PETITION OF PALMER'S COVE YACHT CLUB, INC. (PETITIONER) , GEORGE
MAGUIRE (OWNER) FOR VARIANCES ATa 2'liEAVITT STREET (B 4)
A hearing on this petition was held September 11 , 1991 with .the following Board
Members present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio,
Edward Luzinski, Mary Jane Stirgwolt. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting Variances to allow the property to be divided, ,-,to
demolish existing garages and to resurface the lot for use as parking and boat
storage. Property is owned by George Maguire Tr. and is located in a B-4 zone.
The Variances which have been requested may be granted upon a finding of the
Board that:
1 . Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other lanc
buildings and structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The petitioner was represented by Attorney Michael McMahan.
2. The Board received letters of support from Councillors Gaudreault and Nowak.
3. That members of the club as well as abutters spoke in favor of the Variances.
4. That the flow of traffic would be improved as well as the parking in the area.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the:Board of'.Aopeal concludes-ias.:follows:
1 . Special conditions exist which especially affect the subject property but
not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would inuolve
substantial hardship to the petitioner.
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent
of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal ,toted unanimously, 5-0, to grant the
Variances requested, subject to the following conditions:
1 . Petitioner shall comply with all City and State statutes, ordinances, codes
and regulations.
2. All construction shall be in accordance with plans and dimensions submitted.
3. A building permit for demolition shall be obtained.
4. All requirements of the Salem Fire Department relative to smoke and fire
safety are to be strictly adhered to, as'.well as conditions contained in the
communication from Attorney McMahon to Inspector LaPointe dated 9/10/91 .
5. Petitioner obtain all necessary permits and approvals from any other City
Board or Commission whichhasjurisdiction, including, but not limited to
the Planning Board' s Approval for Subdivision.
6. Exterior lighting comply with the Zoning Ordinance and not create a nuisance
for adjacent property.

I. Complaint received of an odor of fuel oil in the vicinity of #70 and
//72 Leavitt Street, Salem, Mass.
2. Upon investi.rrcrtion it was found that apparently fuel oil is being
dirj,pensed, fr. om the dome of an unregistered fuel oil vehicle, through
a+. ga.r.•den hose into a 275 gallon tank located in the basement of
//70 :Leavitt St. Salem.
31. No 'permi.t is or, record for. the Magnatherm fuel oil burner and the
27.5 gallon fuel Oil storage tank in the basement at #70 Leavitt. St.
4i Serious open wi:ri.ng was present to the oil burner controls.
5. Se.r. ious open wiring was - found to be present throughout the entire
basement. 3evicer. al wires were found spliced with tape, some wires
were .found leading to a makeshi'f't basement apartment, and some
wires were found ;placed at>,ainst i. smoke pipe from said apartment,a.nd
several wires were strung across the ceiling from an open receptacle.
6. Chimneys on both structuresare in an advanced state of fatigue. They
both appealr to be broken down at about a point just above the roof
line.
7. Fuel oil tank has no vent pipe nor fill pipe to 'the outside of
the structure.
8. Oil. 'burner was tagged, fireamatics were removed and wiring was cut
by the Electrical inspector. and myself.
9. Apparent heating unit has been installed in asement a argent
