Mr. Hardy,
This Department was asked to take a look at the second floor porch at the above two family
rental owned by you. The second floor railing is detached and in danger of falling to the ground.
This also constitutes a danger to life and limb for your tenants.This is a violation of Mass. State
Building code 780 CMR section 116. Addittionally, speaking with the tenant on the second
floor,it appears you are renting rooms on both the second and third floors. You are not permitted
for a rooming house and this is a serious violation of Mass General Law, Building Code and Fire
Laws. Also ,several smoke.detectors were missing as well as required Carbon Monoxide
Detectors
For the railing, you are directed to secure a building permit and to begin repairs immediately.
Failure to do so will result in Municipal Code Tickets and further enforcement actions.
Regarding the second matter,you are directed to contact this office upon receipt of this notice to
arrange for an Inspection of the entire premises.

A report has been received by this office that this property is being used as a
rooming house,ywhich is an illegal use',under both City of Salem Ordinance and State
Building Code (780 CMR, Section 310.,5 ). An inspection of this property will be
required to establish it's current use.
Under the provisions of 780 CMR, Section 115.6, State Building Code, access to
this property must be granted for the purposes of inspection. Please call this office upon
receipt of this letter to schedule this required inspection. If this property has rental units,
these tenants must be notified in advance of this inspection, so that access tot ese spaces
