AMENDED DECISION ON THE PETITION OF FIVE ELEVEN L REALTY TRUST FOR A
VARIANCE AT'S-11 -IbACH ST: (B-1)

A hearing on this petition was held on April 20, 1988 with the following
Board Menbers present: James Hacker, chairman; Richard A. Bencal, Secretary;
Messrs. , James Flaming and Associate Member Arthur LaBreque. Notice of the
.hearing was sent to abutters and others and notices of the hearing were
properly published in the Salon Evening News in accordance with Massachusetts
General laws Chapter 40A.
Petitioner is requesting Variance to allow four stores to be converted to
four residential units in this B-1 zone.
The Variance which has been requested nay be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforoenent of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from
the intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing and
after viewing the plans, makes the following findings of fact:
1. Less traffic would be generated if the stores were converted to
residential units.
2. One letter was presented in support, two people spoke in opposition.
3. The present store space is small and unrentable.
4. The two persons who spoke in opposition also felt the prenesis were
too small for a viable business.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would involve substantial
hardship to the petitioner;
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously 4-0 to grant the
petitioner the variance requested, subject to the following conditions:

2. Maintain Six (6) legal parking spaces on site.
3. No further renovation be done to the property without the obtaining
of any and all proper and legal permits as required by the City
of Salon.

frau the date of the filing of this decision, without prejudice
to petitioners right to request such variances be granted again
after their experation.
5. A certificate of occupancy for each unit be obtained.

Dear Mr. Scott:
The purpose of this letter is to provide notice that certain premises owned by you,or
under your control have been used for the illegal keeping, sale, or manufacturing of controlled
substances,as defined in Massachusetts General Laws, Chapter 94C, Section 1.
Specifically,the premises located at 5 '/z Leach Street Salem, MA 01970 were used for
such purposes. See the enclosed police report for the specific dates and times.
Massachusetts General Laws Chapter 139 Section 20 provides in pertinent part,
"Whoever knowingly lets the premises owned by him,or trader his control, for the purposes
of....the illegal keeping, sale,or manufacture of controlled substances,as defined in section one
of chapter ninety-four C,or knowingly permits such premises,while under his control,to be used
for such purposes,or after due notice from any such use omits to take reasonable measures to
eject therefrom the persons occupying the same as soon as it can be lawfully done, shall be
punished by a fine of not less than one hundred nor more that one thousand dollars or by
imprisonment for not less than three months,nor more than one year, or both."
The Salem Police Department will be enforcing the provisions of M.G.L. ch. 139, sect.
20 (copy attached),to prevent drug trafficking in residential neighborhoods and to promote a
safer environment for families living in rental housing.

Chapter 139:Section 20 Aiding or permitting nuisance
Section 20.Whoever knowingly lets premises owned by him,or under his control,for the purposes of prostitution,assignation,
lewdness,illegal gaming,or the illegal keeping or sale of alcoholic beverages,as defined in section one of chapter one hundred and
thirty-eight,or the housing of a premises which is licensed under section twelve of said chapter one hundred and thirty-eight and on
or in such premises alcoholic beverages are habitually served to persons who are intoxicated or alcoholic beverages are served to
persons whom the operators of said premises know or have reason to know will operate a motor vehicle under the influence of
intoxicating liquor in violation of subdivision(1)of section twenty-four of chapter ninety or the illegal keeping,sale or manufacture
of controlled substances,as defined in section one of chapter ninety-four C,or knowingly permits such premises,while under his
control,to be used for such purposes,or after due notice of any such use omits to take all reasonable measures to eject therefrom the
persons occupying the same as soon as it can lawfully be done,shall be punished by a fine of not less than one hundred nor more
than one thousand dollars or by imprisonment for not less than three months nor more than one year,or both.
