Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Sal Pm'Y P em EveningNew ' sin accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance from side yard setback and to alter a non- conforming structure to construct an open deck for the property at 71 Leach Street located in an R-2 zone. The Variances,which have been requested, may be granted upon a fording by this Board that: a Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to theti pe tloners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal,after careful consideration of the evidence presented at the hearing, and after viewing the plane, makes the following findings of fact: I. Mary Devlin,petitioner presented her petition. 2. The request is for construction of an open deck. 3. Request is functional as well as recreational. Deck will allow emergency exist from a window. 4. The requested setback is for 0.1" from side line. 5. There are 4 units in the Condominium. 6. Mary Levesque of 77 Leach Street spoke in favor of the petition. Special conditions exist when especially affect the subject property but not he District. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 5 in favor and 0 in opposition to grant the Variances requested, subject to the following conditions: 1. Petitioner shall comply with all city and state stature, ordinance, codes and regulations. 2. All construction shall be done as per the plans submitted and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. S. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit per Section 8-6 of the Zoning Ordinance to alter the property from 3 residential and 1 commercial to 4 residential for the property located at 71 Leach Street B-2.. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-3 (2) (8), which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension of expansion, of nonconforming lots, land, structures, and uses, provided however, that such change, extension, enlargement of expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. We are further aware that the deck would be directly adjacent to the property line between our lots. We have no objection to such a deck and agree that it would be an appropriate use of the space. We also have no objection to any kind of separator such as a privacy screen if such is desired. We also wish to draw attention to the fence and gating arrangement that we share near the front of the lot. We recognize that the new owner is under no obligation to allow us to continue having such common fence and gate and will abide by whatever is desired. If the owner is willing, we will arrange to improve the fence and gate according to whatever best suits the use of the newly developed area. We will contact the new owner after a brief settling in period to find out what is acceptable before proposing any changes.
