DECISION ON THE PETITION OF ROBERT D. FARLEY (PETITIONER) ,
CHERRY HILL REALTY TRUST (OWNERS) FOR APPROVAL OF A REVISION
OF SITE PLAN AT 114R HIGHLAND AVE. (R-1 )
A hearing on this petition was held Tuesday, September 29, 1987 with the following .
Board Members present: James Fleming, Vice Chairman; Richard Bencal, Secretary;
Peter Strout and Associate Member Arthur LaBrecque. Notice of the hearing was sent
to abutters and others and notices of the hearing were properly advertised in the
Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petition, Architect for Cherry Hill Realty Trust, is requesting approval of revision
of the site plan, originally approved by the Board of Appeal on January 21 , 1987 for
this property which is located in an R-1 zone.
The Board of Appeal, after hearing all of the evidence presented, makes the
following findings of fact:
1 . The change in the position of the building on site was requested by
and done to meet the concerns of the City's Public Works Department;
2. No opposition or support was voiced to the proposed change.
Therefore, the Zoning Board of Appeal concludes that the proposed change will not
adversely affect the original plan submitted and will better serve the needs of the
area with the building moved to the new location. The Board of Appeal voted
unanimously, 4-0, to grant the requested revision on the following conditions:
1 . The location of the building be moved to the new site as per
the new plans submitted at this hearing;
2. Twenty two (22) legal spaces be maintained on site.
