As you are aware the variances granted by the Zoning Board of Appeal on January 15, 1986 have expired and must be re-applied for. I see no reason except a change in the submitted plans and wordage of the application indicating that there will be additional offices on the lower level, to change the application. It would appear, if the intent is tomarket the property for business offices that the ten ( 10) parking spaces shown would be adequate. However, should the spaces be for professional offices then of course the parking would have to conform tothe Ordinance or variance from parking be requested. Once your request for the necessary variances has been approved by the Zoning Board of Appeal I would be more than pleased to advise your client of the steps necessary to obtain a building permit. A hearing on this petition was held January 15, 1986 with the following Board Members present: James Hacker, Chairman; Messrs Ch na$$r LuW' k and Associate Members Bencal and LaBrecque. Petitioner, the owner of the property, requests permissioh'tb divide his property into two lots as shown on a plan submitted to the Board, simultaneously he requests variances for proposed Lot 1B as to lot area, lot width, and front yard requirements, and variances for proposed lot 2B as to lot width, area, front and side yard requirements. Property is located in a B-1 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings, and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise to petitioner; and c. desirable relief may be granted without substantial detriment to the public good and wihtout nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. We had obtained a variance for Joe Carter. Joe acted on the variance and obtained a demolition permit and removed the building. A proposed new purchaser wishes to have additional offices on the lower level of the building. As you remember, the lower level is on a slant so part of it would apparently be below grade. Please try to give me an idea as to what I might need in the form of a variance. I believe the building complies with the height limitations and everything is all the same except for putting in additional space in what was the basement . Any thoughts you might have would be helpful . PINAULT REQUESTING VARIANCES FOR 95 and 99 LAWRENCE STREET A hearing on this Petition was held on June 10, 1981 with the following Board Members present: Douglas Hopper, Chairman, Messrs. Feeherry and Hacker and Associate Member Lusinski. Variances are required because this property is presently in both a R-1 and R-2 district where the proposed division of the property would be prohibited without the grant of variances from side yard restrictions as well as lot area require- ments. The property has since 1922 had the presently existing buildings on this property. 2. The proposed division of this property into two lots will place a lot line across the property which will cause the two lots to be in violation of the Zoning Ordinance because of the absence of sufficient sideyards and lot area. 3. The proposed division of the property will not in any way involve an alteration of the existing structures on this property. On the basis of the above findings of fact, and the evidence presented at the public hearing, the Board of Appeals concludes as follows: 1. The property in question is unique because of the existing structure on the property which structures make it impossible to divide this property into two lots without in some way violating the provisions of the City's Zoning Ordinance. 2. The conditions described above especially affect the land in question but do not generally affect the zoning district in which the land.is located.
