The petitioner is requesting a Special Permit to allow construction of an addition for additional office space and production facilities in this B-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as 'follows: e Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargements, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantial) more detrimental than the P Y existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after hearing the evidence presented at the hearing and after viewing the plan, makes the following findings of fact: 1 .y The company has been in business for over thirty (30) years on this site; 2. The company, which employs 60-70 people on 3 shifts has ample parking on site; 3. After clarification of the plans neighbors and abutters were in favor. On the basis of the above findings of fact, and on the evidence presented at hearing, the Board of Appeal concludes as follows: 1 . Petitioners plan as altered will not be substantially detrimental to the public good; 2. The plan does not substantially derogate from or nullify the intent and purpose of the Ordinance. � I � I , r I DECISION ON THE PETITION OF SUNBURST FRUIT JUICES,,INC. FOR A SPECIAL PERMIT FOR 220 HIGHLAND AVE. , SALEM page two Therefore, the Zoning'Board of Appeal voted unanimously, 5-0, to grant the requested relief subject to the following conditions: 1 . Plans for the proposed addition must meet conditions set forth in a letter to the Board from the Salem Fire Dept. ; 2. The trailer now located on the site must be removed; 3. A decree from land court be furnished to the City Planner stating that Rockmere Street does not extend to Highland Ave. ; 4. A Covenant between petitioner and Mr. Richard Swiniuch be given relative to the use of the property in the R-1 zone; 5. Approval is contingent upon resolution of water problems noted in a letter by the Director of Public Services and all conditions must be met before a Certificate of Occupancy be obtained.
