The Salem Fire Department has no objection to the granting of a Special Permit to
allow construction of an addition at 45 Mason Street subject to the following
conditions:
1- Plans for the proposed construction are presented to the Fire Prevention Bureau
for approval prior to the issuance of a building permit.
2- The proposed construction shall conform to all applicable provisions of the
Massachusetts State Building Code, 527 Code of Massachusetts Regulations, the
Salem Fire Prevention Code, the Salem City Ordinances, and Massachusetts .General
Laws relative to fire safety.

The petitioner has requested a Special Permit from any and all applicable
density and setback requirements to construct an addition at 45 Mason St. which
is located in an Industrial district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Y.otwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D,
grant Special Permits for alterations and reconstruction on
nonconforming structures, and for changes, enlargement, ex-
tension or expansion of nonconforming lots, land, structures,
and uses, provided, however, that such change, extension, en-
largement or expansion shall not be substantially more detri-
mental than the existing nonconforming unse to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after consideration of the evidence presented at the hearing,
sakes the following findings of fact:
1 . No support or opposition was voiced by anyone;
2. The addition could not be built in any other practical way.
On the basis of the above findings of fact, and on the evidence presented, the
. Board of Appeal concludes as follows:
1 . The relief requested can be granted without substantial detriment to
the neighborhood and without nullifying or substantially derogating
from the intent of the district of the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Special Permit subjection to the following conditions:

A hearing on this petition was held March 19, 1986 witli the following Board Members
present: James Hacker, Chairman; Messrs. , Bencal, Chaf{{,gs,2Luq-re p.�! ,Strout.
Notice of the hearing was sent to abutters and others e�nd notices o hearing
were properly published in the Salem Evening News in �c' gkance with Massachusetts j
General Laws Chapter 40A.

The petitioner has requested a Special Permit from any and all applicable
density and setback requirements to construct an addition at 45 Mason St. which
is located in an Industrial district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D,
grant Special Permits for alterations and reconstruction on
nonconforming structures, and for changes, enlargement, ex-
tension or expansion of nonconforming lots, land, structures,
and uses, provided, however, that such change, extension, en-
largement or expansion shall not be substantially more detri-
mental than the existing nonconforming unse to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after consideration of the evidence presented at the hearing,
+^akes the following findings of fact:
1 . No support or opposition was voiced by anyone;
2. The addition could not be built in any other practical way.
On the basis of the above findings of fact, and on the evidence presented, the
,_.Board of Appeal concludes as follows:
1 . The relief requested can be granted without substantial detriment to
the neighborhood and without nullifying or substantially derogating
from the intent of the district of the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Special Permit subjection to the following conditions:

A hearing on this petition was held on March 21 , 1984 with the following Board

hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.,
Petitioner requests a Special Permit to allow him to extend a nonconforming side
setback as more 'fully described in a plan submitted to the Board. This is
located in a (I) district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and

of nonconforming structures, and for changes, enlargement,
extension. or expansion of nonconforming lots, land, structures,

In more general terms, this Board is, when reviewing Special Permit requests,

The Board of Appeal, after considering the evidence presented at the hearing,
and after viewing the plans of the property, makes the following findings of fact:
1 . No opposition to the plan was presented;
2. The granting of this Special Permit will have a negligible effect,
if any, on the neighbors and the neighborhood.
On the basis of the above findings of fact and on the evidence presented at
the hearing, the Board of Appeal concludes as follows:
1 . Petitioner's plan will not be substantially detrimental
to the public good;
2. The relief requested does not substantially derogate from or
nullify the intent and purpose of the Ordinance.
