DECISION OF THE PETITION OF TREEHOUSE DESIGN REQUESTING A VARIANCE
FOR THE PROPERTY LOCATED AT 1-3-5 PLEASANT STREET R-2
A hearing on this petition was held May 17, 200 with the following Board Members were
present: Nina Cohen Chariman, Stephen Harris, Ronald Harrison, Stephen Buczko and
Richard Dionne. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
At the request of the petitioner's Attorney William Quinn, the Salem Board of Appeal
voted 5-0, to grant leave to withdraw this petition without prejudice for a Special Permit
requesting an extension of a nonconforming structure and a Variance from parking for
the property located at 1-3-5 Pleasant Street.

To the Board of Appeal:
We wish to clarify our February 22, 2000, request for variances and special permits with
regard to Section IX A.1 of the Zoning Ordinance. Specifically, the property was
incorrectly identified as 1-3-5 Pleasant Street. In fact, the variance and special permit
requests are limited to the properties at 3-5 Pleasant Street. Our requests in regard to
maximum lot coverage, parking, and side yard setbacks should be modified as follows:
Maximum lot coverage: The application submitted on February 22 included
calculations based on the combined lot area of both 1 Pleasant Street and 3-5 Pleasant
Street. The existing coverage at 3-5 Pleasant Street is 83%. Maximum lot coverage
with the proposed addition to 3-5 Pleasant Street will be 85%.
• Off street parking: The existing property at 3-5 Pleasant Street currently has zero (0)
off street parking spaces. As the building currently occupies 83% of the lot, it will
not be possible to add additional off street parking.
• Side yard setbacks: The February 22 application did not address the western side
yard setback. The setback for the proposed addition to 3-5 Pleasant Street is four feet
six inches (4'-6") from the property line. The required side yard setback is ten (10)
feet.

Special Permits are requested to Sections 8.4 (Nonconforming Structure), 8.5 (Nonconforming use of structure) allowing the
expansion of the existing structure,and existing retail business. A Variance request is requested to section 7.3 (Off-street
Parking) The space between the two existing buildings allows for(2) parking spaces meeting City of Salem Specification, a
literal interpretation of the Zoning Ordinance, adjusting for storage of product, requires (21) spaces for the existing
configuration of spaces, and(28) spaces for the proposed expansion. Variances are sought from Article VI Density
Regulations.Table 1 -specifically from, side and rear setbacks to tike proposed expanded areas and maximum lot coverage.

The Application for Permit was denied by the Inspector of Buildings for the following
reason(s)
The Undersigned hereby petitions the Board of Appeal to vary the terms of the Salem
Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed, as the enforcement of said
Zoning By—Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating
from the intent and purpose of the Zoning Ordinance and Building Code for the follow—
ing reasons:
A literal enforcement of the Zoning Ordinance adversely affects the subject property as a viable location to continue service to
a well established clientele. The existing buildings ability to properly show oriental rugs is limited by the existing small rooms
and floor area,requiring the Owner to pile rugs several feet high making it difficult to show rugs to customers and slowing
transactions considerably. This proposal seeks to expand second floor space over the existing single story areas to create a
gallery atmosphere,where product can be properly viewed. The Owner's are not expecting to service more customers on a
daily basis, but to better serve their existing clientele. fn the matter of Architectural design, the existing street is composed of
2-1/2 story Victorian and Federal period homes, our proposal seeks to unify this scale and aesthetic by modifying the 1950's
single story brick portion of the building to be in character with the existing neighborhood of buildings. We contend that the
