Petition of GEORGE and HELEN PAPADOPOULOS for an Appeal of the Decision of the
Building Inspector relative to the issuance of the Building Permit and Certificate of
Occupancy for the property located at 111-113 NORTH STREET (Bl Zoning District).
A public hearing on the above petition was opened on April 17,2013 pursuant to Mass General Law
Ch. 40A, § 11. The hearing was continued on May 15, 2013, where the Board of Appeals met to
discuss the petitioner's request to withdraw the above referenced petition without prejudice. The
following Board of Appeals members were present: Ms. Curran (Chair), Ms. Harris (Vice Chair),Mr.
Dionne,Mr. Duffy,Mr. Watkins,Mr. Eppley (Alternate) and Mr. Tsitsinos (Alternate).
The Board of Appeal, after careful consideration of the request presented at the public hearing, and
after thorough review of the submitted petition and testimony, voted to grant the withdrawal of the
petition for 111-113 North Street with prejudice. The members voted in favor, with a 5-0 vote in
favor (Ms. Curran (Chau), Ms. Harris (Vice Chair), Mr. Dionne, Mr. Watkins, and Mr. Duffy) and
none opposed.

Madam Chairperson and members of the Board, I would like to thank
you for your time.
In 2008, the developer, Mr. Sideropoulos, clear cut 35-40, 75-100 foot
trees behind the North Street Shell Station, violating one of the
conditions of the 1970 Board of Appeals decision which required that all
trees and vegetation to the rear and side of building be left untouched,
in order to provide a protected buffer zone to the abutters and
neighborhood.
The overall intent of the 1970 Board of Appeals decision was to keep the
commercial activity of the Shell Station out of sight and sound of the
residential neighborhood, and for 38 years the trees acted as a natural
buffer.
In the last 41/2 years, the abutters have had to retain an attorney and
landscape architect, dealt with flooding problems due to the installation
of an illegal drainage system which was eventually removed, the noise,
sight and sounds of North Street, dirt piles, and most recently lighting
intruding on our properties. Mr. Sideropoulos' actions have impacted
our quality of life, enjoyment of our properties, and property values.
Mr. Sideropoulos has been uncooperative during the last 4 1h years. The
progress that was made was not due to any willingness on his part, but
rather due to the persistence and determination of the abutters, the
support and pressure from the City Council and the consistent
messaging from the City Solicitor and the Building Inspector that no CO
would be issued until all the issues were resolved. Mr. Sideropoulos has
never really wanted to right the wrong, but rather do the minimum
possible prior to opening his station.
We insisted on the restoration of the buffer via a densely planted
landscape plan, created by Michael Blier, that used quantities and
heights that would be viable to create immediate screening and
eventually re-create the woods that were lost.. However, the landscape
plan that was executed, was not the plan which all parties agreed to in
December, 2011, but rather a watered down version that was accepted
by the City without the abutters' knowledge. Tree and plant sizes were
reduced and the quantity of the maple trees went from 42 to 15. As a

result, the intended denseness was compromised. Because of our
objections, we were assured that when all of the trees and plants were
in the ground, the abutters would have the opportunity to determine if
any gaps remained. And if so, additional trees would be planted to fill
those empty spaces. But that has not happened.
We have been very reasonable and patient over the last 4 Y2 years. We
have worked diligently and in good faith to have this issue resolved.
What we are seeking is a FAIR RESOLUTION to this issue, which would
include: Mr. Sideropoulos filing a petition for zoning relief, having
additional trees planted in the rear of building, and setting solid,
enforceable conditions to address the violations and to protect the
abutters, the neighborhood and the buffer.
