A hearing on this petition was held September 11 , 1991 with .the following Board
Members present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio,
Edward Luzinski, Mary Jane Stirgwolt. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting Variances to allow the property to be divided, _.to
demolish existing garages and to resurface the lot for use as parking and boat
storage. Property is owned by George Maguire Tr. and is located in a B-4 zone.
The Variances which have been requested may be granted upon a finding of the
Board that:
1 . Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other lane
buildings and structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The petitioner was represented by Attorney Michael McMahan.
2. The Board received letters of support from Councillors Gaudreault and Nowak.
3. That members of the club as well as abutters spoke in favor of the Variances.
4. That the flow of traffic would be improved as well as the parking in the area.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the •Board of.'.Appeal conciudesoas.:follows:
1 . Special conditions exist which especially affect the subject property but
not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would inuoli�e

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Variances requested, subject to the following conditions:
1 . Petitioner shall comply with all City and State statutes, ordinances, codes
and regulations.
2. All construction shall be in° accordance with plans and dimensions submitted.
3. A building permit for demolition shall be obtained.
4. All requirements of the Salem Fire Department relative to smoke and fire
safety are to be strictly adhered to, as well as conditions contained in the
communication from Attorney McMahon to Inspector LaPointe dated 9/10/91 .
5. Petitioner obtain all necessary permits and approvals from any other City
Board or Commission which-has jurisdiction, including, but not limited to
.the Planning Board's Approval for Subdivision.
6. Exterior lighting comply with the Zoning Ordinance and not create a nuisance
for adjacent property.

Dear Inspector LaPointe :
This letter will confirm our discussions as were made after
all the review of the above-referenced acquisition together with
Commodore Leonard Callahan of the Palmer ' s Cove Yacht Club. In
particular we confirm our understanding of your Fire Department ' s
concerns as to safe access so as to provide fire fighting
capabilities within the parking area and specifically the winter
boat storage area as will be located upon that property.
We understand that the Palmer ' s Cove Yacht Club will provide
an approved Fire Department access lock and/or box which will
enable the Salem Fire Department to gain access to that fenced off
area by way of a specially keyed lock. In addition, a sufficient
fire lane will be kept and maintained during winter boat storage so
as to afford Fire Department apparatus access to the entire lot and
any boat stored therein. All boats shall be stored so as to ensure
that any fuel tanks shall be located away from any adjoining lot
lines or property (excepting those immediately adjacent to the
existing Palmer ' s Cove parking area) .
I would be happy to review any other considerations that you
may have regarding this matter and/or any further requests you may
have to ensure the public safety.
