DECISION OF THE PETITION OF GABRIEL & MARY ROSSI, JR. REQUESTIW A'
VARIANCE FOR THE PROPERTY LOCATED AT 73 NORTH STREET (B-P)
A hearing on this petition was held August 21, 1996 with the following
Board members present: Gary Barrett, Chairman, Albert Hill, Arthur
Lebreque, Richard Dionne and Paul Valaskatgis. Notice of the hearing was
sent to abutters and others and notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner, requests a Variance to allow a sign to be install for the
property located at 73 North Street.
The Variance which has been requested may be granted upon a finding of this
Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other land, buildings, or structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogation from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful considerations the evidence presented at
the hearing, makes the following findings of fact:
1 . Mr. Gabriel Rossi , Jr. represented himself.
2. A letter form the City Planner, Craig Wheeler submitted a letter in
favor of the petition.
3. Mr. McDermitt of Dearbord Street spoke in favor of the petition.
4. Councillor Leonard O'Leary spoke in opposition, citing non-conformity
with the city's sign ordinances.
On the basis of the above findings of fact, and on the evidence presented
at the hearings, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
and not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substation hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to
public good and without nullifying and substantially derogating from
the intent of the district or purpose of the Ordinance.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 3-0 to grant
the variance requested, subject to the following conditions:

Dear Mr. Barrett:
I am writing in support of Gabriel Rossi's application for a variance to allow the
replacement of roof signs at 73 North Street, the location of O'Rourke Brothers Memorials and
Absolute Environmental Company.
The view of the building at 73 North Street is obscured from every direction due to the
North.Street overpass, grade differences and the facility's location at the end of the North Street
extension. The existing roof signs, therefore, have helped to identify the business. Mr. Rossi
wishes to replace the existing signs with a single more attractive, visually effective roof sign.
The proposed sign has been reviewed by the Planning Department staff. The size, material and
design are in compliance with the requirements of signs in the Entrance Corridor Overlay
District.
The installation of a new sign is just one part of Mr. Rossi's broader plan to expand and
improve the facility at 73 North Street. City officials have supported the plan since March, when
he first approached the City for help in financing the expansion of the facility. With a strong
record of growth and optimistic projections for future sales, Mr. Rossi had determined that the
building could no longer accommodate O'Rourke Brothers Memorials and Absolute
Environmental Company. Mr. Rossi decided to remain in Salem rather than relocate to another
community.
The City of Salem recognizes Mr. Rossi's commitment to Salem and has provided strong
support. In May, the City made a loan of$12,000 through its Entrance Corridor Business Loan
Program, helping Mr. Rossi to finance exterior improvements to the property and enhance the
appearance of the North Street area. In addition, the City supported Mr. Rossi's application for
participation in the Economic Development Incentive Program, allowing him to take advantage
of State and local tax benefits available through Salem's designation as an Economic Target
Area. These tax benefits will allow Mr. Rossi to direct resources toward the continued expansion
of O'Rourke Brothers and Absolute Environmental.

The growth of both businesses and the expansion of the facility at 73 North Street have
helped to advance several of the City's goals for economic development: adding to the tax base,
creating jobs and improving the appearance of a commercial property on an entrance corridor.
Mr. Rossi has a strong track record in Salem. O'Rourke Brothers was founded at 73
North Street in 1890. Gabriel Rossi and Mary Rossetti-Rossi purchased the business in 1981.
Since that time the business has grown considerably. O'Rourke Brothers Memorials has six full-
time employees. Company officials expect to add another full-time position next year; by the
end of five years, they will add three additional full-time employees. Building on their success
in managing O'Rourke Brothers the Rossis founded Absolute Environmental Company in 1992.
The company specializes in commercial and residential sandblasting, building restoration and
environmental cleaning. Absolute Environmental currently employs two full-time workers.
Company officials expect to add another full-time position next year; by the end of five years,
they expect to create four additional full-time jobs.
Given the difficult location of the building and Mr. Rossi's commitment to expanding his
businesses in Salem, I hope that the Board will give favorable consideration to this petition.
