(State Building Code Section 109.1 .11 that the owner DEFINITION OF HOMEOWNER: Person(s) who owns a parcel of land on which he/she resides or intends to re- side, on which there is, or is intended to be, a one to six family dwelling, attached or detached structures accessory to'such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner" shall submit to the Building Official , on a form acceptable to the Building Official , that he/she shall be res onsible for all such work performed under the buildingpermit. Section 109.1 .1 The undersigned "homeowner" assumes responsibility for compliance with the State Building code and other applicable codes, by-laws, rules and regulations. The undersigned "homeowner" certifies that he/she understands the City of Salem Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and re uu-irreemeents. HOMEOWNER'S SIGNATURE— APPROVAL OF BUILDING OFFICIAL NOTE: Three family dwellings 35,000 cubic feet, or larger, will be required to comply with State Building Code Section 127.0, Construction Control . HOME OWNER'S EXEMPTION The Code states that: "Any Home Owner performing work for which a building permit is required shall be exempt from the provisions of this section (Section 109.1 .1 - Licensing of Construction Supervisors) ; provided that is a Home Owner engages a person(s) for hire to do such work, that such Home Owner shall act as supervisor. " Many Home Owners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q, Rules and Regulations for Licensing Construction Supervisors, Section 2.15) . This lack of aware- ness often results in serious problems, particularly when the Home Owner hires unlicensed persons. In this case your Board cannot proceed against the unlicensed person as it would with licensed Supervisor. The Home Owner acting as supervisor is ultimately responsible. To ensure that the Home Owner is fully aware of his/her responsibilities, many communities require, as part of the permit application, that the Home Owner certify that he/she understands the responsibilities of a supervisor. On the last page of this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community. ofIem, Ctt ttc #use##sem, DECISION ON THE PETITION OF NAPOLEON LEBLANC FOR VARIANCES FOR of LAWRENCE`ST A hearing on this petition was held September 29, 1987 with the following Board Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Strout and Associate Member LaBrecoue. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published. in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting variances from lot size, density, setbacks, lot width and area per dwelling unit to allow parcel to be divided into two lots, A & B,, and to construct a single family on lot B. Property is located in a B-1/R-2 district. The Variances which have been requested may be granted upon a finding of the Board that: C= a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; p _J - - Cn b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, financial or otherwise, to petitioner; C= . c. desirable relief may be granted without- substantial detriment to the C= m public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . There was no opposition to the plan; 2. The proposed division would create two lots that would conform with other lots in the area; 3. The configuration of the lot makes it difficult to maintain. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district in general; 2. Literal enforcement of the Ordinance would work a substantial hardship on the petitioner; 3. The relief requested can be granted without detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. DECISION ON THE PETITION OF NAPOLEON LEBLANCE FOR VARIANCES FOR 95 LAWRENCE ST. , SALEM page two Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the variances requested, subject to the following conditions: 1 . All work be done in strict accordance with plans, as amended September 29, 1987 and submitted to the Board; 2. Plans for construction be presented to the Fire Prevention Bureau prior to issuance of a Building Permit; 3. Proposed construct conform to Massachusetts State Building Code; 4. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws chapter 40A. Petitioner, owner of the property, is requesting variances from lot size, density, setbacks, lot width and area per dwelling unit to allow parcel to be divided and to construct a single family dwelling on the new created lot. Property is located in a B-1/R-2 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 .. There was no opposition to the plan. 2. The Variances were allowed at a hearing on September 29, 1987 but construction did not begin. 3. LeBLANC and RAYMOND 0. PINAULT and NANCY L. PINAULT REQUESTING VARIANCES FOR 95 and 99 LAWRENCE STREET A hearing on this Petition was held on June 10, 1981 with the following Board Members present: Douglas Hopper, Chairman, Messrs. Feeherry and Hacker and Associate Member Lusinski. Notices of the hearing were sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioners have requested variances to divide the property into two distinct lots. Variances are required because this property is presently in both a R-1 and R-2 district where the proposed division of the property would be prohibited without the grant of variances from side yard restrictions as well as lot area require- ments. The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1. The property has since 1922 had the presently existing buildings on this property. 2. The proposed division of this property into two lots will place a lot line across the property which will cause the two lots to be in violation of the Zoning. Ordinance because of the absence of sufficient sideyards and lot area. 3. The proposed division of the property will.not in any way involve an alteration of the existing structures on this property. On the basis of the above findings of fact, and the evidence presented at the public hearing, the Board of Appeals concludes as follows: 1. The property in question is unique because of the existing structure on the property which structures make it impossible to divide this property into two lots without in some way violating the provisions of the City's Zoning Ordinance. 2. The conditions described above especially affect the land in question but do not generally affect the zoning district in which the land.is located. DECISION - JUNE 10, 1981 - LeBLANC & PINAULT - PAGE TWO '81 JUN 17 A10 :07 CITY CLERK'S OFFICE SALE;', ?4r SS 3. The conditions described above which affect the land in question, but not the zoning district generally cause a special hardship to the Petitioners by complicating separate ownership of the two residences on the property. k. The desired variance may be granted without substantial detriment to the public good. Therefore, the Board of Zoning Appeals unanimously voted in favor of granting the requested relief. The Board grants a .variance to the Petitioners on the following terms and conditions: The Petitioners are granted a variance from sideyard requirements and lot area requirements to allow the division of this property into two lots as described on the plans submitted to this Board.
