DECISION OF THE PETITION OF ERIC EASLEY REQUESTING A VARIANCE FOR
THE PROPERTY LOCATED AT 35 MASON STREET I
A hearing on this petition was held April 30, 2003 meeting with the following Board
Members were present: Nina Cohen Chairman, Stephen Harris, Richard Dionne, Bonnie
Belair and Joseph Barbeau. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
At the request of the petitioner's Attorney, George Atkins, the Salem Board of Appeal
voted 5-0, to grant leave to withdraw this petition without prejudice requesting a Variance
for the property located at 35 Mason Street located in a R-2 zone.
GRANTED LEAVE TO WITHDRAW WITHOUT PREJUDICE .

Appeal from this decision, if any, shall be made pursuant to Section 17 of the

General Laws Chapter 40A, Section 11, the Variance or Special Permit granted herein
shall not take effect until a copy of the decision bearing the certification of the City Clerk

Dear Neighbor:
I received a disturbing notice in the mail last week from the City-of Salem.—The _
notice was that of a public hearing to be held next Wednesday, April 30`n, at 6:30 PM at
120 Washington Street, Salem,regarding the property at 35 Mason Street.
Mr. Easley,the property owner of 35 Mason Street, got a building permit issued
in.August of 2001 to construct a residential garage 40' x 60'. At the time the permit was
issued a special notation was made that this building was for residential use only.
However, Mr. Easley has now decided he would like to transform that garage into a
rental facility and get the zoning laws changed for the neighborhood. Mr. Easley has
also decided to convert the two-family unit on the front portion of property to a three-
family unit.
The Mason Street area is already a thickly populated area and adding more rental
units will just make our street more congested and create more parking issues. Not to
mention what affect this could have on property values.
Your attendance at the public hearing will be very important to help prevent such
actions from taking place. Please support our efforts to keep this neighborhood from
becoming a mini-industrial park. Please sign and mail(or give it the mailman) the self-
addressed card to the City of Salem Board of Appeals to show your opposition to this
action.

To The Board of Appeals:
I wrote a letter on March 14th 2003(copy enclosed), stating our support for Eric Easley's 35
Mason St project. I was unable to attend Eric's Neighborhood meeting on the 15th of March. It is
my understanding that no one showed in opposition at this meeting. The Invitation to the Meeting
had requested, (copy enclosed)that if anyone could not attend they were to send a letter stating
their concerns. It is also my understanding no letters in opposition were sent to Mr. Easley or to
the Ward Councilor Mike Bencal.
On April 28, 1 received another letter(copy enclosed)dated April 22 signed, "concerned
residents". This letter asks its recipients to send out the enclosed, pre-addressed, pre-stamped
post card opposing the project The letter goes on to say there will be"parking problems",
"property value*concerns, and"mini industrial parks". I feel the letter from the citizens is very
misleading in its description of the project, and therefore the post cards sent back by the
residents are not truly representative.
The project provides for 10 parking spaces on the property and two more on the street, which is
more than the required amount. I believe this would improve parking not make it worse.
Regarding"Property values", I think the neighbors would rather live next door to a newly
developed residential property for families, rather than commercial property. And last, the letter
mentions, "Mini industrial park', I don't understand this at all, the project proposes residential
apartments, nothing commercial.
Where were these concerned citizens when Mr. Easley reached out to them on March 15th at the
Neighborhood meeting Councilor Mike Bencal had set up? Its truly unfortunate to receive a letter
that goes behind the scenes with postcards, when any concerns should have been brought up at
the neighborhood meeting, or he or she could of approached Mr. Easley directly.
I ask the Board to make light of the post cards and listen to neighbors that actually have seen the
plans and written letters, or neighbors that actually attend the meeting on April 30th, 2003.
1 ask the board to support the petition for 35 Mason St. I believe the two additional spaces
provided for the on street parking, would be a great help to us and other neighbors.

I am writing this letter in favor of the proposal by Eric Easley @ 35 Mason St to change
the use of the front building from a two unit to a three unit , and to split the use of the rear
building into two, three bedroom apts., and the remainder to be used for a gar Te. It is
also my understanding, after attending the neighborhood meeting on March 15 2003 (set
up by the ward councilor Michael Bencal) that Eric Easley plans to shorten the entrance
to his property allowing two more cars to park in the street. My wife and I live next door
@ 37 Mason St and we believe this is a great proposal all the way around. Not only will
the building and the property look better but the neighbors will gain two extra parking
spaces. I have had contact with Mr. Easley on several occasions living here and found
him to be very responsible property owner and maintains 35 Mason St. very well.

On behalf of my tenants, and as a property owner of 29 Mason St., I am in favor of the
proposal at 35 Mason St. I strongly agree with the proposal due to the fact it will benefit
not only the owner of 35 Mason St but also the surrounding residents such as myself and
my tenants. More parking spaces on the street will benefit everyone. Adding the two
residential units to the rear building will be a nice improvement to its looks. The change
of both buildings @ 35 Mason St will make good use of the property without effecting
others. I Have spoken to Mr. Easley on a couple of occasions and found him to be very
reasonable person and I support his efforts to improve his property and our neighborhood.
