DECISION OF THE PETITION OF LAFAYETTE LLC REQUESTING A SPECIAL
PERMIT FOR THE PROPERTY LOCATED AT 245 LAFAYETTE STREET R-2
A hearing on this petition was held Marchl9, 2003 meeting with the following Board
Members were present: Nina Cohen Chairman, Stephen Harris, Nicholas Helides,
Bonnie Belair and Joseph Barbeau. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
At the request of the petitioner's Attorney William Quinn, the Salem Board of Appeal
voted 5-0, to grant leave to withdraw this petition without prejudice requesting a Special
Permit for expansion of nonconforming use to allow the addition of 4 units and a
Variance from parking requirements for the property located at 245 Lafayette Street
located in a R-2 zone.

Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to Massachusetts
General Laws Chapter 40A, Section 11, the Variance or Special Permit granted herein
shall not take effect until a copy of the decision bearing the certification of the City Clerk

Dear Chairman Cohen,
This letter is in opposition to the request for a special permit for expansion of a non-
conforming use to allow the addition of four units and a variance from parking at 245
Lafayette Street. As you know city-wide neighborhood groups as well as individual
council members have worked long and hard to maintain the integrity of Salem's
neighborhoods by being mindful of density issues. These issues affect not only the
quality of our lives but the values of our homes.
I lived in this neighborhood in the late seventies and early eighties—and even then
parking was problematic. The issue of increased intensity of use in our older fragile
neighborhoods is an issue that this Board has been confronted with time and time again.
I hope the Board of Appeals upholds our zoning ordinances which clearly deny this type
of variance being granted and by this letter request that the Board not grant this request
for a special permit and variance .

Dear Salem Board Members, Re: 245 Lafayette St.
My family has lived next to 245 Lafayette Street for the last 16 years. When we
first moved to the neighborhood, #245 Lafayette was occupied by mostly elderly
tenants. Over the years that changed to a mix of elderly, working couples, and families.
About a year ago when talking to some of the tenants they informed us that the new
owners had raised the rents to over$1200. and installed heating units so that tenants
now had to pay for heat. Shortly after that all of the renters moved out. The units are
now being sold as condo for $209,000. and $199,000.
We are very much opposed to any expansion in the number of units in this
building. Over the year's noise, garbage and water run off have been a constant
problem at#245 Lafayette Street.
Two years ago, a dumpster was installed in the rear which was constantly filled
and over flowing. For years loose garbage from#245 Lafayette St. has been blown or
washed into Dr. Richard Winer's yard (249 Lafayette) and then into our yard.
The water run off from this building has been a huge problem. In heavy rain, all
the water from 245 Lafayette floods Dr. Winer's rear yard. This water is contaminated
with oils and greases from the cars parked at#245 this water ultimately leaches into the
abutters' yards. The new owners installed a dry well in 2002 but this can not handle the
water in heavy rains.
We have had to listen to dogs barking, domestic disputes and loud music coming
from the building at 245 Lafayette Street.
The units are currently being advertised in the MLS Real Estate Network as Pet
Friendly, Conveniently Located Next to Salem State. As a neighbor I'm concerned
there will be the possibility of a dog per unit and or college students moving in.
Adding four more units to this building will only exasperate the problems we
already have.
The neighborhood is already densely populated and we do not want additional
units added to this building.
