The petitioner Lesley Linder seeks relief pursuant to sections 8-2, 8-4, 8-6, 9-4 and 9-5 to allow construction of two rear decks for the property located at 14-16 Leach Street, Salem, in the Two-Family Residential (R-2)zoning district. The petitioner is requesting a Special Permit to alter an existing non-conforming structure and a variance from the thirty (30) foot minimum rear yard setback requirement of the City of Salem Zoning Ordinance (Sec 6-4,Table I) to approximately eleven (11) feet for the construction of two 8 ft by 12 ft decks. The Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the Petition submitted, makes the following findings of fact: 1. Petitioner owns a multifamily house at 14-16 Leach Street, which presently houses 4 residential rental units. The property is an existing nonconforming structure and use within the R-2 zoning district. 2. Petitioner, who was represented by Philip Posner, Esq., constructed two 8 by 12 ft. decks on the rear of the property without obtaining required zoning relief and without obtaining a building permit. He appears before this Board at the request of the Building Inspector's office, which notified him of these violations. 3. Mr. Posner stated that his client was now attempting to comply with building codes and regulations He further stated that the decks were constructed in an effort to enhance and improve the property. r 4. Ward Five City Councilor Matthew Veno opposed the petition on the ground that the decks would be a nuisance to neighbors due to the density of the surrounding neighborhood. On the basis of the above findings of fact, including all evidence presented at the public hearing, the Zoning Board of Appeals concludes as follows: 1. The petitioner's request for a Special Permit to alter an existing non- conforming structure and a variance from the thirty(30) foot minimum rear yard setback requirement of the City of Salem Zoning Ordinance (Sec 6-4, Table I)to approximately eleven (11) feet for the construction of two 8 ft by 12 ft decks does not constitute a substantial detriment to the public good. 2. The requested relief does not nullify or substantially derogate from the intent or purpose of the zoning ordinance. 3. A literal enforcement of the zoning ordinance would create a substantial hardship to the petitioner. 4. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. In consideration of the above, the Salem Board of Appeals voted, four(4) in favor (Cohen,Debski, Dionne, Hams) and one (1) opposed (Belair), to grant the request for a Special Permit and a Variance, subject to the following terms,conditions, and safeguards: 1. Petitioner shall comply with all city and state statutes, ordinances,codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to, including the Fire Department policy regarding use of open flames for cooking on exterior decks. 4. Exterior finishes of the new construction shall be in harmony with the existing structure. 5. A Certificate of Inspection is to be obtained. 6. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to, the Planning Board. r f 7. The Petitioner shall submit As-Built plans to the Building Inspector within thirty (30) days of the date of this decision. S. The Petitioner shall consult the City of Salem Board of Health to determine an appropriate permanent enclosure for trash barrels and shall install and maintain such structure on the side of the house at all times while any units are rented. The petitioner is requesting a Variance from a rear yard setback and a Special Permit to alter an existing non-conforming structure to allow the construction of decks at the rear of the property. The petitioner has constructed the porches/decks on her property in violation of the rear yard setback requirement of thirty(30) feet. The petitioner has also enlarged a previously non-conforming structure by constructing these decks and is asking for the Special Permit to allow for the increase in size of the decks for the property located at 14-16 Leach Street in an R-2 zone. The Variance,which has been requested,may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Seciton 5-30), which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6 and 9-4, grant Special Permits for alterations and reconstruction of non-conforming structures, and for changes, enlargement, extension or expansion of non-conforming lots, land, structures and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing non-conforming use to the neighborhood. In more general terms, this Board when reviewing Special Permit requests is guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. The Petitioner, Lesley Linder is the owner of the property located at 14-16 Leach Street. The property is located in an R-2 District. The Petitioner was represented by Attorney Philip Posner, 900 Cummings Center, 207-T, Beverly, MA 01915. 2. The Petitioner is requesting a Variance and Special Permit to construct decks for the rear of the property. The decks have already been built in violation of the State Building Code requiring the Petitioner to obtain a Building permit prior to beginning any construction. The City Building Inspector filed a Complaint in the Salem District Court to require the Petitioner to stop work on the project and to be brought into compliance with State and City Codes and/or Ordinances. 3. The Petitioner has constructed the decks in violation of the rear yard setback requirement of thirty(30) feet by increasing the size of the decks from (8) eight feet to (12) twelve feet. 4. Councilor Matthew Veno spoke in opposition to the requests for a Variance and Special Permit stating that he was distressed that the Petitioner who owns other properties should have been aware of the requirement to obtain a building permit prior to beginning any construction. He suggested that this behavior should not be rewarded. 5. The tenants residing at 14-16 Leach Street provided a letter in support of the Petitioner; as the decks have enriched their living space. On the basis of the above findings of fact, including all evidence presented at the public hearing, including, but not limited to, the Petition and plans, the Zoning Board of Appeals finds as follows; 1. The petitioner may construct the year porches/decks in the rear of the property. 2. The petitioner's request for a variance to allow the rear porches/decks in the rear of the residence does not constitute a substantial detriment to the public good. 3. The porches/decks do not nullify or substantially derogate from the intent or purpose of the zoning ordinance. 4. The petitioner's lot size and shape prohibit locating the addition in another location. 5. The petitioner's lot size and coverage restrictions do not generally occur in the district and are specific to their land. 6. A literal enforcement of the zoning ordinance would create a substantial hardship to the petitioner. J' 7. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. 8. The Special Permit can be granted in harmony with the neighborhood and will promote the public health, safety, convenience and welfare of the City's inhabitants. In consideration of the above, the Salem Board of Appeals voted, four(4)in favor: (Cohen,Dionne, Debski, Hams) and one(1) opposed: (Belair)to grant the requests for a variance and special permit subject to the following terms, conditions, and safeguards as noted below: 1.
