A hearing on this petition was held November 29, 1989 with the following Board
Members present: James Fleming, Chairman ; Messrs. , Bencal , Febonio and Nutting.
Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner is requesting a Variance from front, rear and side yard setbacks and
a Special Permit to extend nonconforming structure to allow construction of an
addition in this B-2 district. Property is owned by Esther Realty Inc.
The Variances which have been requested may be granted upon a finding of the
Board that :
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, with provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the procedure and conditions set forth in
Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, enlargement, extension or expansion
of nonconforming lots, land, structures, and uses, provided, however, that such
change, extension, enlargement or expansion shall not be substantially more
detrimental than the existing nonconforming use to the neighborhood.
In more general terms, this Board is , when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City' s inhabitants.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact: .

1 . The proposed plan is in harmony with the current use of the property and
the neighborhood.
2. The Ward Councillor expressed his support of the plan.
3. The plan will reliev a potential danger to area pedestrians.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows :
1 . Special conditions exist which especially affect the subject property but
not the district in general .
2. Literal enforcement of the Ordiance would work a substantial hardship
on the petitioner.
3. The relief requested can be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district of the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
Variances and Special Permit requested, subject to the following conditions :
1 . Petitioner must comply with all the requirements of the Salem Fire Dept.
relative to smoke and fire safety.
2. All construction must be done in compliance with the State Building Code
and as per the plans and dimensions submitted to the Board.
3. All curbying must be installed as per the plans submitted to the Board.
4. A stop sign at the location be installed and approved by the Police Dept.
5. The lighting for the lot and drive-up be inward and not affect local
residences.

SCHEDULE A
The Petitioner is the Lessee under written lease of the
premises situated at 72 Loring Avenue, Salem, Massachusetts.
Petitioner has for many years had a branch bank at this facility
in order to serve its customers in that particular area. Over the
past several years it has become apparent that, as a matter of
convenience for its depositors and customers, a drive-in addition
to the existing branch would be of particular benefit and
convenience to the general public. Petitioner therefore, has
prepared plans to extend the present structure so that a drive-in
section of the branch bank can be built.
The building to which the drive-in addition is to be attached
is an existing non-conforming building that has existed for many
years, even prior to any Zoning Ordinance. Extent of the non-
conformity is minimal, in that the lot has more than ample area and
complies with substantially all other density requirements other
than front yard and rear yard set backs, and even for these items
there is substantial compliance. The lot is a corner lot.
However, the proposed addition will come closer to the street
line than would normally be permitted. Therefore, the Petitioner
would request a Special Permit to extend the non-conforming
structure and a Variance from the front yard, rear yard and side
yard requirements so as to permit the construction of the drive-
in addition to the branch bank at 72 Loring Avenue, shown on the
site plan submitted as "proposed addition" area.
It is submitted that the use is permitted in the area, the
area is zoned B-2; there are other banking facilities on Canal
Street, together with other businesses. The request is not against
the Master Plan in that the area is zoned for this particular use.
In addition, it will serve and provide convenience to the general
public and the Petitioner feels that the petition can be granted
without derogating from the intent of the underlying Zoning
Ordinance. As a corner lot, it is bounded by two streets.
Additional land acquisition or alternative placement of the
building or addition is not feasible. These limitations, peculiar
to the lot, would create hardship to the Petitioner= if the Zoning
Ordinance were literally applied to this project. Therefore the
Petioner respectfully requests`that the Board grant a special
Permit to extend a non-conforming structure and Variance from the
front yard, rear yard and side yard setback requirements to permit
the construction of the proposed addition shown on the submitted
plans.

As a result of reviewing the site and site plans for the renovations
and addition of a new drive-up window to Eastern Bank on Canal St. I
believe by adding this addition it will eliminate a very serious hazard
where vehicles parked halfway out into the street. Plus, by adding new
parking and a new sidewalk it will make this area much safer.
I would like to suggest that the Bank place a stop sign on their
property by the egress to Canal St. to eliminate a possible traffic
hazard at this location.

prepared plans to extend the present structure so that a drive-in

years, even prior to any Zoning Ordinance. Extent of the non-
conformity is minimal, in that the lot has more than ample area and
complies with substantially all other density requirements other
than front yard and rear yard set backs, and even for these items
there is substantial compliance. The lot is a corner lot.
However, the proposed addition will come closer to the street
line than would normally be permitted. Therefore, the Petitioner
would request a Special Permit to extend the non-conforming
structure and a Variance from the front yard, rear yard and side

;he provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
of Appeal may, in accordance with the Drocedure and conditions set forth in
v Section VIII F and IX D, grant Special Permits for alterations and reconstruction
of nonconforming structures, and for changes, enlargement, extension or expansion '
of nonconforming lots, land, structures, and uses,
change, extension. enlargement or expansion shall not obedsubstantially ed, however, rmore
such
detrimental than e existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted )n a finding
