DECISION ON THE PETITION OF THON,AS, PHILIP .AND f•;ARY MCAULIFFE
FOR VARIANCES AT 333 HIGHLAND AVENUE (BPD)
A hearing on this petition was held January 14 , 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and
Strout. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioners, represented by Attorney Quinn, are requesting Variances to allow
two (2) principal buildings on one ( 1 ) lot and a further Variance from side yard
setbacks to allow the construction of building at 333 Highland Avenue, said
property being located in the Business Park Development District (BPD) . The in-
tended use of the new building is to house medical offices.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial. detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after viewing the plans, makes the following findings of fa.-t:
1 . There was no opposition, to the petition presented at the hearing;
2. The petitioners have secure- approval from the Salen-s Conservation
Co=ission, which has places an Order of Conditions on the proposed
development.
On the basis of the above findings of' fact, and on the evidence presented, the
Board of Appeal concludes as. follows:
1 . Special conditions exist .which especially affect the subject property
but not the district generally;
2. Literal enforcement of the provisions of the Ordinance would involve
substantial hardship to the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
requested Variances, subject to the following terms and conditions:
1 . That all the reouirements of the Conservation Commission' s Order of
Conditions be complied with by the petitioners;
2. That the building be constructed as per the plans submitted to the
Zoning Board of Appeal;
3. That a Certificate of Occupancy be obtained;
4. That all applicable provisions of the State Building Code, Fire
Prevention Code, City Ordinances, and Massachusetts General Laws
relative to fire safety be complied with;
5• That all the requirements of the Salem Planning Board be adhered to;
6. That the new building not be occupied by more than sixteen ( 16)
physicians;
7 . That the petitioners maintain not less than eighty nine (89)
parking spaces on the site of the new building, said parking spaces
to comply with all the requirements of the Salem Zoning Ordinance.

Dear Mr. Hacker:
Upon reflection, I would like to suggest a substitute
to the language proposed in my January 22 , 1987 letter to
the Board for the parking space condition in the variances
grant to the McAuliffes . The substitute would be as
follows :
"There shall at all times be at
least 89 legally conforming
parking spaces provided on the
lot, as shown on the site plan
drawn by Lindentree Corporation,
dated 12/26/86 and submitted to
the Board. "
One reason for this alternative suggestion is that
this site plan was the one used at the hearing as the
genesis for the 89 space limitation. Further, Section
VII C-4 of the Zoning Ordinance only requires angle
parking stalls such as these to have dimensions of 9 feet
wide and 19 feet long (rather than the 9 ' X 20 ' mentioned
in my previous letter) , and upon a second look at the plan
it is possible that some of the stalls may have been
designed at larger dimensions while others were designed at
slightly smaller, but still conforming, dimensions .

I , the undersigned, have reviewed:
1 . the Application of Thomas McAuliffe , Philip J.
McAuliffe and Mary L. McAuliffe , owners of property
located at 333 Highland Avenue, Salem, Massachusetts, for a
proposed variance from Sections II (B) (26) and
III (C) (9) of the Salem Zoning Ordinance, so as to allow
the existence of two principal buildings on the same lot,
and also for a proposed variance from the side yard
requirement of Section VI (D) , Table IV of the Salem
Zoning Ordinance, so as to allow the construction of a new
building with only a ten (10 ' ) foot side yard setback; and
2 . the plans to be submitted at the scheduled hearing by the
Salem Board of Appeals on the Application; and
I support the grant of the variance by the City of Salem Board
of Appeals.
