Petition of AL SNAPE seeking to appeal the Budding Inspector's interpretation of the Tasting Room
regulations as defined in Sec. 10 of the Salem Zoning Ordinance for the property located at 108 JACKSON
STREET(Map 25 Lot 390)(13-4 Zoning District).
A public hearing on the above Petition was opened on August 16,2017 pursuant to M.G.L Ch. 40A, § 11 and
was continued to the next regularly scheduled meeting on September 20, 2017 and October 18, 2017. The
hearing was closed on October 18, 2017 with the following Salem Board of Appeals members present: Peter
A. Copelas (Vice-Chair),Tom Watkins,Jimmy Tsitsinos,and Paul Viccica (alternate).
The petitioner is seeking to appeal the Building Inspector's interpretation of the Tasting Room regulations as
defined in Sec. 10 of the Salem Zoning Ordinance.
Statements of fact:
1. In the petition date-stamped July 19, 2017, the Petitioner was seeking an appeal of the Building
Inspector's interpretation of the Tasting Room regulations as defined in Sec. 10 of the Salem Zoning
Ordinance.
2. Al Snape,petitioner was present at the public hearing.
3. The petitioner was before the Board seeking an appeal of the Budding Inspector's interpretation of a
Tasting Room as defined in Sec. 10 of the Zoning Ordinance.
4. The staff planner presented the information that the City's Zoning Ordinance defines a Tasting Room
as: "A room attached to a brewery,distillery,or winery that allows patrons to sample or consume win,
beer, and other alcoholic beverages that are produced on-site in accordance with M.G.L c. 183. A
tasting room may not be greater than fifty (50)percent of the main building's gross square footage.A
seasonal tasting area is permissible, but shall not be included in calculating the tasting room's square
footage for purposes of zoning compliance; however, the square footage of a seasonal tasting area is
applicable to building,plumbing and other relevant codes."
5. Far From the Tree Cider operates in two (2) separate buildings at the property of 102-108 Jackson
Street.The existing tasting room has production space.
6. The petitioner requested to expand the existing tasting room by removing all production facilities in
this building at the time of the application. The Building Inspector made a determination based on
this information that the proposed removal of production facilities from the existing tasting room no
longer meets the definition of a tasting room.
7. On August 16, 2017 the petitioner submitted a letter with clarification that the 440 square foot
basement at 108 Jackson Street is licensed production space that was not part of the original square
footage presented to the building inspector.

8. The petitioner is proposing to continue to utilize the existing licensed basement of the existing tasting
room as a production area.
9. The building inspector determined, in light of the information provided by the applicant on August
16, 2017, that the proposal meets the definition of a tasting room as defined by the Salem Zoning
Ordinance.
10. On August 16, 2017,the petitioner did not present any testimony and requested a continuation of the
public hearing until September 20,2017 to wait for the issuance of a building permit
11. At the September 20, 2017 meeting, the petitioner did not present any testimony and requested a
continuation of the public hearing until October 18,2017.
12. On October 18,2017, the petitioner requested to withdraw the application without prejudice.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted four (4) in
favor (Peter A. Copelas (Vice-Chan), Tom Watkins,Jimmy Tsitsinos, and Paul Viccica (alternate) and none
(o) opposed, to allow the petitioner to withdraw the application without prejudice.
The application is withdrawn without prejudice.

A 440 square foot basement production area at 108 Jackson St. was omitted from the original
documents because this area does not contribute to the gross square footage of the main building or
the proposed tasting room. It does however have importance in regards to the interpretation of tasting
room regulations.This area was on our original tasting room plans 2 years ago and is still in use and will
continue to be in use in the future for hard cider production.
The proposed capacity increase of 108 Jackson St. meets the requirements of"A room attached to
either a brewery,distillery or winery that allows patrons to sample or consume wine, beer,and other
alcoholic beverages that are produced on-site in accordance with M.G.L. c. 138.". With the proposed
increased capacity 108 Jackson St. will continue to be a licensed working winery.The production area in
the 440 sq.ft. basement will continue to act as a winery production area. The tasting room is attached
to the basement,the basement and tasting room are a smaller winery building next to the main winery
building.
The proposed capacity increase of 108 Jackson St. meets the requirements of"A tasting room may not
be greater than fifty(50) percent of the main building's gross square footage.A seasonal tasting area
is permissible,e.g. patio or deck, but shall not be included in calculating the tasting room's square

Hi Erin,
My apologies for not pulling before the last meeting, we had been waiting on a final word from
Tom and it didn't come in until the day after the meeting due to our architect turning things
around a bit slower than we hoped. I was also in surgery and recovering during the last couple of
days so my head was elsewhere. We'd like to withdraw without prejudice. I've drafted a letter
that will be in the mail today. Thank you for all your help as we clumsily attempted to navigate
the ZBA system, we are extremely happy that we'll be able to stay at our location as a result.

Dear Board Members:
I am writing this letter in support of the proposed addition of two bathrooms and the allowance of
a capacity increase from 49 to 99 patrons at the Far From the Tree cider tasting room. I have seen no
negative impact on the neighborhood from this business.They have been good neighbors and a welcomed
addition.
I was just there on Friday night and was disappointed to be denied entry because they were at
capacity. We took advantage of the food truck that was visiting, and were surprised to see so much room
and empty seating available on the patio. It was a beautiful night and it would have been nice to enjoy a
glass or two of cider with my meal and support a local business but instead had to take our food home to
consume.This business has been in our neighborhood for two years and I have never heard a complaint.It
would be a shame to see them leave the area and perhaps Salem if they are not allowed to expand their
business.
Far From the Tree offers a welcomed alternative to those of us who do not drink beer or hard
liquor. Their cider creations are unique and interesting and allow Salem to offer something distinctive not
found anywhere else.They have put Salem on the map in the local hard cider world. I love that I can
bring my growler(large bottle)in to be refilled for at home consumption. They are a model of small
business and I support them.

I'm contacting you to express my support of the expansion of Far From the Tree. The owners of the business
have taken a building that was an absolute dump and transformed it into a gem. There is plenty of room both
inside and out, and they should not be restricted merely because the building they transformed came with only
one bathroom.
Additionally, the part of Salem where FFTT is located is in desperate need of renewal. Restricting FFTT would
discourage burgeoning business owners from choosing Salem as a location. Also, I would hate to lose FFTT if
they must relocate to accommodate their growth. Their product is amazing and is helping to establish Salem as
a 1st class destination for foodies & craft brew aficionados, as well as for the Halloween tourists.
