DECISION ON THE PETITION OF JAMES ABRAM FOR A SPECIAL PERMIT
AT 13-18 & 20 sable rd. , 3,5, & 7 BUENA VISTA RD. , SALEM, MASS.
A hearing on this petition was held on July 25, 1984 with the following Board
Members present: Scott Charnas, Secretary, Messrs Robert Gauthier, Edward
Luzinski and Peter Strout, Associate Member, Richard Bencal. Notice of the
hearing was sent to abutters and others and- notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts General
Laws Chapter 40A.
Petitioner is requesting a Special Permit and/or Variance from lot size.
The Zoning Board of Appeal voted unanimously to allow petition Leave to Withdraw

Vista Road.
Dear Mr. Hacker:
The Planning Board wishes to oppose the petition of James Abram for a
special permit and/or variances from lot size at 13-18 & 20 Sable Road and
3, 5, & 7 Buena Vista Road. This is an R-1 zone which requires 100 feet of
lot frontage and 15,000 square feet of lot area for each home. With a spe-
cial permit waiving these requirements the petitioner can file a definitive
plan with the Planning Board without adequate R-1 lot densities. He will
have to conform to all other zoning and subdivision requirements.
The Planning Board generally disapproves of any plan that increases
the density beyond the zoning requirements for that zone. Although many
of the homes in this area average 7000 square feet in size, there are also
several homes, including abutters, which have lot areas as large as 17,000
square feet. There also exist at least 3 parcels of land that are 1 to 3
acres in size and undeveloped in the immediate area. Approval of this
petition may set a precedent for the development of other large parcels in
the area. The Planning Board views this petition as a subdivision plan and
suggests the petitioner submit a preliminary plan to the Planning Board
before petitioning the Board of Appeal. The Planning Board in this case,
insists on strict adherence to the R-1 zone density requirements.

Kavanaugh will be present at your June 20, 1984 meeting to respond to them.
