Dear Mr . Gauthier ,
We are writing to you to register a complaint regarding a
zoning violation that is present at 47-49 Leach, Street .
There are currently eleven ( 11 ) people residing in a two
family dwelling at the above address . Five males on the first
floor , six females on the second and they moved into our neigh-
borhood the first week in September . There hasn ! t b.e.en .a quiet ,
tranquil evening since! What with doors slamming , loud talking ,
stereos and general disquiet , many times into the wee hours of
the morning , we ' ve had many sleepless nights . As a result , many
calls to the police have been made for their assistance . There
were never many parking spaces available , but now there are none .
As homeowners and taxpayers that are being forced to live
amongst a college dormitory we feel that this violation is no
longer tolerable . We are requesting that you , as zoning enforce-
ment officer , investigate our complaints and rectify the situa-
tion . Should you have any additional questions please feel free
to contact us .
Your immediate attention to this matter will be greatly
appreciated .

DECISION ON THE PETITION OF PETER & DEBORAH FADDEN
FOR A SPECIAL PERMIT FOR 47-49 LEACH ,$T. ,C�S�ALEM
A hearing on this petition was held November 28, 1984 with the following Board
Members present: James Hacker, Chairman; MetsTs. , Charnas, Lnczinski, Strout and
Associate Member LaBrecque. Notice of the heary3)g_ was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property, are requesting a Special Permit to convert a
two family dwelling dwelling into a three family dwelling in this R-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board
pf Appeal may, in accordance with the procedure and conditions set forth in Section
$III F and IX D, grant Special Permits for alterations and reconstruction of non-
H = r eonforming structures, and for changes, enlargement, extension. or expansion of non-
5 onforming lots, land, structures, and uses, provided, however, that such change,
gxten.Vion, enlargement or expansion shall not be substantially more detrimental
than Vie existing nonconforming use to the neighborhood.

2. A majority of houses in the area are two family;

3. The area is densely poplulated and already plagued with parking
problems which this plan would exacerbate.

Ph the basis of the above findings of fact and on the evidence presented at the
- - = Eearing, the Board of Appeal concludes as follows:
1 . The relief requested would substantially detract from the two family
= o character of the neighborhood and thus be substantiall detrimental
to the public good.
herefore, the Zoning Board of Appeal voted 5 - 0 against granting the requested
Special Permit. The request is therefore denied.
