LISOVICZ, JR. - MAYOR DECISION OF THE PETITION OF JAMES DONOVAN REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 12 PLANTERS STREET A hearing on this petition was held August 21, 2002 and continued to the September 18, 2002 meeting with the following Board Members were present: Nina Cohen Chairman, Bonnie Belair, Nicholas Helides, Joseph Barbeau and Stephen Harris. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. At the request of the petitioner the Salem Board of Appeal voted 5-0, to grant leave to withdraw this petition without prejudice for a Variance from side setback and density to construct a 2 story for the property located at 12 Planters Street located in an R-2 zone. '.Since that meeting we had the opportunity to meet with the extremely helpful Building Inspector, Tom St.Pierre, and now believe that we have come up with another plan. To Whom It May Concern: I would like to oppose the proposed two-story addition on the property located at 12 Planters Street , Salem, MA. I am a property owner at 10 Planters Street, directly to the right of the proposed property. I feel the close proximity is a safety issue as it would encroach my property creating a potential fire hazard . The closeness could create an alley which could pose a safety risk and personal threat to others . I also feel it will devalue my property. Please consider this appeal . There is no ill-will between neighbors but I feel these are legitimate concerns to consider . Thank you for your consideration in this matter . Sincerely,* V Marilyn King Dear Appeals Board: My name is Robert King. My two sisters and I own the home located at 8-10 Planters St. . I got a call about 2 weeks ago from Mrs. Donovan informing,me that an addition was being built on the back of the;property they own located at 12 Planters St.. My initial reaction was,"Sure, no problem"(I was half-asleep on the.couch when she called).. She went on to say that they had already removed the old enclosed porch and that the new addition would be 20x20ft and two stories high. She-sounded very nervous, she repeated, "two stories high." She told me that she didn't need my signature, but if I could sign the petition it would be nice. But the nervousness in her voice troubled me. I looked at the area where the addition would be and realized why she was so nervous. The addition would create a twenty-five foot high wall three feet from the property line completely cutting off any sunshine or breeze coming into our yard. I called my sister Marilyn and left a message, just telling her about the addition and asking for her thoughts. I then called my sister Janet and she said not to sign anything. My sister Marilyn called back very upset. She said, "Do you know what that would do to our property? It would completely kill any view we had, lower our property value, eliminate our privacy, and make it impossible to fight a fire from a safe distance." My sister Marilyn knows first hand about fire and she's very apprehensive because just about a year ago when she was living there, it was 2 AM and she saw a fire in Mrs. Lesley's yard at 6 Planters St. next door. She called the Fire Department and ran over and pounded on her door and screamed. Mrs. Lesley's car was engulfed in flames that were catching the bushes at her front door on fire. My sister continued to pound on the door and scream until she got Mrs. Lesley and her daughter Audrey out of the house just as the vinyl siding was melting off. My daughter Angela is now living in our house at 10 Planters St. and I don't want to take any chances with my daughter's life. The Donovans go to some extent to maintain an area of about a half an acre of Mass Electric land located in back of their property where they live at 15 Planters St.. It gives their yard a nice open look, lets the sun in, keeps the forest a safe distance from the house, and would allow a fire hose to be used effectively. I think it's an excellent idea - I would do the same. We ask only what they would want if the tables were turned. When I retire, I plan to move back to the house that we've owned for over 50 years and live out my life there. Our house is the only house to be badly impacted by this addition—those other signatures are nice, but it doesn't affect them. We wouldn't do this to our neighbor, please don't do it to us. I vehemently oppose this addition. I believe that the laws of the city should be upheld, and the variance denied. I feel the close proximity would pose a fire hazard. I also feel that this addition will decrease the value of my property, by wedging the houses so closely together like a project. King(Small Wednesday, August 21, 2002 Board of Appeals Salem, MA To whom it may concern: I recently learned of the plans for a twenty by twenty foot addition two stories high at the property located at 12 Planters St, which would be built onto the back of the house and very close to the fence which separates our backyards. As a resident of 10 Planters St, closest neighbor to said property (12 Planters St) at which the proposed addition would be constructed, and the person most immediately and directly effected by this development, I strongly oppose this alteration because I feel as though it would negatively impact life on my side of the fence to the extent of having less privacy, less sunlight, yet, at the same time, create a dramatic increase as a potential fire hazard. It would become an undeniably uncomfortable intrusion on the sanctuary I can home. Thank you for your consideration.
