Dear Condo Owners,
I
About a year ago, I identified structural problems in both the front and rear porches. The more
severe being the rear porches. The directive issued last year was to have a qualified individual
(ie-a Structural Engineer) evaluate and design repair or replacement methods for the porches.
To date, nothing has been done that this office is aware of. This a Building code violation and
failure to address this matter within 15 days will result in Municipal Code tickets and further
enforcement actions. If you feel you are aggrieved by this action, your appeal is to the Board of
Buildings,Regulations and Standards in Boston. Please have a representative of the Condo
Association reply in writing or by e-mail what your plan is

DECISION ON THE PETITION OF GREGORY MAITLAND REQUESTING A

A hearing on this petition was held on June 15, 2005 with the following Board Members
present: Nina Cohen, Chairman,Nicholas Helides, Edward Moriarty, Stephen Pinto and
Bonnie Belair. Notice of the hearing was sent to abutters and others and notices of the
hearing were published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner is requesting a Variance from the number of stories to construct a 3`d floor
dormer for the property located at 29-31 Leach Street located in an R-2 district.
The Variance which has been requested may be granted upon a finding of the Board that:
a. Special conditions and circumstances exist which especially affect the land,building
or structure involved and which are not generally affecting other lands, buildings and
structures in the same district;
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district or the purpose
of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and after
reviewing the plans at the hearing, makes the following findings of fact:
1. The house was a legal 4 family converted into 4 condominiums. The other three unit
owners are in approval of the project.
2. There was no opposition to the proposed variance.
On the basis of the above finding of fact, the evidence presented at the hearing, the
Zoning Board of appeal concludes as follows:
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petition.

3. Desirable relief can be granted without substantial detriment to the public good and

Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, ordinances,codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing .
structure.
6. There will be no roof deck allowed on the dormer.
7. A Certificate of Inspection is to be obtained.

Committee hot line, I conducted an inspection of the above mentioned
Property and found the following:
1. Rear porch repairs were being performed without proper permits.
2. Lags must be installed each 24" to anchor porch to house.
3• -nstall additional support for second floor porch.
4• Remove sofa from front porch at second floor.

course of action to rectify this situation. Failure to do so will result in
legal action being taken against you.

101.4 Referenced Standards: Where differences occur between provisions of this
code and referenced standards, the provisions of this code shall apply.
SECTION 102.0 ORDINARY REPAIRS
102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, ]seating system or any
other equipment is specifically controlled by the provisions of this code or tlse
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction.
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof, both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.

121.3 Prosecution of violation: If the notice of violation is not complied with
within the time period specified in the notice, unless otherwise provided in this code,
the building official may institute the appropriate proceedings at law or in equity in
a court of competent jurisdiction to restrain, correct or abate such violation or to
require the removal or termination of the unlawful use of the building or structure
in violation of the provisions of this code or of the order or direction made pursuant
thereto.

Northeast Housing Court, and failed to appear . You also

Mr. Richards , the charges on you can not be dismissed
unless you are present in court and until you file a
permit application. The Judge has continued your case
until August 29 , 1995 at 9 : 00 a .m. in Salem District
