The petitioner is also requesting a variance from the provisions of 8.2 Entrance Corridor Overlay District to exceed the number of curbcuts at 111 HIGHLAND AVE. (Map 14,Lot 199)(8-1 Zoning District and ECOD) A public hearing on the above Petition was opened on October 18, 2017 pursuant to M.G.L Ch. 40A, § 11 and the hearing was continued on November 15, 2017. The hearing was dosed on December 20, 2017 with the following Salem Board of Appeals members present Peter A. Copelas (Vice- Chair), Tom Watkins, Mike Duffy,Jimmy Tsitsinos,Jim Hacker (alternate). The petitioner is seeking a special permit per Sec. 3.3.2 Nonconforming Uses, to allow a change from a service station and storage facility to four (4) new dwelling units and variances from the provisions of Sec. 4.1.1 Table of Dimensional Requirements of the Salem Zoning Ordinance to exceed the minimum lot area per dwelling unit, minimum rear yard setback, maximum height requirements. The petitioner is also requesting a variance from the provisions of 8.2 Entrance Corridor Overlay District to exceed the number of curbcuts. Statements of fact: 1. In the petition date-stamped September 25, 2017, the Petitioner requested a special permit per Sec. 3.3.2 Nonconforming Uses, to allow a change from a service station and storage facility to four (4) new dwelling units and variances from the provisions of Sec. 4.1.1 Tabk of Dimensional Requirements of the Salem Zoning Ordinance, to exceed the minimum lot area per dwelling unit, minimum rear yard setback, maximum height requirements. The petitioner is also requesting a variance from the provisions of 8.2 Entrance Corridor Overlay District to exceed the number of curbcuts. 2. Attorney Scott Grover and architect Dan Ricciarelli of Seger Architects presented the petition. 3. The property is located in an R-1 Zoning District and Entrance Corridor Overlay District. 4. At the October 18, 2017 the petitioner was seeking a special permit per Sec. 3.3.2 Nonconforming Uses,to allow a change from a service station and storage facility to four (4) new dwelling units and variances from the provisions of Sec. 4.1.1 Tabk of Dimensional Requirements of the Salem Zoning Ordinance, to exceed the minimum lot area per dwelling unit, minimum rear yard setback, maximum height requirements. The petitioner is also requesting a variance from the provisions of 8.2 Entrance Corridor Overlay District to exceed the number of curbcuts. 5. At the October 18, 2017 meeting, the petitioner received substantial comments from the public and the Department of Planning and Community Development. On November 15, 2017, the petitioner requested a continuation to the next regularly scheduled meeting on December 20,2017. No testimony was heard on that date. 7. The petitioner submitted revised plans dated December 18, 2017. The petitioner reduced the number of dwelling units from four (4) to two (2) units after meeting with the neighbors. The petitioner also reduced the size of the building, and reconfigured the layout of the proposed development such that there is only one (1) driveway proposed off of Wilson Road rather than the four (4) driveways previously proposed. The substantial redesign of the project eliminated the need for the petitioner to request the following. minimum rear yard setback, maximum height requirements and a variance to exceed the number of curbcuts. 8. The petitioner revised the petition and is requesting a special permit per Sec. 3.3.2 Nonconforming Uses, to allow a change from a service station and storage facility to four (4) new dwelling units and variances from the provisions of Sec. 4.1.1 Table of Dimensional Requitrmews of the Salem Zoning Ordinance, to exceed the minimum lot area per dwelling unit. 9. The petitioner is proposing four (4) parking spaces, which exceeds the number of parking spaces required per dwelling unit. 10. The petitioner states that the petitioner needs a variance for minimum lot area per dwelling unit. The petitioner is proposing a lot area per dwelling unit of+/- 4,200 square feet where 15,000 square feet per dwelling unit is required. 11. The petitioner is proposing to close the existing curbcut along Highland Ave. and install an ADA compliant sidewalk along the property boundaries of this parcel in compliance with the proposed plan and the requirements of the City of Salem Engineering Department. 12. At the public hearing one (1) member of the public spoke in favor of and three (3) opposed to the petition due to concerns about the height of the structure and proximity of the addition to the adjacent parceL The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, makes the following findings: The Board finds that proposed non-conforming use is less detrimental that the existing non- conforming use. Special Permit Findings: 1. There are social, economic and community needs served by the proposal for moderately priced housing and the petitioner is proposing to convert the use of the property from a commercial use to a residential property,which is a use that is in keeping with the underlying zoning district. 2. There will be no impacts to traffic flow and safety,including parking and loading. 3. There will be no impact to the adequacy of utilities and other public services. 4. There will be no impacts on the natural environment,including drainage as the petitioner is proposing to remove large areas of impervious surface, which will be replaced with landscaping materials and improve drainage. 5. The proposed residential use is more in keeping with the character of the neighborhood and the underlying zoning. The potential fiscal impact, including impact on City and tax base and employment is positive as the project will increase the assessed value of the property, increase tax revenue for the City, and bring more housing opportunities,which in turn support economic revitalization. Variance Findings: 1. Special conditions and circumstances that especially affect the land, building, or structure involved, generally not affecting other lands,buildings and structures in the same district. 2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the applicant as the lot size of the property is only 8, 718 +/- square feet and the literal enforcement of the ordinance would not allow any residential use of this residentially zoned parcel. 3. Desirable relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5)(Peter A. Copelas (Vice- Chair), Tom Watkins, Mike Duffy, Jimmy Tsitsinos,Jim Hacker) in favor and none (0) opposed, to allow a special permit per Sec. 3.3.2 Nonconforming Uses, to allow a change from a storage facility to four (4) new dwelling units and variances from the provisions of Sec. 4.1.1 Table of Dimensional Reguinments of the Salem Zoning Ordinance, to exceed the minimum lot area per dwelling unit subject to the following terms, conditions and safeguards: Standard Conditions: 1. Petitioner shall comply with all city and state statues, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner and Engineering Department. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Exterior finished of the new construction shall be in harmony with the existing structure. 6. A Certificate of Inspection is to be obtained. 7. A Certificate of Occupancy is to be obtained. 8. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to the Planning Board. Peter A.
