TO WHOM IT MAY CONCERN:
RE: 12 Lee St. , Salem
Regarding the above referenced property which contains, 5,330 square
feet, 50 feet of frontage, is a single family dwelling located in a single
family district and was constructed in 1926, the City of Salem considers
this to be a lawful nonconforming structure. It is nonconforming due to
the fact that it does not meet existing density requirements as set forth
in the Salem Zoning Ordinance, Art.VI, Section 6-4, Table I, Residential
Density Requirements.
Art.VIII, Section 8-4, Nonconforming Structure, paragraph (2) states
"Should such structure be destroyed by any means to an extent of more than
fifty (50) percent of its replacement cost or more than fifty (50) percent
of its floor area at the time of destruction, it shall not be reconstructed
except in conformity with the provisions of this ordinance. "
