Gentlemen and Mesdames :
On August 24, 1981 the Board of Appeal granted the petition
of the Salem Redevelopment Authority requesting a zoning
variance for 28 Norman Street . The variance was conditioned
upon and subject to final approval of the proposed development
plans by the Salem Redevelopment Authority and the Design
Review Board . On November 17 , 1981 the Salem Redevelopment
Authority certified for record purposes that the proposed
development plans had been approved . Stern Group I , Inc. , the
proponent of the development plans , petitioned the Board of
Appeal for an extension of the variance for 2-8 Norman Street .
On October 4, 1982 the Board of Appeal authorized the extension
of the variance effective through and including September 22 ,
1983 .
This letter is to notify you that Stern Group I , Inc . has ,
by quitclaim deed , conveyed the premises at 28 Norman Street ,
Salem, Massachusetts to Jeffrey A. Stern, Royer W. Stern and
Edward Novakoff , doing business as Forrester s Corner
Associates and does not intend to exercise its rights in
accordance with the variance or any extension thereof granted
by the Board of Appeal and Jeffrey A. Stern et als d/b/a
Forrester ' s Corner Associates by letter dated as of this day
join in this representation of their own behalf .

A hearing on this Petition was held on September 2, 1982, withlLflt¢ following
Board Members present: Douglas Hopper, Chairman; Messrs. Hacker, Feeherry
and Associate Member Luziuski. Notice to the hearing was sen`E1T&-Wbutf6ra!J 4ASS-
and others and notices of the hearing were published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 4OA.
The Petitioner has requested an extension of the rights authorized by a prior
variance granted by this Board dated August 24, 1981.
On the basis of the authority of Massachusetts General Laws Chapter 4OA §11,
the terms of this Board's prior decision (including all conditions stated
therein) are hereby extended and are effective through and including
September 22, 1983.

RE: Petition of Stern Group I
Norman Street Parcel
Dear Mr. Hopper:
The Salem Redevelopment Authority strongly supports the request to
extend the variance granted to Stern Group I on August 24, 1981 to con-
struct 25 residential units at 28 Norman Street (B-3 District) .
The Authority has supported the concept of housing on this site
(and through the downtown) and has worked closely with the Developer to
bring this concept to fruition. It is hoped that the Board will act
favorably on this project.

1. The present zoning for the property does not permit residential
uses nor allow for residential use under special permit procedures.
2. The property in question is one of the very few vacant parcels in
the center of Salem. Because of its unique size and location, the
development of this parcel is a unique concern to the entire City.
3. The conditions described in paragraph 2 herein especially affect
the land in question but do not generally affect the zoning district
in which the land is located.
4. The conditions described in paragraph 2 herein which affect the
land in question, but not the zoning district generally cause the
following special hardship: if the requested variance is not
granted the property will have to be developed in a manner which
is not consistent with the Urban Renewal Plan and not in keeping
with the surrounding buildings thus resulting in harm (including
but not limited to financial harm) to the petitioner and to the
City as a whole.
5. The grant of this variance may be granted without substantial
detriment to the public good because the proposed use will benefit
the entire City.
6. The Board of Appeals granted a variance to permit residential
development on a much larger vacant lot almost abutting this
subject property following a hearing held by the Board on March 11,
1981. The granting of this variance would be consistent with
that Decision of the Board, and with the Urban Renewal Plan. It
is requested that the Board of Appeals grant the petition upon
the following terms and conditions :
a. That no more than 25 residential units may be constructed
on the site.
b. No less than 1z parking spaces per residential unit actually
constructed shall be maintained on the site.
C. This variance is further conditioned upon and subject to
final approval of the proposed development plans by the
Salem Redevelopment Authority. The terms and conditions,
if any, of that final approval by the Salem Redevelopment
Authority, if such terms and conditions should be more
restrictive than any existing provision of the zoning
ordinance as it pertains to B-3 districts, are incorporated
and made part of this variance.
