DECISION OF THE PETITION OF ERIC OLSON REQUESTING A VARIANCE FOR
THE PROPERTY LOCATED AT 1 HIGH AVENUE R-1
A hearing on this petition was held March 15, 2000 with the following Board Members
present: Nina Cohen, Chairman, Stephen Harris, Ronald Harrison, Richard Dionne and
Stephen Buczko. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting Variances from maximum height of building from 2 %: to 3
stories for addition for the property located at 1 High Avenue R-1.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Homeowner Eric Olson sought to enlarge his residence by constructing a dormer on
the rear roof, below the roofline, thus extending the height of the house from 2 '/:to 3
stories. The maximum height of the roof ridge remains unchanged.
2. Neighbors Roger and Marilyn Poitras of 4 Cross Ave. opposed the granting of the
variance on the grounds that the extension would deprive them of privacy and
sunlight. Mike Fisher and Deb Clay of 14 Cheval Ave. also opposed the plan on the
same grounds, and argued that the change would negatively affect the value of their
property.
3. Ward 1 Councillor Scott LaCava, opposed the change because of the impact on the
neighbors, several of whom had called him to register their opposition.

4. Mr. Olson stated that he would cut down a large maple tree on the southeast corner
of the lot to allow additional sunlight to reach the neighboring lots.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 4-1, to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state stature ordinances, codes and codes
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Inspector.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy shall be obtained.
6. Exterior finishes of the new construction shall be in harmony with the existing
structure.
7. Maple tree on the southeast corner of the lot to be removed.

Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to
Massachusetts General Laws Chapter 40A, Section 11. The Variance or Special
Permit granted herein shall not take effect until a copy of the decision bearing the
certificate of the City Clerk that 20 days have elapsed and no appeal has been filed,
or that, if such appeal has been filed, that is has been dismissed or denied is
recorded in the South Essex Registry of Deeds and indexed under the name of the
owner of record or is recorded and noted on the owner's Certificate of Title.

Dear Members of the Board.
Let.me_begimby.saying-that the enclosed lett�distributed.byMr.
Olson to "neighboring Willowites"glaringly omitted two of the.families
who will be most_dramatically impacted by his plans._(ourselves.and Deb
Clay) This lack of consideration in the early stages is disturbing and leads
us to wonder.what other.surprises.might arise-with regard-tothisalteration
project down the road.
Our.neighborhood is extremely congested Mr__Olson's house.is one
of the largest in the neighborhood It touches most property borders. Any
shred of privacy we.may.enjoy now will be_virtually eliminated with the
construction of shed dormers and additional windows looking down on our
property.
In addition to losingprivaey-this plan will further prevent sunlight
from reaching our home and yard(warming us in the winter and affording
us the..ability.to utilize our yard in the summer for gardening).
As we have lived here many years, we have felt assured that the
zoning-ordinances would protect our property and its value.
We have further concerns that the new owners at 2 Cross Ave. may
not have been adequately.informed as to the impact of this renovation.
Thank you for taking our concerns into consideration.

RE: One High Avenue
To My Neighbors In Salem Willows:
I realize my recent submission for renovation approval with the City of Salem, has
aroused much speculation among my neighboring ".Willowites" . May I take a moment
to assure you, my renovations do not involve a brothel, a rental, a condo or a
"dot com" start up company on the third floor. (If I did have a dot com company,
I 'd be moving not renovating! ) Much to the contrary, I am spiffing up my attic to
accomadate a new wife, who will be relocating from Marblehead to take up residence
in the Olson Manor. Since I have known the joys of marriage before, I thought a
whole lot of space might be the smart way to go.
Finally, there will be no asthetic changes to the front of the house and very
minor alterations to the back. No changes to the height or the width. The original
"Victorian" lines will remain!

The Salem Historical Commission is in receipt of your agenda for March 15,2000 and offers the following
comments:
• 135-137 Boston, 139-139'/2 Boston,3 Rawlins Street—Please be reminded that any proposed demolition of
these properties will kick in the Demolition Delay Ordinance which states that a demolition permit cannot be
obtained until six months have elapsed from the date that a demolition permit is requested unless the Salem
Historical Commission issues a Waiver of the Demolition Delay Ordinance to allow immediate demolition.
• Hig _h Avenue~Please be advised that this property is located within the Salem Willows National Register
Di—strict. Enclosed please find a copy of the Building Survey form indicating that it was built between 1871
and 1891. While alterations to this property do not fall within the jurisdiction of the Commission and the
Commission takes no position on this petition, if requested by the Board of Appeal as a condition of approval,
we would be pleased to offer design review to ensure that the proposed project is sympathetic to the historic
property and to the National Register District.
• 3-5 Pleasant St. Enclosed please find a copy of the Building Survey form indicating that this property was
built before 1874. While alterations to this property do not fall within the jurisdiction of the Commission and
the Commission takes no position on this petition„ if requested by the Board of Appeal as a condition of
