A hearing on this petition was held June 15, 1994 with the following Board
Members present: Stephen Touchette, Chairman; Gary Barrett, Albert Hill
and Nina Cohen. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting Variances from side, rear,
lot size and distance between buildings to allow the fire damaged carriage
house to be demolished and rebuilt. Property is located in the R-3 zone.
The Variances which have been requested may be granted upon a finding by
this Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. There was no opposition to the petition.
2. The petitioner represented that his immediate neighbor at 276 Lafayette
St. , was in support of his proposed reconstruction.
3. The Salem Historic Commission has reviewed the plans and have given
their approval.
4 . The existing carriage house is in disrepair as a result of age and a
fire that damaged parts of the interior and the roof.
5. The proposed structure will be used as a garage.

On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
but not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0 to grant the
variances requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, ordinances,
codes and regulations.
2. All construction shall be done in strict accordance with the plans and
dimensions submitted and approved by the Historic Commission.
3. Petitioner shall comply with all requirements of the Salem Fire
Department relative to smoke and fire safety.
4. A Building Permit is to be obtained prior to beginning construction.
5. Exterior finishes of the new addition shall be in harmony with the
existing structure.
6. A Certificate of Occupancy is to be obtained.
7. Final Approval be obtained from the Salem Historic Commission.

by fire in 1979 .The shell of the structure is still standing
,' but it is in such poor disrepair that it must be demolished

The Application for Permit was denied by the Inspector of Buildings for the following
reasons: Petitioner needs variances for side, rear, total
area and distance between structures .
The carriage house was originally built on the side
boun. ary line with no setback at all . The new structure
Will be built in the same location and will not comply with
the 2,irrent zoning requirements in that: there is insuficient
sine setback, total 1a d a ea, and distance betgee buildings .
The Undersigned hereby petitions the Board of ppearls to vary the terms of tie Salem
Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed, as the enforcement of said
Zoning By-Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially dero-
gating from the intent and purpose of the Zoning Ordinance and Building Code for
the following reasons:
This petitioner ' s property is located in Salem' s
HistOCic District anu it is felt that carriage house
adds to the cnaracter of the home. The Historic Commision
has foroidden it' s removal unless it is replaced with
another "appropriate” structure. The problem is that the
old 'barn is literally falling Town. Immediate action
neeus to be taken anu the petitioner proposes to replace
the ueteriating carriage house with a replica that shall
act as a garage.

Dear Chairman Grealish:
At its meeting of May 18 . 1994 , the Salem Historical
Commission approved a Certificate of Appropriateness for the
demolition and reconstruction of the carriage house at 274
Lafayette Street. The approval is conditional that no demolition
begin until necessary approvals from the Board of Appeal are
obtained and the work is ready to commence. The applicant is
required to use as much of the original materials and details as
possible, locate the building on the same site and return to the
Commission with additional details on the cupola, windows and doors
for the Commission ' s review and approval .
Based on these conditions , the Salem Historical Commission is
in full support of the project and heartily endorses the Ronan' s
application for variances . Thank you for your consideration.
