The Petitioner seeks a Special Permit per Sec. 3.1 Principal Uses, of the Salem Zoning Ordinance, to allow an indoor commercial recreational use including puzzle rooms and virtual reality experiences. Statements of fact: 1. In the petition date-stamped May 26, 2017, the Petitioner requested a Special Permit the petitioner Special Permit per Sec. 3.1 Principal Uses, of the Salem Zoning Ordinance, to allow an indoor commercial recreational use including puzzle rooms and virtual reality experiences. The petitioner is also requesting Variances for relief from Sec. 3.3.4 Variance Required to allow less than the required setbacks and Sec. 5.1.8 Table of Required Parking Spaces to allow less than the required number of parking spaces. 2. Attorney Scott Grover presented the petition. 3. The property is located in an Industrial Zoning District. The petitioner is proposing to establish a new business in the existing building offering a variety of indoor entertainment options including puzzle rooms,virtual reality experiences and theatrical exhibits year-round. 4. Currently, portions of the building are occupied primarily with storage and office space. 5. In the Industrial Zoning District, indoor commercial recreational uses are permitted by Special Permit under Section 3.3.4 of the Zoning Ordinance. 6. The petitioner is also proposing structural changes to the existing non-conforming structure. The petitioner is proposing three (3) new stairways that will encroach further into the already existing nonconforming setbacks. The setback requirements are thirty (30 ft) feet and the petitioner is proposing to be within 14.8 feet at the most narrow point. The petitioner is also proposing to install shipping containers along the rear and sides of the building to provide an expansion of space and better circulate visitors through the virtual reality and puzzle room experience. 8. The petitioner is also requesting a variance from the parking requirements of Section 5.1.8 of the Zoning Ordinance to allow less than the required parking spaces. Under this section, one (1) parking space is needed for each 36 square feet of floor area plus one space for each two (2) employees. To comply with the requirements of the Zoning Ordinance, the petitioner would need to provide 180 parking spaces on the property. The petitioner is proposing a total of twenty-three (23) parking spaces. 9. The petitioner proposed to off-set parking demand by limiting the number of people and timing of arrival through online ticketing sales and timed ticketing. The petitioner proposed a trolley service to pick-up and drop-off patrons during the October season and to pay for employee parking or pay for Lyft and Uber services to eliminate additional vehicle parking demand. 10. The petitioner also proposed to make it know to their patrons that parking is limited and to encourage the use of public lots and the MBTA garage during October. 11. During October, it is expected that between 200 and 300 guests could be visiting at one time and queued inside of the building to wait for a turn to experience the exhibit. 12. At the June 21, 2017 meeting, the Board expressed concern about the number of parking spaces and proposed alternative methods of transit to the site during October and requested that the petitioner work with a traffic engineer to provide information on traffic and parking impacts, pedestrian circulation and safety, and loading. 13. The Planning Department also requested that the petitioner consider further traffic mitigation including the addition of a crosswalk at the driveway openings and other mitigation opportunities to allow for safe pedestrian access to and from the site. 14. The requested relief, if granted, would allow the Petitioner to have an indoor commercial recreational use including puzzle rooms and virtual reality experiences, construct within the required setbacks and allow less than the required number of parking spaces. 15. At the June 21, 2017 meeting the petitioner requested to continue to the regularly scheduled meeting on August 16, 2017 to allow the petitioner time to work with a traffic engineer. 16. At the August 16, 2017 meeting, the petitioner requested to continue to the September 20, 2017 meeting. No testimony was heard on this date. 17. At the September 20, 2017 meeting, the petitioner requested to continue to the October 18, 2017 meeting. No testimony was heard on this date. 18. At the October 18, 2017 meeting the petitioner requested to withdraw the application without prejudice. 19. At the public hearing, twenty-two (22) abutters and two (2) City Councilors spoke in opposition to the application, due to concerns about traffic and parking. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in favor (Peter A. Copelas (Vice-Chair), Tom Watkins,Jimmy Tsitsinos, and Paul Viccica (alternate) and none (o) opposed, to allow the petitioner to withdraw the application without prejudice. Presently, portions of the building are occupied primarily for storage purposes. The petitioner is proposing to make a substantial investment in interior renovation and to make relatively minor changes to the outside such as the installation of new entryways and cosmetic repairs. In addition, shipping containers will be installed around portions of the perimeter of the building to house exhibits. The use of the property for indoor commercial recreational purposes is permitted by Special Permit in the Industrial Zoning District under Section 3.3.4 of the Zoning Ordinance. The finding required for the issuance of such a Special Permit is that the adverse effects of the proposed use will not outweigh the beneficial impact on the City. In this case, the present building has been seriously underutilized for many years. It is the intention of the new owner to restore the building and return it to a more productive use which will benefit the neighborhood and the City as a whole. In addition to the Special Permit for use, the plans of the petitioner will require a variance from parking requirements of Section 5.1.8 of the Zoning Ordinance. Under that Section, one parking space is required for each 36 square feet of floor area plus one space for each two employees. The actual floor area of the entertainment space at 1 Jefferson will be approximately 6,477 square feet(including the new shipping containers), requiring a total of 180 spaces before considering the number of employees. To provide this number of parking spaces would require land area of roughly 35,000 square feet when the area of 1 Jefferson Avenue is only 24,000 square feet. The size of this building coupled with the relatively small land area are special conditions which make the parking requirements for any permitted uses very difficult to achieve. For the proposed use as an entertainment facility, achieving the required parking is an impossibility. For these reasons, a literal enforcement of the parking requirements will cause both the petitioner and the landowner a substantial hardship. The petitioner has entered into a contract with a private trolley company which will transport customers from downtown locations to the property. In addition, tickets to the facility during October will only be sold on a"timed ticketing"basis which will discourage individuals from arriving at the property prior to their scheduled admission time. These factors will minimize traffic and mitigate problems associated with overflow parking into the abutting neighborhoods. The structural changes to the existing nonconforming building also require a variance under Section 3.3.4. Specifically, the three new stairways to be constructed will encroach further into the already nonconforming setbacks. Because the existing building already encroaches into the 30-foot setback required in the Industrial District on three sides, any change for the purpose of providing reasonable access would be prohibited if the Ordinance were literally enforced. The inability to provide reasonable access to the building without a variance would cause a substantial hardship. For the reasons set forth above, both the variances from the parking and the dimensional requirements of the Ordinance may be granted without substantial detriment to the public good and without substantially derogating from the intent of the district or the purpose of the Ordinance. The neighborhood surrounding the aforementioned address is a quiet residential neighborhood consisting of many multi-family buildings and scattered single family buildings. A potentially noise attracting business with inadequate parking is a poor fit for this neighborhood. The primary concern of this variance is that of parking. The neighborhood is mainly made up of many multi-family buildings with few driveways. This being the case, tenants are dependent on on-street parking for their cars and most prefer a parking spot close to their homes for convenience of walking distance and feeling of security by being able to see their car from their home. Being an owner of a multi-family in this neighborhood and talking to many tenants and prospective tenants over the years, I know how important on-street parking is to my tenants and consequently how important on-street parking is to me as a landlord. If a reliable amount of parking is not available for tenants, their convenience and feeling of security is decreased which in turn hurts my business as a housing provider. Additionally, parking during snow-bans would be even worse. With precious few spots available during snow-bans for tenants who park on-street, the parking situation would be even worse if customers of the variance-seeking business were to start parking in snow-ban available parking lots. A secondary concern this variance raises is that of noise in the neighborhood. A great benefit of the neighborhood that I've seen personally living in it is that it is quiet. Even though it is close to downtown, the foot traffic is minimal which means any noise generated by pedestrians is minimized making it a very comfortable place to live. Many of the houses in the neighborhood are very old and not well insulated which lets in sound very easily. During the Halloween season the neighborhood gets a glimpse of what an increased foot-traffic area is like as noisily chattering tourists pass through the neighborhood on foot to get to their cars out of the range of resident-only street parking, which this neighborhood becomes during Halloween. It would detract from the neighborhood greatly if this level of pedestrian noise became constant year round due to the variant-seeking business' increased foot traffic from boisterous gaming-based customers as they walked to their cars in over-flowing parking areas. This would definitely infringe on the quiet enjoyment demanded by residents of the neighborhood and in turn hurt landlord's ability to market and profit from buildings in this area harming home values. The final concern that a variance should not be allowed is due to how late the proposed business would be open. Again, as a quiet residential community, noisy customers walking the streets and starting cars late into the night possibly beyond 11:00pm is unacceptable. Hopefully, the Board will agree that the variance this business is seeking would definitely disturb residents and hurt the livability, marketability, profitability and value of the neighborhood for tenants and owners alike. I am a resident of Winthrop St. with no on street parking as are several of the properties on our street.The idea of an entertainment venue including a haunted house during the month of October is not conducive to the parking shortage already in our neighborhood. This proposed venue is off the beaten path of downtown Salem and its haunted attractions. The idea that people are going to park downtown and walk to this venue is just not practical.Timed ticketing will not alleviate the anticipated parking overflow in our neighborhood.The notion of trolleys available at a moment's notice to transport patrons to this venue is also not feasible or believable. Downtown traffic during October is a congested nightmare.No trolley is going to be able to navigate that traffic in order to deliver patrons in time for their allotted time slot.And what happens when a ticket holder gets held up in traffic on their way into Salem and can't make the trolley?They are going to park on the surrounding streets of the attraction. It has been suggested that posting `resident only' parking signs in our neighborhood will deter patrons from parking on our streets. Visitors to this venue will ignore the temporary resident only parking signs that already go up on our streets in October as much as current visitors to Salem in October already do. I have witnessed it personally, and have addressed it with offenders. It is not a challenge I care to address on a regular basis for an entire month. It has been suggested that a detail officer will deter patrons from parking in our neighborhood. A detail officer is not going to ask where patrons are parked and if he/she does,they are not going to be given an honest answer. There is simply not enough parking attached to this property to allow for this kind of proposal. The MBTA strip of land between 1 Jefferson Ave and the police station that is suggested as an option is used by police department staff for their personal vehicles. It is unlikely that this is suddenly going to be made available for this business. The applicants are simply being naive or selfish in their request for approval of this project without regard for the negative impact on the neighborhood. Their solutions are not practical or applicable. It is my belief that patrons are going to park in the neighborhood well before their scheduled ticketed time, and maybe visit the nearby cider tasting room while they await their time slot. That's what I would do. I am not in favor of this proposition and am asking that you please deny the request for this project.
