JOSEPH'S CREDIT UNION n FOR A SPECIAL PERMIT AT 336 LAFAYETTE ST. (R-2 ) A hearing on this petition was held November 18, 1992 with the following Board Members present: Richard Bencal, Chairman; Richard Febonio, Francis Grealish Jr. , Edward Luzinski and Stephen Touchette. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a Special Permit to extend nonconforming use and structure allowing for construction of two additions. Property is located in an R-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3(j ) , which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. The property has been used as a commercial building for many years. 2. There are other commercial properties in the general area. 3. The new design and reconfiguration would allow petitioner to better serve customers and comply with the new Americans with Disabilities Act. J PETITION OF ST. JOSEPH'S CREDIT UNION SPECIAL PERMIT AT 336 LAFAYETTE ST. , SALEM page two 4 . The remodeled structure would help to beautify and upgrade the general area. 5. The addition would not encroach on any front setbacks. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1. The Special Permit requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. 2. The granting of the Special Permit requested will promote the public health, safety, convenience and welfare of the City's inhabitants and may be granted in harmony with the neighborhood. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the Special Permit requested, subject to the following conditions: 1. Petitioner shall comply with all City and State statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a legal building permit. Petitioner requests permission granted from the Board of Appeals to enlarge existing structure with two small additions and to change the facade of the existing structure. (2) The present exterior and interior design of the existing structure is dated and not as pleasing as the new proposed facade and type of structure as envisioned by the petitioner. The new building with its traditional McIntyre architecture would tend to beautify the area. (3) The existing operations at the credit union are being hindered by in- adequate and inefficient space. The new plan offers the credit union more space and more efficiency to better serve its community members. Operating under the present conditions is proving to be a financial hardship to the credit union. (4) The new design affords access and equal services to disabled members by providing a handicapped accessible restroom, coupon booth and teller station in conformance with the provisions of the Americans With Disabilities Act. (5) The location and size of the lot and its relation to nearby properties presently zoned for business or non-residential uses such as professional offices or apartment houses give reason to expand the current business use. (6) An increase in taxable value might result from an expansion of the current use. n r T o L i a T N 6 n Q _ r O .. w :mx o S n CD N u cn m to o cn c v c o LR:al: TO BE L C35 1 J, ) ALF N j3JT5, E / O g 1 42• .. g i y I( LEGEND 5 6g , i Y4 :iD CATCH BASIN 0 EXIST.
