22-24 PARK STREET - ZBA D D 22-24 PARR STREET - STACY JOHN THOMAS S ofttlPm, ttsstttllusetts t Pnzirb of E?T#enl G1iY OF CIERKSSIO FICfSS DECISION ON THE PETITION OF STACY JOHN THOMAS FOR A SPECIAL PERMIT AND VARIANCE AT 22-24 PARK STREET (R-3) A hearing on this petition was held February 18, 1998 with the following Board Members present: Nina Cohen, Chairwoman; Richard Dionne, Paul Valaskagis and Albert Hill . Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Special Permit to allow the expansion of a nonconforming three (3) family dwelling to a four (4) unit dwelling and a Variance from parking requirements for the property located at 22-24 Park Street. The property is located in a R3 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-3(j ) , which provides as follows : Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. .n more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Variance which has been requested may be granted upon a finding of the Board that: A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. DECISION ON THE PETITION OF STACY JOHN THOMAS FOR A SPECIAL PERMIT AND VARIANCE AT 22-24 PARK STREET, SALEM page two C. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented, at the hearing, makes the following findings of fact: 1 . The Petitioner did not submit a scaled drawing for the property. 2 . Jean Martin of 32 Park Street , Salem, Mass. spoke in opposition to the petition. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . The Special Permit and Variance cannot be granted without substantial detriment to the public good or without nullifying and substantially derogating from the intent of the district or the purpose of the Ordinance. 2 . The granting of the Special Permit and Variance requested will not be in har: onv with the neighborhood and will not promote the public health, safety, convenience or welfare of the City's inhabitants . :'herefore, the Zoning Board of Appeal voted unanimously, 4-0, against the granting of the Special Permit and Variance requested. Having failed to zarner the four affirmative votes required to pass , the motion to grant fails and the petition for a Special Permit and Variance is denied. I am also requesting a Variance from the new parking requirement hecausf the pinsent. use of this space would be less detrimental to the neighborhood than that of it ' s alternative use . I am asking for the Special Permit/Parking Variance because of the Hardships their rejection will cause me and certain residents of "The Point" neighborhood . Thank You . Board Of Appeal Members/ 2 February 16th, 1998 BACKGROUND THE PURCHASE : T purchased this property July 1996 as a four unit building . The property was presented to me by Melanson Realty Associates, a respected and well known North Shore Realtor. . ( 8ee Attachments No : l, 2, and 3 ) Before purchasing the property T checked with vsilouw City Of Solem Departments and was satisfied that the building was a four unit building . ( See Attachment No : 4 ) 23 DOW STREET UNTT : 23 Dow Sirent is a 226 square foot studio apartm. nt which has been .in unp for more than twenty-five yva' s . Removal of this unit would create a hardship on certain residents of "The Point" neighborhood such as students, single persons, single persons on assistance, and/or senior citizens on fixed incomes . These peoples are most in need of decent, reasonably priced rental housing which is in scarce supply in the neighborhood . Al.sn an automobile for this segment of the population would be considered a luxury which they probably would not own, thereby not contributing to the present parking situation . Board Of Appeal Members/ 3 February 15th, 1998 In addition, if I am not allowed to offer this unit to "Point" residents the loss in income would cause me great financial hardship making it very difficult to meet my mortgage obligation . THE PROPERTY : Tn its present configuration, 22/24 Park Street. and 3? Mew Street consist: of one Studin, One One Bedrnom, and Two Twn Bedroom Apartments . nridei present Salem Aoard Of Health Rules the Studio and One Bedroom Apartments can only be occupied by if my reque;t for the Special Permit/Vari,inre is dE,nl.ed tF;ey:e AT,ari-rnvntc would need to be combined to ,rpp.ke One Two/Three Redroom Apartment . This; newly configured Apartment would surely be more dr-trimental to "The Point" neighborhood by bringing in more children, more teenagers of driving aye (;adding to the Parking Situation ) , or more wr.,rking adults (which would alsn add to the Parking situation ) . The newly configured apartment could increase occ1)pancy from two people to ass many a eight. (childreri/adult combination) . In addition, an increased Hardship would be. brnught to the Single Widowed Senior Woman on fixed income whn presently lives at 22 Park Street and would be forced In move . Board Of Appeal Member;/ 4 February 16th, 1998 IN CONCLUSION : T purchased what was represented by Broker./confirmed by Salem Town Records to be a legal four unit property . I also found the building to be attractive because of the mix of Apartments that I could offer to "Point" Residents at Affordable Rents . Tf my request for a Special Permit/Variance is AQWWA : 1 . A Hardship will be forced on current tenants W__ 22 /24 Park and 23 Dow Streets 2 . A Hardship will be place an "Point" ranideni.s who most: need small reasonable priced hnnaing 3 . Tnureosed wrow0ing in the nei, hborhood and nverparkinU of vehicles is most likely to occur with a change to the property . With respect to your letter dated September 23rd; Paragraph 2, your Notice Of Complaint Hearing October 27th, and the Complaint Hearing with Ms . Farmer , Clerk Magistrate held on November. 17th : I came into the Building Department this morning, met with Mr . Kevin Goggin, Assistant Building Inspector, and re-checked the Building File and the information I received therein . According to at least two City Department ' s records, 22/24 Park Street and 23 Dow Street have been recognized as a four unit building for some number of years . I purchased this property in July 1996 . Before purchasing this building I came into the City Building Department and requested to see the Building File . Telephone number : ( 617 ) 576-3414 r Attachment Nn Leo E. Tremblay/ 2 9a December 19th, 1997 _ The only paperwork that was in the File were two letters from the Health Departed dated September 23rd and October 07th, 1986 . These letters were signed by V. Moustakis, and both letters refer to the building as a four unit apartment building . These letters were aleo copied to the Building Inspector , Electrical Inspector and Fire Prevention . ( Sep attached Health Department: letters ) T r.•sumed that because there were no follow up correspondences, any violations that might have e.ted had been corrected . I •asked if there was any additional information on the property, and the person on duty at the desk, suggested that I check with the City An e=.sors Office . At; the Assessors Office they explained that: they have been assessing and taxing this property as a four unit building since at least August neth, 1973 . They stated they suspect that they have been taxing this properky as a four unit long befor.c this date bot could not confirm such because thwy In not keep records before 1973 , - ( See attached City Assessors Building Record ) In addition, just prior to Durc} asing this property, the Salem Fire Prevention Bure.an issued a Certificate Of Compliance to the seller . This Certificate clearly states the building has four units , ( See attached Certificate Of Compliance ) After reviewing and relying on this information, 1 was satisfied that the property was a legal four "nit building and concluded the purchase . CeoeE. Tremblaymbei 9th, is_{37 AttahmF t Nr ^.F; I believe this information should be sufficient enough to have the November 17th Complaint Hearing dismissed .
