Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner request a Special Permit,Per Section 8-5 to allow existing non-conforming use (car dealership)to be converted to an Animal Shelter for the property located at 347 Highland Avenue located in a BPD zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3 (2) (8)which provide as follows: Notwithstanding anything to the contrary appearing in this Ordinance,the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion, of nonconforming lots, land, structures,and uses,provided however, that such change, extension,enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is,when reviewing Special Permit requests, guided by the rile that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare for the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise,to the petitioner. C. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. DECISION OF THE PETITION OF NORTHEAST ANIMAL SHELTER REQUESTING A SPECIAL PECIAL PERMIT FOR THE PROPERTY LOCATED AT 347 HIGHLAND AVENUE BPD page two The Board of Appeal, after careful consideration of the evidence presented, and after viewing the plans,makes the following findings of facts: 1. Petitioner,Northeast Animal Shelter, Inc. was represented at the hearings by Attorney Charles Blaisdell of Salem. 2. Petitioner presented two Petitions at both public hearings, numbering in excess of approximately 1100 signatures in favor of the request for a Special Permit. 3. A petition by a score of neighbors was submitted in opposition,raising concerns of traffic,noise,order density,and appropriateness of the proposed use to the neighborhood. 4. Ward 4 Councillor Lenny O'Leary appeared in opposition to echo the complaints of the neighbors in opposition. 5. City Council President Jean Pelletier also appeared in opposition, raising questions of traffic, density, noise, and the most appropriate use of the site in a BPD District. 6. Petitioner has standing to move for the Special Permit relief requested pursuant to a document submitted by the owner of record, Cathleen Kavanaugh, Trustee of Kelhon Realty Trust,dated November 29, 2005, indicating that an executed Purchase and Sale Agreement had been entered into by and between Northeast Animal Shelter and Kelhon RealTrust owner of the Realty premises at 347 Highland Avenue, previously occupied and operated for many years by Kelly Honda, formerly of Salem, now of Lynn,Ma. 7. Petitioner offered evidence that its current location,times 30 years, at 204 Highland Avenue, is too small and is otherwise inappropriate for its intended purpose, namely at the larges nonprofit animal shelter in the region that does not destroy animals, specifically cats and dogs, entrusted to its car, and finds suitable homes for said stray animals. 8. Petitioner represented that over 30 years they have placed in excess of 90,000 homeless dogs and cats into loving homes, through a careful and reasoned adoption process. 9. Petitioner represented that the recent relocation of Kelly Honda/Salem to Kelly Honda/Lynn provided the shelter with a golden opportunity to relocate almost across the street from the current location, at a premises that will provide an immediate end- use structure, totally consistent with its goals, objectives and operations, without any structural alterations whatsoever. 10. Petitioner noted, by way of legal argument, that the proposed use would merely substitute one pre-existing non-conforming use, namely an auto dealership, for another non-conforming use, namely the animal shelter, in the BPD Zoning District. 11. However, Petitioner emphasized, in a public Hearing attended by in excess of 100 supporters of this Petition on both occasions, that the requested relief was not in conflict with the general objectives of the Zoning Ordinance, and, rather than being a detriment, would provide a benefit and service, of the highest order, to the City of Salem and its many and varied pet owners and lovers. 12. Petitioner indicated that the use of the premises would not be obnoxious, offensive, detrimental, or otherwise create a nuisance to the neighborhood, noting that its current use, just a very short distance up Highland Avenue on the opposite side, had resulted in not one complaint against the shelter for its operation at the police department, animal control officer, or Salem Board of Health in its 30 years of continuous operation. 13. Petitioner noted that the use of the premises would continue to be commercial, consistent with other surrounding uses, but that the use would be a higher or more valued use in terms of sheltering and saving stray cats and dogs, as opposed to the sale, resale, maintenance, or repair of motor vehicles, specifically Hondas. 14. Petitioner provided plans indicating no structural changes to the premises. 15. Petitioner provided plans indicating more than ample parking, pursuant to Salem Zoning Ordinance, including 146 parking spaces, six handicapped spaces, and 29 parking spaces for employees at premises that currently limit full-time employees to six and part- time employees to 20. 16. Petitioner noted that not only would there be no structural alteration to the building, but that the existing building in its configuration was an end-use building for the shelter's purposes. 17. Specifically, the current configuration of the building would fit perfectly with the animal shelter's intended use. 18. For example, several existing offices and a conference room could be utilized for administration and for adoption purposes. 19. The multi existing auto repair bays would be ideal for indoor runs for dogs. 20. The rather long and narrow existing auto parts supply room would be ideal for animal food and supplies. 21. In sum, the Petitioner suggested that the building was almost in move-in condition, and is truly an end-use purchase for the shelter. 22. The Petitioner specifically represented that the granting of the relief requested, to substitute one non-conforming use for another non- conforming use, would not adversely impact the neighborhood, would generate less, not more, auto traffic, with more parking, and would be serviced by already existing and adequate utilities and public services, and would have no detrimental impact on the natural environment or character of the neighborhood. 23. Petitioner was receptive to concerns raised by neighbors and the Board regarding traffic, congestion and parking. 24. Petitioner noted that parking would be strictly one-way in and one- way out. 25. Petitioner noted that there was more than ample parking based on the number of trips the facility was likely to generate, on a weekly, monthly, or yearly basis, in the placement of its adopted animals. 26. Petitioner indicated that the hours of operation would be consistent with those at its current locus, Monday through Friday 9:00 a.m. — 9:00 p.m., and Saturday and Sunday 9:00 a.m. — 6:00 p.m., with the weekends likely to generate more traffic, but not, in any event, more traffic than the current site. 27. The Petitioner responded to neighborhood concerns regarding odor, noise and dog waste by indicating that the new building was constructed in a good and workmanlike manner and appeared to provide adequate sound barrier walls and roof. 28. The Petitioner noted that all waste would be contained on premises and handled in a sanitary manner. 29. Petitioners also noted that there would be no outdoor dog runs, and that all of the dogs could run, in a healthy, safe, sanitary, and quiet manner, in the large existing auto shop repair bays on the premises. 30. Petitioner also compared and contrasted, favorably, in terms of density, traffic and noise, the current use of the premises by Kelly Honda with the proposed use of the premises as an animal shelter. 31. Petitioner estimated that Kelly Honda's premises were operated in a manner that generated more traffic, more noise, and more congestion than the proposed operation, based on the number of cars that Kelly sold per week, the number of cars that Kelly repaired per week, the number of customers that came to Kelly's premises weekly, the number of service vehicles that serviced Kelly's, including numerous car-hauler trailers, etc., etc.. 32. By way of contrast, the Petitioner pointed out that it placed far fewer animals per month than Kelly Honda sold vehicles per week, that it had far fewer employees, that it had far fewer vendors and services vehicles, and that, in summary, the use of the premises would be less dense, less noxious and less traffic-intensive than Kelly Honda, of Salem. 33. Mr. Kelly testified that he relocated to Lynn because his Salem site was too small for his expanding Honda business of sale/resale and repair of Honda motor vehicles. 34. Neighbors raised concerns related to outdoor animal runs and leaving animals outside unattended. 35. The Petitioner represented that there would be no outdoor animal runs, and that animals would never be left unattended, in any event, when outdoors. 36. Petitioner also emphasized that, in terms of use of the premises, at any one time, the animal shelter might have as few as two or three dogs, plus puppy litters, and the same number of cats and kitten litters on premises, and that it was by placing animals in adoption and changing the animal inventory regularly that the center was able to place approximately 90,000 animals with qualified adoptive families over the last 30 years. 37. Neighbors questioned whether the large structure under Purchase and Sale Agreement by the Shelter would be utilized exclusively for Northeast Animal Shelter purposes. 38. The Shelter emphasized that this was an end-use building, that it had absolutely no intention of using the building for any other purpose, and certainly would not be letting or subletting the premises to any other tenant. 39. The opposition to the Petition was concerned not only about the number of animals, but whether the animals were coming from distant points or out of state, and whether the animals were healthy or unhealthy or subject to quarantine. 40. The shelter assured the Board that the dogs would not be shipped in from all over the United States, but, instead, would come from the area, would be appropriately restrained and quarantined, as necessary, under applicable state laws. 41. In summary, the Petitioner presented substantial written and oral evidence, plans, petitions and documents, in support of its contention that a Special Permit should be issued to the Northeast Animal Shelter, to operate its humanitarian animal shelter business, which has been ongoing, without interruption or complaint, for 30 years, just down the road on Highland Avenue at a new adjacent larger, better, safer, cleaner, well-lit, secure facility at 347 Highland Avenue, Salem, MA. On the basis of the above findings of fact, including all of the evidence presented at two very lengthy public Hearings, including, but not limited to, detailed plans, including the Petition, and substantial, credible and extensive testimony in support thereof, the Zoning Board of Appeals concludes as follows: 1. The proposed use of said premises may be changed from an auto dealership and repair shop to another non-conforming use, namely an animal shelter, insofar as the Board specifically finds that the proposed use is equally appropriate or more appropriate to the District than the existing non-conforming use as an auto dealership. 2. The Board further finds that the relief requested may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent and purpose of this Ordinance. 3. The Board also specifically finds that the granting of the Special Permit, with the conditions and safeguards noted hereinafter, is appropriate and in harmony with the purpose and intent of this Ordinance. 4. The Board further finds that the proposed use of the premises, as changed, altered or extended by the Petitioner, will not depart from the intent of this Ordinance and its prior use or degree of use, insofar as the building or its proposed use is neither increased in volume nor area unreasonably. 5. The Board further finds that no structural alterations are being made by the proposed use, that the proposed use provides adequate parking pursuant to all applicable Salem Zoning Ordinance regulations, and that the proposed use is equally appropriate or more appropriate to the District than the existing non-conforming use. 6. In permitting such change, the Board of Appeals does require certain appropriate conditions and safeguards as noted hereinafter. On the basis of the above findings of fact, and on the evidence presented at the hearing,the Board of Appeal concludes as follows: 1. Literal enforcement of the provisions of the ordinance would involve substantial hardship on the petitioner. 2. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. 3. The Special Permit granted can be granted in harmony with the neighborhood and will promote the public health, safety, convenience and welfare of the City's inhabitants. 4. Special conditions exist which especially affect the subject property, but not the district in general. On the basis of the above findings of fact, the Zoning Board of Appeal voted 5 in favor and 0 in opposition to grant the Special Permit requested, subject to the following conditions. 1. Petitioner shall comply with all city and state statues, code ordinances and regulations. 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. All construction shall be done as per the plans and dimensions submitted and approved by the Building Commissioner. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Petitioner shall obtain a Certificate of Inspection. 6. Petitioner shall obtain proper street numbering for the City's Assessors Office and display said number so as to be visible from the street. 7. Petitioner shall obtain approval from any City Boards or Commission having jurisdiction including, but not limited to the Planning Board. 8. Unless this decision expressly provides otherwise, any zoning relief granted does not authorize Petitioner to demolish or deconstruct any structure (s) on the property to an extent greater than 50% of the structure as measured by floor area or replacement cost. If a structure on the property is demolished by any means to an extent of more than fifty percent of its replacement cost or more than fifty percent of its floor area at the time of deconstruction, it shall not be reconstructed except in conformity with this Ordinance. 9. No animal shall be left unattended outside. 10. Runs must be maintained indoors. 11. Papers from the State regarding the quarantine of dogs be submitted to the City of Salem Health Department 12. If there is any expansion of the use of the premises,Petitioner shall come back to the Board of Appeals for an other Special Permit. I am a taxpayer in Salem and I disagree with the position the mayor has taken to get a "for profit" business there in order to collect taxes. First, the amount of taxes paid would be a relatively small amount in the scheme of things, second, the shelter has stated they would make annual payments in lieu of taxes to help the city and third, who knows how long it would be, if ever, before a business showed interest in that property. I realize there is a financial crisis in our city but there are other ways to generate revenue without blocking this move. Decisions about the growth and stability of a city should not always be determined based on money alone. The goodwill that is generated by the shelter along with the business for other local stores and tourist attractions (i.e. pet stores, restaurants, gift shops, etc) by people who come to the shelter, far outweighs the benefits of having a for-profit business in that location. People come from all over New England to adopt animals from this no-kill shelter. Having the shelter in Salem contributes to our uniqueness and can only be a good thing for our city and its reputation. The staff at the shelter works tirelessly for the animals and the people who adopt them. The current location is cramped and out-dated. It is time they have the.'space and the opportunity they deserve to expand and grow and provide even more animals:with loving homes. 347 Highland Ave. is an ideal location because 1) it is so close to the current location, zoning should not even be an issue 2) it is an appropriate location for the shelter and has everything they need to provide quality care for the animals and 3) it would be a major loss for our city 3/29/2006 Page 2 of 2 t4 and its reputation to have the shelter move out of town. The shelter has been looking for a new space for 15 years and had already begun making payments on the property. They were on the verge of realizing their dream until the mayor stopped the process. Gandhi has been quoted as saying 'The true nautre of a society is measured by the way it treats its animals." This issue provides an opportunity to show that we have evolved to a level of valuing humanity more than money. I have talked with many other Salem residents and we all agree that when it comes to important matters, we are willing to dip into our own pockets, and pay a few more dollars in taxes, whether it is to keep police and firefighters on the payroll, to improve the quality of our schools or to allow the shelter to move to the new location and remain in our city....issues important for different reasons, but they all matter to us. There is another meeting of the zoning board on Wednesday March 29 at 6:30 PM during which voting will take place to decide the future of the shelter. The meeting is open to the public. I sincerely hope that the Zoning Board of Appeals will vote in favor of issuing this wonderful and life-saving shelter the zoning permit it needs in order to move into these premises. > I have been told that the Mayor of Salem is in opposition to this proposed move because the shelter, as a non-profit entity, is not required to pay taxes. However, I also understand that the shelter has offered to pay the city of Salem an annual sum in lieu of taxes, a sum which is pretty much what the city had been receiving in taxes from Kelly Honda, and thus, I fail to see why there should be any opposition on the part of the city of Salem. The Northeast Animal Shelter has been operating their life-saving services tirelessly in the city of Salem for over 30 years, and it would truly be a shame to deny them the opportunity to move into much-needed larger quarters in order to continue the wonderful work they do. The Shelter's already small present quarters was further reduced this past year when they had to remove an entire row of cage space in order to make room for a quarantine area to comply with the new federal law, and as a result, they now have less cage space for housing animals than before. I am a resident of the town of Winthrop, Massachusetts, and a volunteer producer with WCAT, Winthrop's cable access television station, and I have had the honor for these past six years of working with the shelter in producing a monthly pet adoption television series which is broadcast on cable in four North Shore communities. This shelter is outstanding in the services it provides for both the homeless animals in their care as well as for the people who adopt them. I understand that the Zoning Board of Appeals is meeting again on Wednesday, March 29, 2006, and is expected to make a decision on the Shelter's request at that time. I would also like to express my support for the shelter moving into that location. I am a taxpayer in Salem and I totally disagree with the mayor's position of getting a business in that building in order to collect more taxes (especially for the relatively small amount it would generate). I believe the goodwill that is generated by the shelter along with the business generated for other local stores and tourist attractions (i.e. pet stores, restaurants, gift shops, etc) from people who come to the shelter, far outweighs the benefits of having aor-frofit business in that location. I am here to speak in support of the NORTHEAST ANIMAL SHELTER in their desire to relocate to their preferred site. Grafton is a small town of 15,000 people in central MA and home to Tufts University School of Veterinary Medicine and Animal Hospital, reported to be amongst the best in the country. As Salem supports its many Tax Exempt entities and forgoes lucrative real estate tax revenues, Grafton supports Tufts University which occupies 594 acres of Prime TAX EXEMPT undeveloped land, truly a valuable resource in today's real estate market. Unfortunately however, Tufts does not give back to the community as well as Salem's Tax Exempt beneficiaries. For this you should be proud. I recently adopted a 10 year-old cat named RAF from Northeast Animal Shelter to replace my last cat that I had adopted from them several years prior. Days after I had adopted him,he became sick with an upper respiratory infection that had afflicted some of the other cats at the facility. After incurring a $1,200 medical bill for less that 48 hours worth of emergency care at Tufts, I soon realized that I would run out of money before the cat would run out of run out of lives, or recover. Being an animal lover of limited financial resources I was faced with the very unpleasant and grim decision of euthanase my pet. My only alternative was to appeal to the Shelter to see if they had the capacity to nurse him back to health. Unfortunately, they reported to me that they were not a hospital and could not help me. When word spread at the Shelter that RAF was in trouble, Angela, a volunteer, appealed to the director who agreed to have RAF admitted to the New England Veterinary Clinic in Salem, at their expense so that RAF would live. RAF is now at the NEVC recovering in stable condition, as is my wallet. Like Salem, Grafton forgoes significant tax revenue in exercising its Social, Cultural and Moral responsibilities. In supporting tax-exempt organizations, Cities and Towns must look past the direct contribution that these tax revenues deliver, and recognize that the incidental benefits that these organizations provide via increased traffic and commerce drawn to their locals. For example, after taking RAF back to the Shelter this past Monday, I went to the Ground Round with my brother for dinner and stopped at the McDonalds for coffee. In addition to the commerce that I delivered, the Shelter will incur expenses at the NEVC, a tax paying entity. These TAX EXEMPTIONS are the costs of social, cultural and moral responsibility and Salem is not alone in shouldering these burdens. Unlike Tufts, a recipient of such support, NORTHEAST ANIMAL SHELTER gives back to their community, an in tum, the community well beyond Salem's borders gives back to Salem. r` 4 V N While the City could support the SHELTER with a less coveted parcel of land, it would deprive them from benefiting from a location that would grant them the presence and exposure to support their continued growth and contribution to their community. Through the support of NORTHEAST ANIMAL SHELTER and the benevolent acts of their volunteers, such as Angela, the City of Salem, does in fact reaps its benefits through the commerce of their clients. The difference in this equation is the SHELTER, who unlike Tufts, gives back to their community and provides the value to SALEM for the DIRECT TAX sacrifice that they make. For this reason, I appeal to the ZONING BOARD to look past the direct and measurable TAX value that this parcel of land represents, and rest on the comfort that SALEM does in fact receive the full commercial tax benefit from NORTHEAST ANIMAL SHELTER, through the indirect and resultant commerce that their patrons bring. Please allow NORTHEAST ANIMAL SHELTER to relocate to their desired location and receive the benefits that they have truly earned, so they may grow as prosper as proud benefit to your community.
