DECISION ON THE PETITION OF ACQUISITION 1987 TRUST FOR
VARIANCES AT 74 HIGHLAND AVE. (R-2)
A hearing was held on this petition November 23, 1987 with the following Board
Members present: James Hacker, Chairman; Mr. Strout and Associate Members Dore
and Labrecque. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
Petitioners, owners of the property, are requesting variances to allow the
property to be used for a parking area. Property is located in an R-2 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . There was no opposition;
2. Neighborhood appeared to be in favor;
3. A severe parking problem currently exist and this additional parking
will help to remedy this situation.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would work a substantial
hardship on the petitioner;
3. The relief request can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
Variance requested, subject to the following conditions:
1 . A demolition permit be obtained prior to the commencement of the
actual demolition;
2. Removal of asbestos, if any, be done according to all state and local
regulations;
3. Parking be installed as per plans submitted, including green space
and plantings;
4. Eighteen (18) parking spaces be maintained;
5. Positively no access directly to Highland Avenue from the parking
lot.

Dear Mr. Munroe;
The Historical Commission would like to express their concern over
the demolition proposal for 74 Highland Ave. that is coming before
the Board of Appeals the night of November 18, 1987. The house,
built in the 1840's, should recieve special consideration before
any decision is made on its fate. We would also like to remind you
and the owners that any demolition of a building 50 years or older
must first come before the Historical Commission. There,the commission
will to decide whether it is neccessary to invoke the Demolition
Delay Ordinance, delaying the demolition for up to six months during
which time a feasible reuse could be found for the existing building.

The Petitioner is the owner of property situated at 74 Highland
Avenue . Said property was purchased in connection with the
ownership of property situated at 84 Highland Avenue. The
Petitioner desires to utilize the area formerly occupied by the
house at 74 Highland Avenue for employee parking for the various
retail businesses at 84 Highland Avenue. This will help the
congestion that occurs at times at 84 Highland Avenue. In
addition, an existing curb cut onto Highland Avenue for the
existing property will be closed and entrance and exit to the
employee parking area will be through the existing space at 84
Highland Avenue, adjacent to the above property. The Petitioner
paid a very substantial amount of money for the property,
probably in excess of its true value, but the importance of an
area for employee parking to assist the overall situation was an
overriding decision. The Petitioner respectfully requests that
variances be granted so as to enable the Petitioner to utilize
the area at 74 Highland Avenue as a parking area, all as shown on
the submitted plans.
