The Applicai!on for Permit was denied by the Inspector of Buildings for the following
reasons:
A Special Permit is required for the construction of a medical office Building/
private clinic in an R-1 zone within 1 ,500 feet of Salem Hospital in accord-
ande with section V.B.l.f of the Salem Zoning Ordinance.
The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem
Zoning Ordinance anal/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed, as the enforcement of said
Zoning By-Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief -may be granted without substantially dero-
gating from the intent and purpose of the Zoning Ordinance and Building Code for
the following reasons:
In accordance wit:h. the requirements of section V.B.l.f. of the Salem Zoning Ordinance,
a Special Permit is sought for the construction of a medical office building/private
clinic within 1 ,500 feet of Salem Hospital in an R-1 district. Under section II.B.9
of the Zoning Ordinance, a private clinic is defined to include a building having
doctor's offices.
It is believed that the issuance of such a Special Permit would be in harmony with the
intent of the Zoning Ordinance since:
- the development of the site for a medical office building will involve the rem-
oval of an existing gasoline station and replacement with an attractive new
building with good landscaping.
- the site is located within 1 ,500 feet of Salem Hospital
- there will be less trips by cars in and out of the site compared to its present
use as a gasoline station. Ro
