A public hearing on the above Petition was opened on July 15, 2015 pursuant to M.G.L Ch. 40A, 4 11 and closed on this date with the following Salem Board of Appeals members present: Peter A. Copelas (Vice- Chair),Jimmy Tsitsinos, Mike Duffy,Tom Watkins, and James Hacker (alternate)). The Petitioner seeks a Variance requesting relief from Sec. 8.2.6 Entrance Corridor Overlay District Signage of the Salem Zoning Ordinance to allow an internally illuminated blade sign faced with Jimmy John's logo. Statements of fact: 1. Ms. Cronin of Viewpoint Sign &Awning Northborough, MA presented the petition on behalf of the applicant Bendsen Signs &Graphics to secure permits on behalf of Jimmy John's restaurant. 2. In the petition date-stamped June 23, 2015, the petitioner requested a Variance from the provisions of Sec. 8.2.6 Entrance Corridor Overlay District Signage to allow an internally illuminated blade sign faced with the Jimmy John's logo. 3. The proposed internally illuminated blade sign is approximately 52"projection, 42"diameter and 6" deep, faced with the Jimmy John's logo to be mounted to the exterior brick wall at 135 Lafayette Street. 4. The Department of Planning and Community Development submitted a letter to the Zoning Board of Appeals requesting the Board to deny the permit for the following reasons: a. The City's Commercial Design Guidelines, state, "Internally lighted signs are not recommended in the Urban Renewal Areas and Entrance Corridors." b. The City is emphatic about not approving internally illuminated signage in Salem's downtown or along entrance corridors and feels that the approval of the proposal will encourage additional similar proposals. c. The location of the proposed sign is at a newly developed building in the Point neighborhood where the City and other partners are improving the area's aesthetics. d. An externally illuminated blade sign is a more appropriate option for this location. e. Other Jimmy John's locations utilize externally illuminated signage. 5. The requested relief,if granted,would allow the Petitioner to allow an internally illuminated blade sign faced with the Jimmy John's logo. At the public hearing no.members of the public spoke in favor and one (1) person spoke opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project does not meet the provisions of the City of Salem Zoning Ordinance: Findings for Variance: 1. The Board found that there are no special conditions and circumstances that especially affect the land, building, or structure involved as it is located in an entrance corridor with other businesses in the district. Further, allowing an internally illuminated sign would set precedent for other surrounding businesses in this district to install internally illuminated signs not in accordance with Commercial Le— Gomes and Sec. 8.2.6 Entrance Corridor Overlay District Signage. 2. I think we would rather see a fully exterior list blade sign rather than what you've proposed as an alternative. Our commercial design guidelines are pretty clear in not recommending the use of internally lit features along our entrance corridors (the Jimmy John's will be located along an entrance corridor). Below is an idea of the type of sign we would prefer to see—something with a fixture either as part of the bracket or affixed to the building, which would be set above and shining down on the sign. Again, we're fully comfortable with the backlit letters shown in your scheme. The purpose of the Entrance Corridor Overlay District(ECOD) is to augment underlying zoning regulations in designated areas to: 1. Protect and enhance the major entrance ways into the City; and 2. Ensure that such areas are improved in a manner which is in the best interest of the City. 8.2.2 Applicability. The ECOD shall be established along the corridors designated on the zoning map. The boundaries of the overlay shall be interpreted as following the rear lot lines of properties fronting on the corridor or along a line one hundred fifty(150)feet from the centerline of the corridor, whichever is less. 1. Properties within such district shall be controlled by the regulations of the underlying zoning districts, except as hereunder specified. In instances of conflicting requirements, the restrictions listed below shall prevail. 2. The requirements of this section shall not apply to Planned Unit Development(PUD) proposals, or those development proposals which are required to obtain a site plan review special permit. 8.2.3 Requirements. The following requirements shall apply to all properties in the ECOD: 1. Curb cuts. Only one (1) curb cut of no greater than twenty-four (24)feet shall be permitted for all residential uses. A maximum of two (2) curb cuts no greater than twenty-four (24) feet each shall be permitted for all commercial uses. 2. Mechanical equipment and refuse storage areas. No refuse storage areas or mechanical equipment areas shall be located in a front yard, nor within twenty-five (25) feet of the front lot line of the side yard. Such areas shall be screened from all public ways, parking areas, residential land uses and open spice areas. 8.2.4 Fences. In order to maintain and maximize aesthetic views and sight lines, all fences along the front and side lot lines shall comply with the following standards: 1. No fence along front or side lot line shall be more than four(4)feet in height, as measured from the curb level of the street, or average grade elevation of the land where the fence is to be located,whichever is deemed appropriate. 2. Chain link and wire fences are prohibited along front and side lot lines. 3. The purpose of the Entrance Corridor Overlay District(ECOD) is to augment underlying zoning regulations in designated areas to: 1. Protect and enhance the major entrance ways into the City; and 2. Ensure that such areas are improved in a manner which is in the best interest of the City. 8.2.2 Applicability. The ECOD shall be established along the corridors designated on the zoning map.The boundaries of the overlay shall be interpreted as following the rear lot lines of properties fronting on the corridor or along a line one hundred fifty(150)feet from the centerline of the corridor, whichever is less. 1. Properties within such district shall be controlled by the regulations of the underlying zoning districts, except as hereunder specified. In instances of conflicting requirements, the restrictions listed below shall prevail. 2. The requirements of this section shall not apply to Planned Unit Development(PUD) proposals, or those development proposals which are required to obtain a site plan review special permit. 8.2.3 Requirements. The following requirements shall apply to all properties in the ECOD: 1. Curb cuts. Only one (1) curb cut of no greater than twenty-four (24) feet shall be permitted for all residential uses. A maximum of two (2) curb cuts no greater than twenty-four(24)feet each shall be permitted for all commercial uses. 2. Mechanical equipment and refuse storage areas. No refuse storage areas or mechanical equipment areas shall be located in a front yard, nor within twenty-five (25) feet of the front lot line of the side yard. Such areas shall be screened from all public ways, parking areas, residential land uses and open spice areas. 8.2.4 Fences. In order to maintain and maximize aesthetic views and sight lines, all fences along the front and side lot lines shall comply with the following standards: 1. No fence along front or side lot line shall be more than four (4)feet in height, as measured from the curb level of the street, or average grade elevation of the land where the fence is to be located, whichever is deemed appropriate. 2. Chain link and wire fences are prohibited along front and side lot lines. 3. Any fence constructed within an ECOD shall require a fence permit issued by the City building department. 8.2.5 Parking Areas. All parking areas of more than twelve (12) spaces shall be arranged and landscaped to properly screen vehicles from adjacent properties and streets. As you are likely aware, 135 Lafayette Street is located within the Entrance Corridor Overlay District(ECOD). The Department of Planning and Community Development (DPCD) recommends against the granting of a variance for this project for the following reasons: 1. The City's Commercial Design Guidelines, state, "Internally lighted signs are not recommended in the Urban Renewal Areas and Entrance Corridors." (Please see first attachment). 2. We are particularly emphatic about not approving internally illuminated signage in Salem's downtown or along entrance corridors and feel that approval of this proposal will encourage additional similar proposals. 3. The location is at a newly developed building in the Point neighborhood,where a considerable amount of time and effort by the City and others is being put into improving the area's aesthetics. 4. We believe that an externally illuminated blade sign is a more appropriate option for this location. ' i 5. Lastly,we have found that other Jimmy John's locations utilize externally illuminated signage (please see second attachment). We believe that given the company's willingness to work with other communities on meeting a certain aesthetic for signage, that it should also be willing to adhere to the Salem's Commercial Design Guidelines and follow the standards set forth for signage within the ECOD.
