire Department has no objection to the granting of Variances to
allow the division of property and to allow the construction of a duplex
at #46 School Street subject to the following conditions:
1 . Plans for the proposed construction are presented to the Fire
Prevention Bureau for approval prior to the issuance of a
building permit.
2. The proposed construction shall conform to all applicable
provisions of the Massachusetts State Building Code, 527 Code of
Massachusetts Regulations, the Salem Fire Prevention Code, the
Salem City Ordinances, and Massachusetts General Laws, relative
to fire safety.
3. The applicant shall arrange for an inspection by the Fire
Prevention Bureau upon completion of the work.
4. The applicant shall obtain and post proper street numbering from
the City Assessor in accordance with the city ordinance relative
to the numbering of buildings.
5. The access to the property through School Street Court shall meet
the requirements of the Subdivision Regulations with respect to
access for firefighting purposes.
