A public hearing on the above Petition was opened on June 15, 2016 pursuant to M.G.L Ch. 40A, 4 11 and

The Petitioner seeks a Special Permit per Sec. 3.3.3 Nonconforming Structures of the Salem Zoning

Statements of fact:
1. Larissa Lucas,petitioner,presents the petition.
2. In the petition date-stamped May 23, 2016 the Petitioner requested a Special Permit per Sec. 3.3.3
Nonconforming Structures to allow the petitioner to structurally change the existing non-conforming
structure.
3. The petitioner proposes to construct an enclosed four (4) feet by five (5) feet structure in the rear
corner to square off the building where there is currently an existing shed of the same dimensions.
4. The expansion will provide for a small kitchen expansion and rear entrance to the house.
5. The property is located in a historic district and the Salem Historical Commission reviewed and
approved the proposed work ruling that the construction was in conformance with the historic
character of the building and neighborhood.
6. The requested relief, if granted, would allow the Petitioner to structurally change the existing non-
conforming structure.
7. At the public heating nine (9) members of the public spoke in favor of, and nonein opposition to, the
petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:

The Board finds that the structural change is not substantially more detrimental that the existing
nonconforming structure to the neighborhood.
1. Social, economic and community needs served by the proposal are not affected.
2. Traffic flow and safety, including parking and loading will not be affected.
3. Adequacy of utilities and other public services will not be affected.
4. Impacts on the natural environment,including drainage will not be affected.
5. Neighborhood character- The proposed addition conforms to the character of the
neighborhood and structure.
6. Potential fiscal impact, including the impact on City tax base and employment is positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
(Ms. Curran (Chair), Mr. Duffy, Mr. Copelas, Mr. Watkins, and Mr. Tsitsinos) and none (0) opposed, to grant
a Special Permit per Sec. 3.3.2 Nonconforming Uses of the Salem Zoning Ordinance to allow the petitioner
to change a use from one non-conforming use to another non-conforming use, subject to the following
terms, conditions and safeguards:

I am writing to support the application of 15 River Street to renovate a current shed and make it part of the main house.
Historically, houses have grown organically, following the needs of growing families and evolving technology. Kitchens
are especially prone to such changes.As cooking moved from smoky open fires to controlled stoves, so outdoor cooking
lean-to's were enclosed and made part of the house.Allowing this shed to become part of the house proper will follow
in the footsteps of the evolution of most of Salem's old homes.
Such incremental growth of homes also allows families to stay where they have roots and community they are invested
in. Permitting this change will allow a family that is strongly attached to the city to continue to meet its needs and
remain in Salem. We have lost enough such families.

This letter is in support of my neighbors, Larissa Lucas and David Hallowes, who hope to construct an
extension onto the rear portion of their residence on 15 River Street.
While building in a historic residential neighborhood requires care, and at times, restrictive guidelines, I hope
that responsible and considerate home owners such as David and Larissa are granted a fair hearing for a sensible
architectural plan to enhance their existing kitchen space.
Larissa and David have shown admirable concern for the greater good in their neighborhood. Within the past
year, Larissa offered a principled compromise concerning the appropriate preservation of cobblestones at the
end of our street.
Rather than follow voices of polarity- to either thoughtlessly maintain the whole area's Tarmac by Lockman
Square- or to expend more municipal funds to expose a cobbled surface on this sloped area that may be
dangerous for traffic at River, Bridge and Lynn Street, Larissa was one of the few who sought middle ground.
As citizens, we have a responsibility following the spirit of the "Americans with Disabilities Act" to consider
people less fortunate than ourselves. Some people may fmd the steep gradient abutting the streets dangerous for
walking, especially in New England winters, more so as the area's sidewalks were unfinished. However, the
original cobblestones are an historic feature of the area, and maintaining their appearance is appropriate. Now,
we have professionally finished crosswalks of Belgian blocks across the River and Lynn Street intersection, and
a portion by Bridge Street that serves as an attractive but useful visual cue for safer driving to and from Bridge
Street. This is due in no small part to Larissa and David's positive contribution.
Mention of this is not irrelevant. Indeed, I think it shows how historic preservation, necessary progress, and
respect for others can be achieved and maintained at once, with thoughtful planning. This is needed on both
sides and both ends of River Street, as well as elsewhere in our city.
David and Larissa also improved the street side of their driveway, by repairing the brick pavement during an
adjacent improvement. I am sure they will submit an architectural plan deserving serious consideration for
approval, and I hope that you will assist in this process, similarly to how you have done for other improvements
in the MacIntire district.

To the Members of the Board of Appeals,
Please accept my in absentia support of the petition for appeal submitted by Larissa Lucas of 15 River
Street. I am not a direct abutter, but as the homeowner at 6 Andover Street, I can see the exact area in
question from all of my rear windows and my yard. The proposed extension of the Lucas home's
footprint into the area currently used as a garbage shed makes both functional and aesthetic sense to
me.
I have been in the Lucas home while it was occupied by the former owners and recall how unwieldy
the kitchen layout had to be in order to work within the confines of the awkward exterior footprint. I
can imagine that making the kitchen square will substantially improve the lives of the Lucas family
members and any future owners of the home. This appeal to improve the functionality of one of our
neighborhood antiques reminds me of the successful appeal made a few years ago by Peter and Jan
Eschauzier; they, in fact, altered the external footprint of their home in order to add a much-desired
bathroom. It seems there is a solid precedent in,our neighborhood to help current homeowners,
within reason, live more comfortably in 21st-century style.
Fortunately, the proposed alteration to the Lucas property would not substantially change the way the
current home looks. The garbage shed appears to fully occupy the corner, and any more solid,
permanent structure replacing it could only be an aesthetic improvement.
Please accept this letter of support as you consider the Lucas appeal. I have no vested interest in the
outcome of this appeal, but I do recognize that there appears to be precedent for such a functional
change and that the homeowner's proposals seem to be in keeping with the visual appeal of the home
and the neighborhood.

My husband and I are the owners of 13 River Street. As direct abutters, we are writing to convey our support for
a special permit approval to change an existing nonconforming structure at 15 River Street. The item is on the
ZBA agenda for the 6/15 meeting.
The owner of 15 River Street, Larissa Lucas, would like to convert an existing garbage shed into an enclosed
first floor addition to her kitchen. The enclosure is on the same footprint. I believe the project would make her
kitchen much more functional for her family. Furthermore,there is plenty of precedent as it is not unlike
renovations that have been approved for other homes on this street and in the neighborhood.
In addition, my dining room window and kitchen window both have direct views of the existing garbage shed. I
believe this view would be much improved with the conversion of the garbage shed into part of her existing
kitchen.
We fully support Ms. Lucas'petition for a special permit. We encourage zoning board members to approve it.
